Resolution No. 623 Declaring Property at 15429 107th LP SE a NuisanceRESOLUTION No. 623 A RESOLUTION OF THE CITY OF YELM, WASHINGTON, DECLARING THE PROPERTY LOCATED AT 15429107 TH LOOP SE A NUISANCE WHEREAS, February 8, 2022, the Yelm City Council approved Resolution No. 623 which declares the residence and property located at 15429 107th Loop SE a nuisance. WHEREAS, the City of Yelm made numerous attempts to contact the property owner, as well as notices placed on the residence addressing how the condition of the property is in violation of the YMC. Notices were posted on September 29, 2021, November 2, 2021, and a final notice on January 3, 2022 informing the homeowner that the property would be abated by a contractor hired by the City of Yelm and the cost of the cleanup would be billed to the homeowner in the form of a lien on the property. WHEREAS the property is abandoned, in foreclosure, and in a condition that is in violation of several Yelm Municipal Codes WHEREAS, the property management company in lawful control of the property shall clean up and secure the property restoring it to a state free of Yelm Municipal Code violations; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Yelm, Washington, that Resolution No. 623 is hereby signed and the property deemed a nuisance. The City of Yelm was contacted by the property management company regarding cleaning up this property on January 20, 2022. To be in compliance with Washington state HB 2057 laws I request the City Council deem the property a nuisance. As Building Official for the City of Yelm, I shall deem the residence abandoned, and the bank that owns the property will declare the residence is in a state of mid foreclosure. The two prior elements combined with a nuisance declaration allows the property owner to legally access, clean up, and secure the property.
