'T'his is an appeal from the Ye1~n City Council°s denial of a inistrative appeal of a
Dearing Examiner's approval of a site plan issued for tl~e proposed construction of a dal-Mart
Supercenter. The Yelm City Council, y resolution, denied. the petitioner's appeal an December
~$, 2005. See Land Use Petition, ~(~ and Exhibit E,
The petitioner filed this action with the Thurston County Superior Court on January 18,
2006. n that same date, petitioner ~Ied a declaration in which a Legal assistant stated that he had

subsequent service upon the City.

legal messenger hand delivered the petition to elm City Administrator Shelly Badger on January

Because the petitioner did not timely serve the Oity of Y'elm with the 1 d use petition, the
Court must find that it is without jurisdiction to hear this petition and dismiss tl~e same.
0 36.700.040 controls. It provides, in pertinent part, as follows:
(1~ Proceedings for review under this chapter shall e commenced by filing a
land use petition in superior court,
(?) Aland use petition is barred, and the court may riot grant review, unless the
petition is timely filed with the Court timely served on the follouring persons
who shall be parties to the review of the land use petition:
(a) The local jurisdiction, which for purposes of the petition shall be the
jurisdiction's corporate entity and not an individual decision maker or department;
(3) The petition is timely if it is filed and seated on all parties listed in
subsection 2) of this section within. twenty-ozae days oftlze issuance of the land use
decision.
