NOTICE OF VIOLATIONS
Dear Mr. and Ms. Conley:
In the month of December, 2016, you paid for and requested a final inspection and certificate of occupancy for 105 Van Trump as your new home.
NOTICE IS HEREBY GIVEN that operation of a home occupation business on your property at 109 Van Trump St NE [parcel #64421700500] is in violation of Yelm Municipal Code Chapter 18.65.010.
ALLEGATIONS OF FACT
Per the Pre-Application meeting of November 16, 2005, Bed and Breakfast accommodations limit breakfasts to guests only, and the home occupation requires the owner of the house to live
on the premises.
Home occupation businesses limit the area for the business to 400 square feet, which in this case is two bedrooms.
ALLEGATIONS OF LAW
The above described property (legal description: Section 19 Township 17 Range 2E Plat MCKENZIES ADDITION TO YELM DIV 2 BLK 17 LT 5 Document 008/104) Parcel 64421700500 is within the
City of Yelm.
The above described property is Zoned Central Business District (CBD).
18.65.010 INTENT: It is the intent of this section to permit residents of the community a broad choice in the use of their homes as a place of livelihood, and the production of supplementing
of personal/family income, while protecting residential areas from potential adverse impact of activities defined as home occupations. Home occupations are activities conducted for
financial gain or profit in a dwelling unit, incidental or secondary to the residential use, and conducted only by the person(s) residing in the dwelling unit. (Ord. 995 § 12 (Exh.
A), 2015).
18.65.020(A) General requirements: A. Home occupations shall occupy not more than 25 percent of the total floor area of the residence. In no event shall such occupancy exceed 400 square
feet, (Ord. 995 § 12 (Exh. A), 2015).
IT IS ORDERED THAT within 30 days of receipt of this notice Michael J and Karen M Conley cease operations as a bed and breakfast at 109 Van Trump St NE. If you wish to operate a bed
and breakfast at this address, you will need to apply for a site plan review not a home occupation. Operations as a bed and breakfast would only be allowed after site plan review and
all terms of that site plan review are in compliance.
Failure to comply with the terms of this notice of violations by stated time may result in further actions by the City of Yelm, including, but not limited to the issuance of civil penalties
of up to $250.00 per day of violations or further enforcement action through court of competent jurisdiction.
