Until a complete application is made, the Community Development Department can only attempt to inform the applicant of general requirements as they appear in the form presented by the applicant at the time of pre-submission. Proponent: Randy Weber Representative: Hal Grub, P.E., Barghausen Project Proposal: Relocate Floodplain Project Location: XXX Rhoton Rd, Yelm Parcel Number: 22719240300 Property Background and Characteristics The property is located on Rhoton Road. It is approximately 7.57 acres, and currently undeveloped. It is bound to the north and south west by residentially zoned property. The property to the south is zoned industrial and currently used for industrial purposes. The property to the west, across Yelm creek is zoned R-6 residential and is currently vacant. Yelm Creek lies on the western property line of this site. Yelm Creek is not a Shoreline of the State, however Yelm Creek, its riparian habitat buffer, and frequently flooded areas are regulated under the City of Yelm Critical Areas Code, Chapter 14.08 Critical Areas Critical Areas Report. The critical areas report shall be prepared by a qualified professional using scientifically valid method and studies in the analysis of critical area data and field reconnaissance, and reference the source of science used. The report shall evaluate the proposal and all probable impacts to critical areas in accordance with Chapter 14.08. Minimum report requirements may be found in Section 14.08.050 Wetlands. Exact location of a wetland boundary shall be determined through the performance of a field investigation by a qualified professional wetland scientist applying the Washington State Wetlands Identification and Delineation manual as required by 36.70A.175 RCW. Fish and wildlife habitat conservation areas. The report shall provide a habitat assessment of the project area to evaluate the potential presence or absence of designated critical fish or wildlife species or habitat Riparian Buffer. All construction must remain outside of the 150 foot Riparian Buffer established for Yelm Creek. New public flood protection measures are subject to the City’s review and approval of a critical areas report and the approval of a federal biological assessment by the federal agency responsible for reviewing actions related to a federally listed species. Approval Process Critical Area Report Review. The Director of Community Development has authority to interpret and apply and the responsibility to enforce the Critical areas code. It may require additional peer review to ensure compliance with the code. Civil Plan Review Process Building Permit Process Prior to issuance of a permit for clearing and grading and/or building in conjunction with a Critical Areas Report a Development Permit will be required per Section 15.32.110 YMC. The proposed site is mapped by the current FIRM (October 16, 2012) as an AE zone outside of the floodway. An application shall conform to Section 15.32.120 YMC and address Section 15.32.285 YMC for downstream flood elevation. The Community Development Department will serve as the administrator, and review the permit for compliance to Chapter 15.32 YMC. Building permits will be reviewed per the International Building Code, specifically Chapter 16 for flood zones. Fees & Charges The Applicant is responsible for the initiation, preparation, submission, and expense of all required reports, assessment(s), studies, plans, reconnaissance(s), peer review(s) by qualified consultants, and other work prepared in support of or necessary to review the application. Civil plan review is billed on a cost recovery basis.
