N\)Ø INCORPOR,\TE,D CIVIL ENGINEERING & SURVEYING October 28,2024 Hawk's Landing Homeowner's Association 15131 CarterLoop SE Yelm, WA 98597 RE: CarterLoop SP (CES #06141.0) Dear Hawk's Landing HOA, V[e are sending this letter ûo request the development of the six-lot short plat on parcel 52920000003, located at 15106 Carter Loop Road SE, be allowed to join the existing Hawk's Landing Homeowner's Association. The parcel is depicæd as Tract D (future commercial) on the Hawk's Landing recorded plaf #3522261. Pleæe note the parcel is not included in the legal description as a lot subject to the requirements ofthe Decla¡ation of Covenants. (#3531204) The City of Yelm reviewed and approved a rezone from commercial to residential in November2023. Additionally, preliminary short plat approval was issued September 23,2024, for sixJots. A copy of the map is enclosed for your review. The city placed two conditions on the short-plat approval. The city is requiring the project request HOA approval or denial to join the existing association. Below are the conditions the city placed on the proposed short plat: l. Prior to final subdivision approval, the applicant shall construct a paved 5' wide sidewalk within the existing l0' walkway easement near lot 6, connecting this new sidewalk to the paved basketball court in the Hawks Landing open space tract. If paving this new sidewalk requires approval from the Hawks Landing HOA, the applicant shall make all reasonable efforts to obtain this approval. If the approval for this sidewalk is not granted by the Hawks Landing HOA, then the applicant shall demonstrate to the City that a good-faith effort was made to obtain their approval and demonsüate to the City that the Hawks Landing HOA denied the request to construct the new paved sidewalk. If the Hawks Landing HOA denies the request to construct the new sidewalþ then this condition is considered void. 2. Request for six new lots to join the existing Hawk's Landing Homeowner's Association. The applicant shall attempt to have all 6 lots of the proposed short subdivision join the existing HOA for Hawks Landing. Ifthe Hawks Landing HOA does not vote to approve the admission of the 6 new lots to the HOA, then this condition is considered void. For tlris condition to be considered void, the applicant shall demonstate to the City that a good-faith effort was made to join the Hawks Landing HOA, and that the vote to approve their admission to the HOA did not meet the 67o/othreshold for approval. We are formally requesting the HOA consìder allowing the proposed short plat lots to join. In our review, we found in Section Five of the Declaration that an amendment is required to allow the new 492N StreetNE-SuiteD Puyallup, \üØA 98372 ?j3.8r'.8.4282 s,rvrv.cesnstinc,com residential lots to join. This is required to be heard at the HOA annual or special meeting. I understand the vote must meet sixty-seven percent for the amendment(s) to be approved.
