Dear
The City of Yelm Community Development Department has reviewed the application for a sign permit to replace (what they are proposing) a sign located at xxx Yelm Avenue West, Shell Gas
Station.
The permit has been denied based on the following:
The Unified development code at Section 18.01.090 states that pre-existing, non-conforming structures may be maintained; provided, that they shall not be enlarged, expanded or extended
in a manner which would increase the nonconforming aspects of the structure.
The existing sign is considered a legal non-conforming sign, meaning that it was lawful prior to the date of adoption of the sign ordinance, but which would be prohibited, regulated,
or restricted under the terms of this chapter. Section 18.62.130 (A)(1) & (3) states the no such sign shall be changed in any manner that increases the noncompliance of such sign with
the provisions of the chapter, and when a business or activity containing a legal nonconforming sign is enlarged or remodeled to a value of 60 percent or more of existing value of improvements,
then such sign must be brought in conformity with all provisions of this chapter.
The proposed improvements to the sign would increase the noncompliance by (explain).
This decision may be appealed to the Hearing Examiner. The content of the appeal must be in writing, be accompanied by the appeal fee of $1,250.00. The process to submit an appeal
