CITY COUNCIL MEETING MINUTES
VIRTUAL AND IN PERSON
TUESDAY, May 27, 2025
Call to Order: Mayor Joe DePinto called the meeting to order at 6:00 PM.
Roll Call: Tracey Wood, Joseph Richardson, Joshua Crossman, Stephanie
Kangiser, Brian Hess, Terry Kaminski, David Johnstone (6:05 after
sworn in) and Mayor Joe DePinto.
Staff Present: City Administrator Todd Stancil, City Clerk Kathy Linnemeyer, and
Public Services Director Cody Colt.
APPROVAL OF THE
AGENDA: Motion by Tracey Wood to approve the agenda.
Seconded by Brian Hess
Motion carried 6-0
PUBLIC COMMENT:
CONSENTAGENDA: a) May 13, 2025, Regular Meeting Minutes
b) Approval of Jazz in the Park
c) Approval of Nisqually Valley BBQ Rally
Motion by Tracey Wood to approve the consent agenda.
Seconded by Joshua Crossman
Motion carried 6-0
NEW BUSINESS: City Council Position 6 Vacancy
Motion by Brian Hess to appoint David Johnstone to fill Position 6.
Seconded by Stephanie Kangiser
Motion carried with a roll call vote of 3{3 and Mayor DePinto
breaking a tie vote.
Mayor DePinto administered the Oath of Office to David Johnstone
Appeal of Variance Granted for Reserve at Palisades Subdivision
A closed -record appeal was held to determine the legality and factual
accuracy of the Hearing Examiner's decision to grant a variance for
the Reserve at Palisades Subdivision. This was a quasi-judicial matter.
City Attorney Brent Dille advised the Council that their role was not
legislative but judicial in nature. The Council is to make a decision
solely based on the established record from the hearing examiners
process.
He asked each Councilmember to disclose any ex parte
communications and Councilmember Richardson recused himself due
to having such communications.
Both parties were allowed up to 20 minutes to testify.
Appellant Testimony - Justin Linson gave testimony that reiterated
previous testimony and arguments made before the Hearing
Examiner including that the variance should not have been granted
and the decision should be overturned.
Applicant Testimony — Matt Lewis defended the Hearing Examiners
decision and requested that the Hearing Examiner decision be
upheld. He stated that they do meet the requirements of a hardship
as defined and that WSDOT has denied a request to have access to
the state hwy.
Both parties were allowed up to 5 minutes for rebuttal.
Appellant Rebuttal —Justin Linson gave his rebuttal.
Applicant Rebuttal — Matt Lewis gave his rebuttal.

Motion by Councilmember Crossman to deny the appeal and affirm
the Hearing Examiner's decision to grant the variance from 18.52.080.
Seconded by Councilmember Kangiser
Councilmember Crossman stated Point of Order and Called for the
vote. Mayor DePinto denied the Point of Order due to discussion
still taking place.
Motion carried with a roll call vote S-1 with Councilmember
Richardson abstaining.
Professional Services Agreement with Parametrix for Rhoton Road
NW Reconstruction — Phase 1
Motion by Brian Hess to authorize Mayor DePinto to sign a
Professional Services Agreement with Parametrix in the not to exceed
amount of $848,735.15 for the Rhoton Road NW Reconstruction
Phase 1.
Seconded by Joshua Crossman
Motion carried 7-0
Thurston Economic Development Council (EDC) Professional
Services Contract
Motion Terry Kaminski to approve the Professional Services Contract
with Thurston Economic Development Council in the amount of
$10,000.
Seconded by Brian Hess
Motion carried 6-1
STANDING COUNCIL COMMITTEE REPORTS:
Public Services Committee– Councilmember Crossman reported that the Public Services
Committee met and discussed code updates, annexations, nuisance property and received a
Spring Clean Up report.
General Government Committee — Councilmember Kangiser reported that the General
Government Committee met and discussed the Mayor/Council Protocol Manual and the
Council retreat.
MAYOR/CITY ADMINISTRATOR/STAFF REPORTS:
City Administrator – Reported that all seasonal employees have been hired, announced
that the Splash Pad is open for the season that the Veterans Memorial has been completed.
Mayor DePinto– Attended the grand opening of the Indico Urgent Care, and the South
Sound Military Partnership meeting. He congratulated Councilmember Johnstone and
thanked all of the applicants.
COUNCILMEMBER REPORTS:
Councilmember Wood–Announced that the Council Retreat will be held this weekend and
that it is open to the public.
Councilmember Richardson–Thanked the applicants who applied to serve on Council and
congratulated David Johnstone on his appointment.
Councilmember Crossman – Encouraged Council to attend the South Sound Military
Partnership, attended the Blue Star Marker dedication ceremony and picked up garbage
with the Johnstone family on Spring Clean Up day.
Councilmember Kangiser– Completed two additional AWC trainings, attended the
Veterans Memorial ceremony, has spent time at Public Services learning about
infrastructure.
Councilmember Hess–Attended the Intercity Transit meeting, Veterans Memorial
ceremony and thanked all of the applicants for applying.
Councilmember Kaminski —Attended the Nisqually River Council Retreat, Law & Justice
Council meeting and the Indigo ribbon cutting.
ADJOURNMENT: Motion by Joshua Crossman to adjourn the meeting at 7:10 PM.
