Until a complete application is made, the Community Development Department can only attempt to inform the applicant of general requirements as they appear in the form presented by the applicant at the time of pre-submission. Proponent: Joe Aguilar Project Proposal: Request to Re-establish secondary dwelling unit Project Location: 14812 Berry Valley Road - Tax parcel numbers 21724240400 Zoning and Setbacks The property is split between two zoning designations, R4 and R14. The R14 zone has a minimum density of six units per acre which does not allow a secondary dwelling unit due to minimum density requirements. Density: A minimum of 6 units per acre up to a maximum of 14 units per acre – Minimum number of dwelling units is 30, and maximum number of dwelling units allowed is 70, based on the approximate acreage of 5.00. Actual acreage to be determined by a licensed surveyor. R-14 setbacks are: Rear yard 25 feet, side yard 10 feet, front yard 35 feet. Maximum building height is 35 feet (25 feet if within 100’ of a lower residential zone.) The R-14 zone does not allow for secondary dwelling units, this has not changed since the creation of the zoning code in the mid 1990’s. Any secondary dwelling unit on site prior to the zoning code would have been considered a non-conforming use. Section 17.93.030 YMC states that a nonconforming use shall be deemed abandoned by discontinuance or abandonment for a period of 18 consecutive months, and any subsequent future use of such land or buildings shall be in conformity with the provisions of this title. The secondary dwelling unit on this site was removed on July 27, 2006. Pre-Application Meeting Page 2 of 2 Options for additional dwelling units on this site would be: Subdivide the property into a residential subdivision, with a minimum of 30 dwelling units to a maximum of 70 dwelling units. Create multi-family units with a minimum of 30 dwelling units to a maximum of 70 dwelling units. Both of the options above require full site improvements, which include, but are not limited to, frontage improvements, internal streets, stormwater treatment, water and sewer line extension with connections for each unit, and on site landscaping.
