HomeMy WebLinkAbout10 - LD 2023.0188 Willow Glenn IV - Decommissioned Well Transfer.docxAGREEMENT Decommissioned Well Transfer THIS INSTRUMENT is entered into this day of January, 2026, by and between the City of Yelm, a municipal corporation, hereinafter referred to as the “CITY”, and Century Communities of Washington LLC, hereinafter referred to as the “OWNER.” Collectively City and OWNER are referred to herein as “the Parties”. WITNESSETH: WHEREAS, the OWNER holds record title to the following described property located within Thurston County, Washington: Legal Description: Lot 1 in Block 35 of McKenna Irrigated Tracts, as recorded in Volume 9 of Plats, page 43, records of Thurston County Auditor; Together with that part of the South half of vacated Flume Lane adjoining said Lot on the North; Except any mobile homes located thereon; In Thurston County, Washington. TAX PARCEL ID NO. 64303500100 WHEREAS, the CITY has required as a condition of approval of the OWNER’s development of said property that the OWNER decommission pre-existing potable water well/s on the property and connect to the CITY’s water system. NOW, THEREFORE, IT IS HEREBY AGREED BETWEEN THE PARTIES as follows: 1. The OWNER attests that they are the legal owner(s) of the water rights and/or well previously located on the property. 2. The well has been decommissioned as required in Section 173-160-381 WAC. 3. The OWNER assigns all rights associated with the water rights and/or well located on the property to the CITY for transfer to the CITY. IN WITNESS WHEREOF the parties hereto have caused this Instrument to be executed the day and year first hereinabove written.
