CONCLUSIONS OF LAW, AND DECISION
FINDINGS OF FACT
1. Freddy Carballo lives in the property located at 14721 91st Ave SE, Yelm, WA 98597, Parcel
#33860004900.
2. The property is identified by the Unified Development Code, Title 18 YMC, as being within
the Moderate Density Residential (R-6) zoning district.
3. Freddy Carballo proposes to operate a Real Estate Business out of his home.
4. A home occupation permit is required when a residential dwelling unit is utilized for any
use which requires a state or city business license.
5. Chapter 18.65 YMC provides requirements and standards for home occupations. These
include the following:
The home occupation shall not occupy more than 25 percent of the total floor area of
the residence, or exceed 400 square feet.
All employees must live in the residence.
Off-street parking spaces shall not be reduced in size or number below the minimum
required, nor may they be utilized for anything other than parking.
Traffic generated by the home occupation shall not exceed 3 commercial vehicles per
week, and all client vehicles must be parked off-street.
Storage of merchandise, material or equipment must be entirely within the residence
or accessory building.
Home occupation signs must be wall mounted, and shall not exceed four square feet
in area. The sign cannot be internally illuminated, but may be indirectly illuminated.
CONCLUSIONS OF LAW
A. All home occupation requests must go through the ministerial review process. (18.12.010
YMC) The purpose of the ministerial review process is to ensure that projects are
consistent with applicable development, construction and design standards of the Unified
Development Code [Title 18, YMC]. Public notification is not required for ministerial
permits.

B. Per section 18.12.080 YMC, the planning and building manager or his/her designee may
authorize a home occupation provided it meets all applicable development, building, and
design standards of the Unified Development Code.
C. Freddy Carballo has established that the request for ministerial review approval can
satisfy all criteria set forth in Chapter 18.65 YMC, meet all requirements of the R-6 zoning
classification, and meet all other requirements of the Yelm Municipal Code and therefore
should be approved.
D. A home occupation approval is effective upon approval. The home occupation permit
may be revoked upon determination that there has been a violation of any conditions of
approval or standards of the Unified Development code.
E. Noise levels of any sound source, when measured in the manner and locations prescribed
in Chapter 173-60 WAC shall not exceed the values shown in Chapter 173-60 WAC.
DECISION
The request for a home occupation approval is hereby granted.

APPEAL
The final decision in this matter may be appealed, pursuant to Chapter 18.10 YMC, to the City of
Yelm Hearing Examiner no later than 21 days from the date of this decision. An appeal must be
in writing, contain specific factual objections, and include the appeal fee of $1,250.00.
