Staff Recommendation:
Staff recommends City Council approve the final plat for Hawks Landing, SUB-03-8333-YL,
subject to the conditions below. Staff has reviewed the plat for compliance with the conditions
of approval placed on the preliminary plat. Staff is satisfied that as, conditioned, the final plat
meets all conditions of the preliminary approval.
Background:
The Yelm City Council approved, with conditions, a preliminary plat for the above referenced
project on December 13, 2000. The project has now completed construction, and the applicant
filed an application for final plat on February 3, 2003.
Applicant: Dan Bruno, Heritage Homes and Land, Inc.
Proposal: 60 lot, Residential Subdivision Final Plat Approval
Location: 14720 and 15130 SE SR507. The project site is located on State
Highway 507, south of Mill Road.
Conditions of Final Plat Approval:
1. The applicant has provided an "Agreement Waiver of Protest and Special Power of
Attorney" to defer the required frontage improvements on State Highway 507, as
required in approval numbers 14 & 15 below. Washington State Department of
Transportation (WDOT) does not allow paving between the months of October to
April. The applicant submitted plans to WDOT for approval. The plans were not
approved in time to allow for this work to be completed prior to October. The
applicant has provided a Waiver of Protest, and Bond sufficient to cover the cost of
this construction, and intends to complete the work this spring.
2. The applicant has 60 ERU's that were designated to these parcels as part of the Local
Improvement District. The applicant has applied for an L1D Segregation, to assign the
L1D Assessments to the individual lots.
3. The Applicant has completed the landscaping as required in approval number 22,
however, the hydroseeding was applied very late in the season. The applicant has
provided a Letter of Credit and Assignment for grass seeding The assigned savings
allows for reseeding in the spring if necessary.

Original Conditions of Approval:
Sewer
1. The property is located within the Mill Pond LID District. This property has been assessed a
total of 60 ERU's within the LID. ERU's within the LID are at a cost of $1,823.15/ERU, paid
on an annual basis over 15 years. In addition, the number of ERU's in the LID are charged
a hook-up fee of $2,480 (fee subject to change) at the time of building permit issuance.
Remaining ERU's are charged at the current rate of $4,850/ERU, payable at building permit
issuance. All ERU's require an inspection with a fee of $145.00 per ERU also payable at
building permit issuance.
Complete: The applicant is current on his LID Assessment payments. The applicant
has completed an application to segregate the 60 assessments to one assessment per
new lot. Payment of the sewer connection fee will be as follows: each lot was based on
the original assessment amount of $1823.15. The current balance owing on each lot is
now $1,458.52. The current fee for residential connection, with an existing LID, is
2,620.00. This fee is subject to change, and is payable at building permit issuance.
Public Finance, Inc., administrators of the LID, has completed the paper work and
resolution necessary for the transfer. The City Council will need to approve and
adopt the resolution concurrently with the Final Plat.
2. Existing sewage systems located on-site shall be abandoned per Article IV Rules &
Regulations of the Thurston County Board of Health Governing Disposal of sewage.
Complete: The existing sewage systems were completely removed during
construction.
3. The property is subject to a latecomer's agreement between the City of Yelm and Nisqually
Estates dated January 13, 1999, for a sewer line extension. The applicant shall pay the
latecomer in the amount of $$11,798.32 prior to final plat approval.
Complete: The latecomer's payment has been made and recorded with Thurston
County.
4. The S.T.E.P. System shall be designed to City standards. The applicant shall submit final
civil plans to the Public Works Department for review and approval.
Complete: The S.T.E.P. System has been installed, and inspected by the City. The
applicant has provided a standard warranty agreement.
Water
5. The Proponent shall connect to the City's water system. There is an existing 10" watermain
located along Highway 507. Water ERU's (equivalent residential units) are based on a
consumption rate of 240 gallons per day and are charged a current rate of $1,000/ERU (fee
subject to change) inside city limits. One ERU would be charged to each. residential building
lot. These fees are payable at building permit issuance.
Complete: The Water lines have been installed, and inspected by the City. The
applicant has provided a standard warranty agreement.

6. Existing wells on-site shall be abandoned per Department of Ecology standards and
documentation submitted to the Thurston County Health Department for review.
Complete: The applicant has abandoned the existing wells on site. The applicant has
provided a water well report certifying well decommissioning.
7. Water rights for the abandoned wells shall be dedicated to the City of Yelm.
Complete: There were no water rights for these wells.
8. The property is subject to a latecomer's agreement between the City of Yelm and Nisqually
Estates dated January 13, 1999, for a water main extension. The applicant shall pay the
latecomer in the amount of $13,711.19 prior to final plat approval.
Complete: The latecomer's payment has been made and recorded with Thurston
County.
9. All open space areas and planting strips shall have an irrigation system with a separate
water meter(s). The applicant shall submit final civil plans to the Public Works Department
for review and approval.
Complete: Irrigation meter, serving all planting strips located further than 75 feet
from future hose bib connections has been installed. The approximately 1.08 acre
open space area was not irrigated as: the recreational use (basketball court) did not
require irrigation; the open space serves as a reserve area for the future SR 510/507
Loop; and for potable water conservation purposes.
Stormwater
10. The applicant shall design and construct all storm water facilities in accordance with the
DOE Storm Water Manual, as adopted by the City of Yelm. Best Management Practices
BMP's) are required during construction. The applicant shall compile a final storm water
report along with construction drawings.
Complete: The stormwater system design and construction has been approved by
the City.
11. The applicant shall submit a storm water operation and maintenance plan to the Public
Works Department for approval prior to final plat approval.
Complete: Stormwater maintenance agreement complete.
12. The stormwater system shall be held in common by the Homeowners. The Homeowners
Agreement shall include .provisions for the assessment of fees against individual lots for the
maintenance and repair of the stormwater facilities.
Complete: Stormwater maintenance agreement is complete, and will be recorded
with the final plat.
13. WSDOT will only accept surface water runoff equal in quality and quantity to that of the pre-
developed site. Any additional surface water runoff generated, impacting State property, will
require appropriate stormwater mitigation in accordance with the Department of Ecology's
Stormwater Management Manual.
Complete: The stormwater system has been inspected and approved by the City.

Transportation
14. The applicant shall complete all street improvements as identified in the Mitigated
Determination of NonSignificance.
Complete: Mitigation included Highway 507 improvements and school district
mitigation, The school mitigation has been recorded with Thurston County. The
applicant has submitted a waiver of protest and bond for Highway 507 improvements.
15. Frontage improvements are required for this project. Frontage improvements shall be
consistent with the City of Yelm's Development Guidelines. Frontage improvements for
Highway 507 shall be consistent with the section "major arteriaP'. Interior street
improvements shall be consistent with the section "local access residentiaP'.
Complete: The applicant has submitted a waiver of protest and bond for Highway 507
improvements.
16. The proponent shall mitigate transportation impacts based on the new residential p.m. peak
hour trips generated by the project. The Transportation Facility Charge (TFC) shall be
based on 1.01 new peak hour trips per residential unit. The proponent will be responsible
for a TFC of $757.50 which is payable at time of building permit.
Complete: The TFC charges are payable at building permit issuance.
The traffic impact for the commercial use shall be determined at the time of a proposed use
and land use application for the site.
The applicant has not submitted any plans for the commercial site. It will be
reviewed separately from this final plat process.
Fire
17. The applicant shall submit fire flow calculations for existing hydrants. All hydrants must
meet minimum City standards.
