Resolution No. 626 Declaring 14906 89th Ave SE and 311 McKenzie as Public Nuisance PropertiesRESOLUTION No. 626 A RESOLUTION OF THE CITY OF YELM, WASHINGTON, DECLARING THE PROPERTIES LOCATED AT 14906 89TH AVE SE AND 311 MCKENZIE AVE SW AS PUBLIC NUISANCE PROPERTIES WHEREAS, the City of Yelm made numerous attempts to contact the property owner of the residence located at 14906 89th Ave SE, as well as notices placed on the residence addressing how the condition of the property is in violation of the YMC; and WHEREAS, A Notice of Violation letter was mailed on March 14, 2022, a second letter on March 30, 2022, and a civil penalty imposed on April 11, 2022. A site visit was also performed on Monday, June 27, 2022 and was met with aggression; and WHEREAS the property located at 311 McKenzie Ave SW is abandoned, in foreclosure, and in a condition that is in violation of several Yelm Municipal Codes; and WHEREAS, the property management company in lawful control of the property shall clean up and secure the property restoring it to a state free of Yelm Municipal Code violations; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Yelm, Washington, that Resolution No. 626 is hereby approved and the properties located at 14906 89th Ave SE and 311 McKenzie Ave SW are deemed as public nuisance properties. KEY FACTS AND INFORMATION SUMMARY: 14906 891h Ave SE - The City of Yelm has been contacted by the Yelm Police Department, as well as numerous neighbors of the residence located at 14906 89th Ave SE regarding the accumulation of house hold garbage on the property. The amount of flies and rodents is a serious health concern, and must be abated as soon as possible. A Notice of Violation letter was sent on March 14, 2022, followed by a second letter on March 30, 2022 informing the property owner that fines will be imposed if all code violations are not corrected by Friday April 8, 2022. A $250.00 civil penalty was issued to the property owner on April 11, 2022. The City of Yelm would like to hire a third party company to remove all garbage from the property and lien the property for the cost of the clean-up. , I EST. 1924 L A My 00 11 1L Lei o Meeting Date: August 9, 2022 CITY COUNCIL AGENDA SUMMARY City of Yelm, Washington 311 McKenzie Ave SW - The single family home located at 311 McKenzie Ave SW is abandoned, in mid -foreclosure, and the lack of maintenance poses a fire hazard to itself and surrounding residences. The property management company in control of the property would like to cut the overgrown grass, change the locks on the residence, and overall secure the property protecting it from trespass or vandalism. We request council deems the property a nuisance, allowing the management company to be in full compliance of the HB 2057 law, and eliminating the risk this property exposes adjacent properties to.
