Gentlemen:
By this time, you should have received via the US Mail a notice of appeal and notice of closed record appeal hearing in the matter of Yelm Commerce Group’s appeal of the Hearing Examiner’s
approval of a site plan review application for the construction of a Wal-Mart supercenter in Yelm. As you know, an appeal of the Examiner’s decision was filed on November 28, 2005,
by the Yelm Commerce Group, Valentine Fyrst, Bill Nicholls, and James Zukowski.
Any response to the memorandum of appeal must be filed no later than December 13, 2005. The City will be filing a response as well as a draft resolution for the City Council’s consideration
at the closed record hearing. The Yelm Commerce Group may file a reply memorandum no later than December 20, 2005.
If any party wishes to raise an appearance of fairness challenge to the Mayor or City Council, they should do so no later than December 20, 2005.
The City Clerk has scheduled a closed record appeal meeting of the City Council for the Council’s regular meeting of December 28, 2005, starting at 7:30 P.M. in the City Council Chambers
at City Hall, 105 Yelm Avenue West, Yelm, WA 98597.
As previously noted, this will be a closed record hearing and argument will be limited to the Yelm Commerce Group, Wal-Mart, and the City, with 10 minutes allocated to each party, starting
with the Yelm Commerce Group. All filings should be made directly to the Community Development Department via email (grantb@ci.yelm.wa.us) in Adobe Acrobat portable document format
(*.pdf) and should include copies of any exhibits referenced or relied upon in your memoranda.
