Per that notification, civil penalties of $250.00 per day are now being assessed on the above property at 216 Yelm Ave East. ALLEGATIONS OF FACT On June 23, 2009, you paid for permit # 20090115 to build an addition onto your existing residence On October 26, 2010, you received the last inspection of record [shear walls] On August 8, 2011, you received a letter from the building official concerning the lack of significant progress on this project On October 10, 2011, you were directed to secure a building permit to reduce the height of the structure or demolish the structure within 15 days On November 14, 2016 you signed for certified mail containing the attached compliance letter ALLEGATIONS OF LAW The above described property is within the City of Yelm The above described property is Zoned Central Business District (CBD) with its current use as Residential (R-4) To date the you have not brought the site into compliance with the letters of October 10, 2011 and November 1, 2016 Per Yelm Municipal Code 18.18.060A: Any person violating or filing to comply with any of the provisions of the codes to which the enforcement provisions of this chapter apply may be subject to a cumulative civil penalty of up to $250.00 per day for each active occurrence of violation. Yelm Municipal Code 18.18.060C: Appeal of the issuance of penalties. Within 30 days after the notice is received, the person incurring a penalty under this section may appeal the determination that a violation occurred or may request remission or mitigation of the penalty. Upon receipt of the application, the hearing examiner shall hold a closed record hearing pursuant to Chapter 18.10 YMC. If the examiner determines that a violation occurred, the penalty may be remitted or mitigated for good cause, upon whatever terms the examiner finds acceptable.
