Dear Scott:
This letter is in response to your request to abandon the irrigation system required as part of the approval of Crystal Creek Estates (SUB-00-8251-YL and SUB-01-8294-YL). Specifically,
you wish to abandon the irrigation system on the north side of 93rd Street between the curb and sidewalk.
Because the system was required as part of the subdivision approval and the abandonment of the system shifts responsibility for maintaining the planter strip to individual property owners,
the system may only be abandoned if each property owner acknowledges that they understand this shift in responsibility. Once a statement signed by each property owner, in substantially
the following format, is returned to the Community Development Department, the City will make arrangements for the system to be disconnected.
I understand that once the irrigation system between the curb and sidewalk is abandoned, I will be responsible for ensuring that sufficient water is provided to the street trees to ensure
their health and that, if the street trees in front of my property do not survive, I will be responsible for their replacement.
If you chose to repair the system, the City will accept deposit of 150% of the anticipated cost of repair into the City’s trust account as a form of financial guarantee.
