STATEMENT OF FACTS:
Numerous junk and abandoned vehicles including trucks, cars, and RV’s have collected on the eastern edge of this property
Police responses to this address have resulted in arrests for illegal drug and possession of stolen weapons.
There is suspicious activity on going at this address.
A nuisance violation notice was mailed to you on November 2, 2016. In that notice you were informed of violations of Yelm Municipal code 10.20.010 for junk boats and junk vehicles on
your property.
A second notice was mail to you on November 16, 2016 via certified mail. This notice was accepted as service on November 22, 2016.
No appeal was filed after acceptance of service by Certified Mail.
Representatives of Delta Construction have visited the site and Community Development offices on two occasions to discuss removal of the vehicles, boat(s), and associated junk.
Zoning for this property is Gateway C-1 Commercial.
Per Yelm Municipal Code Section 18.36.020 Auto wrecking and junk yards are not allowed uses in C-1 Commercial.
This parcel is undeveloped property and has no allowed use until after Site Plan Review and permitting.
STATEMENT OF LAW:
Yelm Municipal code Section 10.20.010 reads No “unlicensed and/or inoperable motor vehicle,” as such term is defined in RCW Title 46, shall be stored on any premises within the city
for a period exceeding 30 days, unless the same is stored within an enclosed structure. Violations thereof shall be attributed to the owner or owners of record of the real property.
Section 18.18.060 Yelm Municipal Code Civil Penalties. Any person violating or failing to comply with any of the provisions of the codes to which the enforcement provisions of this chapter
apply may be subject to a cumulative civil penalty of up to $250.00 per day for each active occurrence of violation.
Alternatively, failure to abate a nuisance may be prosecuted as a misdemeanor under Section 9.48.050 Yelm Municipal Code.
You have the right to appeal this notice within five days as provided in Section 9.48.010(E), Yelm Municipal Code, or within ten days from the date of service by mail, as evidenced by
the postmark on the notice.
