The City posted 'do not occupy' notices on each of the units located on the second floor. This action is a follow -up to the notice dated March 30, 2005, in which you were required to provide a preliminary report from a licensed Architect or Engineer addressing the soundness of the roof, balcony, and stairs for hazard to the tenants. This report was required to be submitted to the City no later than April 13, 2005. The morning of April 14, the Community Development Department contacted by telephone the engineer contracted to prepare the preliminary report and was told that the report would not be available until the end of the day, but that the stairways and balconies were found to be unsafe and additional work would be required to determine that the roof was structurally sound. At the time the City and Fire District were posting the second floor apartments, several of the residents indicated that they had not been told by the apartment manager that the City and District had conducted a life /safety/fire inspection and indicated that it was possible that the apartments would have to be vacated. This is disturbing as the Community Development Department had provided a 'notice of probable action' to the apartment manager on March 30, 2005, for distribution to the tenants. This notice explained that the apartments may have to be vacated, pending the structural report. It appears that the possibility that the second floor may have to be vacated was not communicated to the tenants, which then denied them the opportunity to find alternate housing. It is the property owners responsibility to comply the provisions of the revocation of the certificate of occupancy and the posted 'do not occupy' notice. I think it was clear that if the structural report indicated that there were life /aafety issues, the building would need to be vacated, as indicated in the notice of probable action (attached to the 1st letter), which was provided to Rob on the 30th for distribution to the tenants. My understanding, from my building inspectors discussion with the Engineer this morning, that the stairs were an issue, :wt that additional work would be required to determine if the roof were safe, but we still. don't have a copy of the report. You have indicated that the Cit�r will not pull the do not occupy until such time as the needed repairs are completed. However, you also indicated that the city would not impose the civil penalties and other enforcement remedies referenced in you April 14, 2005 so long as my client was making progress relative to getting the deficiencies corrected. If the City was going to change th.it position at any time you indicated you would give me notice ahead of time. With regards to the Fire District's inspection and punch list, I believe a significant number of those issues have been addressed. There are several items that in our opinion require immediate attention and others that we suggest further investigation so as to determine the extent of the issue. Parties present include Ian Frank with Anderson- Peyton, Rob Edwards with Nisqually Valley Golf Course, and Larry Hanson with the City of Yelm building department. At the exterior of the building, elevated wood framed walkways were noticeably insufficiently maintained. Wom paint has left bare lumber and sheathing to be exposed to the elements for a prolonged time. Additionally it appears that many of the structural elements are oventressed. The joists look to have severe deflection under dead load only. The entire walkway is sloped away from the structure apparently beyond the required amount for water runoff. This would suggest that the metal braces are also overstressed. In our opinion the walkways require immediate attention and supplementary support should be provided if the walkways are to remain in use until they can be repaired or replaced with a capable system. Wood framed stairs exist which lead to the elevated walkways. The stairs also appear to have been insufficiently maintained. The paint that is on the stain is old and is cracked and pealing leaving the bare wood exposed to the elements. At some point some structural elements have been replaced or added. The solid sawn stair treads were covered with plywood. This decreases the potential of the water to evaporate from the joint between the plywood and the solid sawn lumber and increases decay. The stain should be supported by additional means if they remain in service until they may be repaired or replaced. No siding was visible over the entire structure. The only protection from weather was painted wood sheathing. The paint is old and is cracked and pealing due to a lack of maintenance. The wood sheathing presumably also provides the lateral restraint. With the wood sheathing exposed to weathering the lateral capacity is most likely reduced. The existing capacity of the lateral system should be further reviewed by a professional engineer. On the roof several shallow puddles of water were present which indicates that the roof may not have the required slope to direct water to outlets. The roof has probably been drying for a couple of days and with more rain the ponding would likely increase which would also increase the weight to the building. The roof system should be further reviewed by a professional engineer for structural capacity, and by an architect for the control of rain water. Inside the building there are many locations with evidence of water intrusion from the roof. Several of the locations observed had buckets or other containers to catch the water. Some of the water damage has left structural members exposed. Evidence of decay appeared to be present at the locations visible. The extent of the decay is unknown and should be investigated further by a professional engineer. It is our recommendation that the stairs and elevated walkways be repaired prior to further use by the public. These items pose a considerable risk to the public if left unattended. We also believe that further investigation into the structural capacity of the building, specifically the roof, be made as soon as possible. The risk to the public is not fully able to be assessed without further investigation including destructive investigation. Thurston Fire /EMS was dispatched on March 26, 2005 at 1744 hours for a service call at 15425 Mosman Ave. (Nisqually Valley Golf Course Apartments). The calling party, Melissa Schafer (apartment #9), reported the ceiling of her apartment was leaking. She stated she went outside to check and found a large puddle of water on the roof. She stated she was very concerned the roof would collapse. E•22 arrived on scene at 1753 hours after clearing an aid response. FF Russell talked with the resident, and then inspected the roof where he found a large pool of water. A decision was made to recommend the residents of the apartment building move out until an inspection could be made to determine the safety of the building. Red Cross was contacted to make arrangements for residents wishing to vacate their apartment until the inspection could be completed. Each resident was contacted by the fire crew. 9 apartments were vacant or had no one home. The remaining residents opted to remain in their apartment and see what happened. Melissa Schafer in Apt. #9 vacated her apartment and went to stay with family feeling the building was unsafe. Gene Schuster, building manager, arrived and was informed of the status of the building and the recommendation to the residents to move until an inspection could be arranged. He stated he was aware of problems with the roof but had been unable to get the building owner to make any repairs. The City and Fire District found substantial compliance with the correction notices dated March 30, 2005. A few issues do remain, and the District will forward to you under separate cover their inspection report. The City also received the structural report regarding the integrity of the roof of the building on May 5, 2005. In summary, the report and the previous report dated April 14, 2005, indicate that the upstairs apartments are unsafe to occupy unless a new roof is installed, the stairways replaced, and the balconies repaired /replaced. As you are aware, the City of Yelm has posted a "Do Not Occupy" sign for the second floor apartments. What this means is that due to the governmental action that is been based on their concern for the public health, safety and welfare, you are required to vacate your apartment. The apartment manager has advised me, through the owner, that you have refused to vacate the premises. Although this is an unfortunate set of events, and I am sorry that you have to move, the City is only trying to make sure your health and safety is protected. All other tenants on the second floor have either vacated their apartment or are in the process of vacating their apartment. You are the only tenant that has indicated they do not intend to move. Remaining in your apartment is not an option. You must make arrangements to move immediately.
