Grant Beck, Yelm’s Community Development Director announced on March 10, 2006, that Judge Paula Casey dismissed a land use petition against the City brought by the Yelm Commerce Group.
The petition challenged the City Council’s decision to approve a Wal-Mart supercenter. The Yelm Commerce Group appealed the decision to the Thurston County Superior Court, but did not
serve the City of Yelm within the required time period. The City moved to dismiss the appeal.
According to Grant Beck, Yelm Community Development Director, Judge Casey’s decision was a victory for the land use permitting process. Mr. Beck stated that “the City of Yelm is committed
to an open and fair land use process and the even-handed administration of the land use permitting process. Part of maintaining a level playing field is that all sides of a land use
dispute must be responsible for meeting applicable deadlines”.
The decision clears the way for Wal-Mart to begin construction, including transportation system improvements required by the City.
