WHEREAS, the parties hereinafter described are the owners of
certain real property hereinafter described, and:
WHEREAS, it is the purpose of the parties hereto to share a
well on the property hereinafter described of KENNETH L. ALEXANDER
and SHARON M. ALEXANDER, husband and wife, and to provide all
necessary labor and material to operate, maintain and keep in good
repair the well and all the necessary equipment, including pipes,
and
WHEREAS, said parties are desirous of entering into an
agreement as tenants in common in a water system and grant
easements over each others land to effectuate t►e purpose of this
agreement,
NOW, THEREFORE, in consideration of the mutual promises,
covenants and agreements hereinafter contain, the parties hereto
agree as follows:
1. That the parties hereto agree that they will share equally
in all of the expenses of maintaining, operating and supplying the
necessary equipment to effect the operation of the well and water
system which is the subject of this agreement.
2. That the parties hereto agree that they will be tenants in
common in a water system and all necessary and pertinent apparatus
used in connection with the operation of said water system
including but not limited to the casing, pump and pump house.
3. That KENNETH L. ALEXANDER and SHARON M. ALEXANDER, husband
and wife, being the owners in fee simple of the following described
property:
The South 117 feet of the North 367 feet of the East 220
feet of the Northeast quarter of the Northeast quarter nf
the Northeast quarter of Section 24, Township 17 North,
Range 1 East, W.M.: EXCEPTING THEREFROM the East 20 feet
for county road known as Cullens Road.
In Thurston County, Washington.
hereby grant to HAROLD ALLEN and BETTY SUE SMITH, each as their
separate property, successors in interest to their mother, BEATRICE
ALLEN, and their respective heirs, successors and assigns
(hereinafter "Allen"):

4. That each of the parties to this agreement shall have the
right to use the water system for ordinary domestic purposes and no
other, and that said system shall serve one single family dwelling
on the Alexander above described property; and a single family
dwelling on the Allen property le ally described as:
Commencing on the West, line 31 Cullens Road, 367 feet South of the North
line of Section 24, Township 17 :forth, Range 1 East W.M.;
South 85 fee*;
West 150 feet;
North 85 feet;
East 150 feet to the point of beginning.
The above described real estate is situated in the Cou f Th
State of Washington, ]mown as No. r J' Cullens Road
5. That for purposes of this agreement "ordinary ome X
purposes" as used herein shall mean all usual domestic uses;
including watering of livestock, but shall not include commercial
irrigation.
6. That if the well should run low, or if there should be
insufficient water for domestic purposes, all the parties hereto
agree that they will each reduce the use of water as determined by
the Alexander's.
7. That said easements, covenants, and co -tenancies shall be
appurtenant to the real property heretofore described.
8. That each of the parties to this agreement agree to share
equally the expenses associated with compliance with state and
county regulations and maintenance of the well, the casing, the
pump, the pump house, and all pertinent apparatus used in
connection with the operation of said well. That the parties to
this agreement further agree that each party will pay their own
expenses of maintaining the piping used in their own domestic water
system. The parties to this agreement further agree that Allen
will assume the cost of relocating the existing service pipe so as
to minimize interference with future improvements which may include
running the existing service pipe so that it runs to the maximum
extent adjacent to lot lines.
9. None of the parties to this agreement make any warranties
nor covenants as to the quality or quantity of the water in the
water system.
10. In the event of any failure to keep and perform any of the
covenants and agreements herein contained and such failure
continues for twenty (20) days after written notice from the
Alexander's, unless appropriate action has been taken by Allen in
good faith to cure such failure, the Alexander's may terminate this
agreement.

11. In the event that the Alexander's are required to retain
the services of any attorney to enforce the provisions of this
agreement, the losing party agrees to pay all reasonable costs and
attorney's fees in connection therewith. It is agreed that the
venue of any legal action brought under the terms of this agreement
may be in the County in which the premises are situated. Beatrice
Allen shall be liable to the Alexander's for any injury or damage
caused by reason of default of this agreement.

in lieu of any contribution to the construction costs of the well).
All dues shall be payable in advance on or before the 1st day of

incident to electrical consumption of the well water pump and
related facilities that are separately metered. The Alexander's
shall determine the initial monthly charge which may be increased
by the exact amount of any increase assessed by the providing
utility company. All monthly electrical costs shall be due and
payable to the Alexander's within ten (10) days of receipt of a
statement therefore.
14. This agreement and covenants herein shall run with the
land and shall inure to the benefit of and be binding upon the
heirs, executors, administrators, assigns, and successors of the
respective parties hereto, and all parties having or acquiring any
right, title or interest in the land described herein. The
covenants contained herein shall be appurtenant to and run with and
attach to the land heretofore described.
15. This agreement and the easements granted therein shall be
revocable only upon the mutual written agreement of all parties or
their heirs, successors, or assigns thereto, provided, however,
either party, their heirs, successors and assigns may terminate
this Easement and Agreement by filing a Notice of Termination at
such time as the Allen premises are connected to a public water
line serving their prmises.
