Issue
Yelm Community Schools has requested the City rezone approximately 12 acres of land that the District currently owns adjacent to and east of the Mill Pond Intermediate School from Low
Density Residential (R-4) to Institutional District (ID) in order to allow the construction of a new Junior High School on the property.
Background
The Yelm Planning Commission held a duly advertised public hearing on the rezone request by Yelm Community Schools at it’s regular meeting of October 20, 2003. After review of the staff
report, testimony by the School District, and comments from the public, the Planning Commission voted unanimously to recommend that the City Council approve the rezone request. In taking
this action, the Commission adopted the findings of fact and conclusions of law in the staff report.
Recommendation
The City Council adopt Ordinance Number 795 rezoning approximately 12 acres from Low Density Residential (R-4) to Institutional District (ID).

ORDINANCE NO. 795
AN ORDINANCE of the City of Yelm amending the Comprehensive Plan Map by re-designating approximately 12 acres from Low Density Residential (R-4) to Institutional District (ID).
WHEREAS, the Capital Facilities Plan for the Yelm Community Schools indicates that a new Junior High School is needed to serve the population growth in Yelm, it’s urban growth area,
and rural lands within the School District boundaries; and
WHEREAS, the Yelm Comprehensive Plan identifies the Institutional District as being appropriate for land under public ownership, such as the School District, and
WHEREAS, the City’s Comprehensive Plan also notes that new school facilities are needed and should locate within the urban growth area, and
WHEREAS, had the subject property been acquired by the District prior to start of the Comprehensive Plan update process in the mid-1990’s, it is likely that the property would have been
designated as Institutional at the time of the update, and
WHEREAS, the proposed rezone is consistent with the policies of the Comprehensive Plan as they relate to both schools and the Institutional District, and
WHEREAS, the Environmental Impact Statement prepared for the adoption of the updated Comprehensive Plan and development regulations in 1995/1996 reviewed the impacts of the various zoning
classifications and is being used without modification for this rezone application,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON DO ORDAIN AS FOLLOWS:
The Comprehensive Plan designation of the following property is changed from Low Density Residential (R-4) to Institutional District (ID):
Beginning at the southeast corner of the Southwest Quarter of the Northeast Quarter of Section 25, Township 17 North, Range 1 East, W.M.; Thence N 89o 12’ 44” W along the south line
of the Southwest Quarter of Said Northeast Quarter a distance of 212.82 feet; thence N 22 o 51’ 20” W a distance of 720.55 feet; thence N 40o 14’ 50” W a distance of 302.90 feet; thence
N 59o 00’ 36” E a distance of 819.79 feet to the northeast corner of said Southwest Quarter; thence S 00o 37’ 30” W along the east line of said southwest quarter a distance of 1320.28
feet to the point of beginning.
