F INDINGS OF F ACT
1. Martin Mucino resides in the home located at 10520 Creek St. SE, Yelm, WA 98597, Tax
Parcel # 64303400400.
2. The property is identified by the Unified Development Code, Title 18 YMC, as being within
the Heavy Commercial (C-2) zoning district.
3. The ministerial site plan review process is to ensure that projects are consistent with
applicable development, construction and design standards of the Unified Development
Code \[Title 18, YMC\]. Ministerial permits do not require public notice.
4. Martin Mucino proposes to operate an offsite construction business from the home.
5. Chapter 18.65 YMC provides requirements and standards for home occupations. These
include
The home occupation shall not occupy more than 25 percent of the total floor area of
the residence, or exceed 400 square feet.
Traffic generated by the home occupation shall not exceed 3 commercial vehicles per
-street.
Storage of merchandise, material or equipment must be entirely within the residence
or accessory building.
Home occupation signs shall be wall mounted, and shall not exceed four square feet
in area. The sign cannot be internally illuminated, but may be indirectly illuminated.
C ONCLUSIONS OF L AW
A. Section 18.12.080 YMC allows the Site Plan Review Committee to approve a home
occupation when it complies with all applicable development, construction, and design
standards of the Unified Development Code.
B. Martin Mucino has established that the request for ministerial review approval can satisfy
all criteria set forth in Chapter 18.65 YMC, meet all requirements of the C-2 zoning

classification, and meet all other requirements of the Yelm Municipal Code and therefore
should be approved.
C.A home occupation approval is effective upon approval. The home occupation permit
maybe be revoked upon determination that there has been a violation of any conditions
of approval or standards of the Unified Development code.
D ECISION
The request for a home occupation approval is hereby granted.
