Development Department can only attempt to inform the applicant of general requirements as they appear in the form presented by the applicant at the time of pre-submission.

Property Background and Characteristics
Preliminary subdivision for The Hutch was approved on October 28, 2006. At the time of preliminary subdivision, the State Subdivision Act required a final subdivision be submitted 5
years from the date of approval. That requirement was changed by the legislature to 9 years by Senate Bill EHB 2152 effective June 7, 2012 for preliminary subdivisions approved prior
to December 31, 2007, within city limits and not subject to the Shoreline Management Act. This preliminary subdivision expires October 2015.
Civil Construction plans were approved in May 2007 and expired in May 2008. If you choose to construct the subdivision as approved, the civil plans would need to be reviewed again,
to assure compliance with current standards.
We anticipate that there may be minor changes, which will mean that revised plans will need to be submitted with a current engineers stamp for the plans, and there are past due review
fees of $5,764.26. You will need Skillings Connolly approval to use these plans.
The City of Yelm does not bond for improvements, and requires that all conditions of approval are met prior to submission and approval of final subdivision.
At final subdivision application, the City reviews the subdivision to assure that all conditions of approval are met. The City is also required to prove adequacy of water and sewer
availability.
Water Availability Requirements
The City of Yelm applies a three prong test for water availability pursuant to the State Subdivision Act (Chapter 58.17 RCW) and the State Building Code (Chapter 19.27 RCW).
The Subdivision Act at Section 58.17.110 (1)(a) RCW requires at preliminary subdivision approval that the City determine:
“If appropriate provisions are made for, but not limited to, the public health, safety, and general welfare, for open spaces, drainage ways, streets or roads, alleys, other public ways,
transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, schools and school grounds, and shall consider all other relevant facts, including sidewalks
and other planning features that assure safe walking conditions for students who only walk to and from school.”
The Act at Section 58.17.150 (1) RCW further requires that at final subdivision approval, the City consider:
“Local health department or other agency furnishing sewage disposal and supplying water as to the adequacy of the proposed means of sewage disposal and water supply”
Finally, the State Building Code at Section 19.27.097 (1) RCW requires that, prior to issuance of a building permit:
“Each applicant for a building permit of a building necessitating potable water shall provide evidence of an adequate water supply for the intended use of the building. Evidence may
be in the form of a water right permit from the department of ecology, a letter from an approved water purveyor stating the ability to provide water, or another form sufficient to verify
the existence of an adequate water supply.”
Water Availability Status
As of the date of this report, the City has approximately 40 water connections available for new construction. This includes building permits that have been submitted and are in the
review process
The City has prepared a water system plan update for review and approval by the Washington Department of Health that would add as many as 200 connections available for new development.
At the current rate of new construction, the existing and added water connections would provide for an additional 2 to 3 years worth of growth.
The Washington Department of Ecology approved new water rights in the amount of 947 acre feet to the City on October 21, 2011. This is expected to accommodate 20 years worth of growth.
The Ecology approval was appealed to the Pollution Control Hearings Board, and the Board held a hearing in December of 2012. The Board has not yet issued a decision, and is not expected
to do so in the next several months. Once the board issues a decision, it may be appealed to Superior Court.
Until the water rights are approved, the City is most likely unable to approve a final subdivision application at this time.
LID Assessment:
The property is part of the Killion Road Local Improvement District (LID). This LID constructed the frontage improvements to Killion Road. There is an assessment on the property, see
attached.
