Dear Allen:
Attached please find a temporary certificate of occupancy for the new Yelm Wal-Mart. This temporary occupancy is for the purpose of allowing the building and site to be utilized by
Wal-Mart employees, contractors, and tenants for the purpose of stocking the store and preparing for the store opening.
As you recall, my letter of May 24, 2007, contained several conditions for the issuance of a temporary occupancy, all of which have been substantially complete with a couple exceptions
which are addressed as conditions of the temporary certificate of occupancy, as follows:
The fire alarm and sprinkler systems are complete, have been inspected, and are approved with minor issues that will be addressed by the contractor prior to issuance of a final certificate
of occupancy.
The water system has been inspected and approved by the Public Works Department with the exception of several items (see attached punch list) which are being addressed by the contractor
no later than June 15, 2007.
The sewer system has been inspected and approved by the Public Works Department with the exception of several items (see attached punch list) which are being addressed by the contractor
no later than June 15, 2007.
The parking lot has been completely paved and striped with sufficient spaces to accommodate the expected number of vehicles during the time of the temporary occupancy.
The parking lot lighting has been installed and energized.
The stormwater treatment and disposal system will be fully operational by Monday the 11, 2007. Until the system is inspected and approved by the Community Development Department, portable
pumps of sufficient capacity to
operate the system during a storm event shall be maintained online and manned during any rainfall events.
All perimeter walls along the north and east property lines have been installed with the exception of a portion of the north property line in the area of the loading docks. Until the
perimeter walls are fully installed and approved, no loading or unloading shall take place between the hours of 6 PM and 8 AM.
The paving and striping on the SR 510 Yelm Loop frontage and Yelm Avenue (SR 507) has not been completed. Until paving and striping is complete, no employee access to the site shall
be permitted between the hours of 7:00 AM and 8:30 AM.
If the required striping east of the SR 510 Yelm Loop is completed and approved, this limitation will be lifted, provided all traffic entering the site from SR 507 is at the eastern
entrance, and all traffic exciting the site is from the SR 510 Yelm Loop.
A developer agreement for acquisition of the property required for the 103rd connection is not in place, but Wal-Mart has agreed to deposit $250,000.00 towards the purchase of the required
right-of-way with the City of Yelm prior to issuance of a final occupancy permit. The City will refund any unexpended funds to Wal-Mart within 30 days of the City’s reimbursement of
right-of-way costs to the Washington State Department of Transportation.
A draft letter of credit for the required 103rd connection and the reconstruction of 103rd Avenue in the amount of $582,243.00 has been submitted to the City for approval and is expected
to be in place no later than June 11, 2007. The temporary certificate of occupancy will be revoked if the letter of credit has not been finalized by June 15, 2007.

for your grand opening.
