Tami,
I did receive your note about checking the pond/swale with regards to the new property line, but I did not know this was a requirement of the BLA submittal. We had one of our engineers
look at the new line location in regards to the pond and determine that the new line does not affect the slope. There is still ample room behind the outermost pond grading and the new
property line for maintenance purposes.
This does go back to your comment about making the building setback line more or less nonconforming. Our understanding of the whole need for this BLA was the fact that the existing building
did not meet the setback line. Mr. Brown hired us to perform the BLA as he was instructed by the city that his building was non-conforming. I am not sure how in the process of getting
the building permitted, built and inspected that it was placed too close to the property line, but that is the situation. The reality is that there is not 20’ between the existing building
and the outermost extent of the pond grading, so if the intent is to bring the building into conformance along the 10’ building setback line by dong the BLA, then the pond will not
also be 10’ from the new property line. It is not currently 10’ from the existing property line so already non-conforming. As the pond is a shallow swale and pond (2-3 feet in depth
max) the future maintenance can be performed without having a 10’ setback from the property line.
Was the applicant made aware that you would be charging peer review fees outside of the BLA review fee? Our assumption was that the BLA application and review fee would actually cover
the review of the BLA. As I noted above, I don’t think an additional engineer review is necessary to tell you that the pond and the building both cannot meet the 10’ setback from the
new property line. Please advise on the process moving forward as the purpose of this BLA was to bring the building into conformance at the city’s request. Thank you.

The BLA is being reviewed by our engineer. The engineer is determining whether the new boundary line will meet setbacks for the pond and swales.
While they may not currently meet setbacks and be nonconforming, I cannot approve this if it makes the setbacks more nonconforming. That is why I requested this information from you
with application. As it was not submitted, we are doing the review ourselves and will submit peer review fees with our reply.
