A RESOLUTION OF THE CITY OF YELM, WASHINGTON, UPDATING THE CITY OF YELM FEE
SHCEDULE AND REPEALING RESOLUTION NO. 628
WHEREAS, On December 13, 2022 the Yelm City Council approved Resolution No. 628
establishing a fee schedule, and
WHEREAS, city staff have reviewed the fees and structure for the Yelm Community
Center and Yelm City Park rentals and determined that updates are needed, and
WHEREAS, proposed changes would clean up existing language to be more consistent
with current practices, and
WHEREAS, the newly constructed stage at Yelm City Park can be rented separately or
can be included in a park rental, and
WHEREAS, updated fees for Yelm City Park and Yelm Community Center define which
spaces are included in the rental fees, and
WHEREAS, a new fee for rental of city owned barricades has been added, and
WHEREAS, updated event rental fees for the Community Center and Yelm City Park will
be in effect for all 2024 events;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Yelm, Washington
as follows:
THAT: Resolution No. 645, City of Yelm Fee Schedule, attached hereto at Exhibit A is
hereby approved effective January 1, 2024 and Resolution 628 is hereby repealed.

*"Consultant costs" means any outside consultation expenses which the City reasonably
determines are necessary to adequately review and analyze the application.
*"Staff costs" means the actual costs of City staff time and resources.
"Waiver of appeal fee
The city council may waive the fee required for filing an appeal when the appellant can:
a. Show that the appeal fee will create a financial hardship; or
b. Show that the appeal fee is a barrier to public fairness; or
c. Show overriding public interest, health or safety; or
d. The appellant is a nonprofit corporation registered with the State of Washington, and
demonstrates to the City Council that the appeal fee would impact the ability to forward the
corporations mission to serve the community of Yelm. The appellant shall apply for the
waiver at the same time as the appeal is filed. Appellant shall provide documentation to the
satisfaction of the City Council that the appeal fee should be waived.
Refund of appeal fee
The Hearing Examiner may refund a portion of or the entire appeal fee if a finding is made that
the original decision was based on unreasonable grounds or without proper consideration of
circumstances.

Video Redacting Charge $0.68 per minute
Pursuant to RCW 42.56.240(14)(f), law enforcement agencies are permitted to charge
requesters not exempted under RCW 42.56.240(14)(e) the reasonable costs of redacting
videos. The Yelm Police Department analyzed a 2017 Body Worn Video Redaction Cost Study

completed by the Seattle Police Department, which determined the amount of time it takes
to redact such footage, and multiplied that amount of time by the City of Yelm Police
Department Administrative Assistant staff salaries to determine the "reasonable cost for such
redactions". The Seattle Police Department completed stopwatch style time studies to
determine the amount of time it takes to redact Body Worn Video recordings then created a
cost per minute of redaction time based on the weighted staff salary costs. The methodology
used to calculate the fee for staff time spent redacting body camera video recording was
approved by the Yelm City Council Resolution No. 634 on February 28, 2023.

ACTION REQUESTED: Move to approve Resolution No. 645 updating proposed fee structure
to modifying existing language and adding additional fee for the use of the City Park, Park
Stage and city owned Barricades
KEY FACTS AND INFORMATION SUMMARY:
Proposed changes would clean up existing language to be more consistent with current
practice. In addition, the use of the City Park would be a separate rental, allowing a user to rent
a portion of the park if desired. The newly constructed stage could be rented as a separate use
and/or is included with the park rental. Under existing language, it is less expensive to rent the
park, community center and adjacent parking lots and/or streets than it is to just rent the
community center. Through the 2023 rental season there were many lessons learned that are
reflective in the fee structure proposal and the complete overhaul of the rental facilities
guidelines and policies.
