TO GENERAL PENALTIES FOR VIOLATIONS OF THE CITY CODE AND
ORDINANCES; AMENDING CHAPTER 1.12 OF THE YELM
MUNICIPAL CODE.
WHEREAS, the City Council is authorized to modify the City code in accordance with
Washington State laws; and
WHEREAS, the current City code contains provisions that were adopted in 1984 and 1972;

WHEREAS, the City Council desires to remove conflicts and redundancies from the current
code and comply with the recommendations of the state of Washington Administrative Office of
the Courts; and
WHEREAS, the City Council desires to revise the code to provide consistency with state
penalties; and
WHEREAS, Chapter 1.12 YMC, relating to general penalties, is designed to apply to all
titles, chapters and sections of the code; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF YELM AS FOLLOWS:
Section 1. Chapter 1.12 of the Yelm Municipal Code is amended to read as follows:
Chapter 1.12 GENERAL PENALTY

1.12.010 General Penalties
1.12.020 Separate offense for each day violation committed
1.12.010. General Penalties
A. Criminal Penalty.
1. Unless otherwise provided, any person violating any provision or failingto
comply with any mandatory requirement of this code or any ordinance of
the city shall be guilty of a misdemeanor, and shall be punished as stated
in RCW 9.92.030, as amended.
2. Any person violating any provision or failing to comply with any mandatory
requirement of this code or an ordinance of the city that is designated a
gross misdemeanor shall be punished as stated in RCW 9.92.020, as
amended.
B. Civil Penalty.
1. Any person violating any of the provisions of this code or any ordinance of
the city that is designated a civil offense or civil violation shall have
committed a civil infraction.
2. Unless otherwise provided by city code or state law, any person
committing a civil infraction, including those non -criminal violations as set
forth in Title 10 YMC, shall be assessed a monetary penalty of $250.00 for
each day the violation occurs.
1.12.020 Separate offense for each day violation committed.
Each person is guilty of a separate offense for each and every day during any portion of
which any violation of this code or any ordinance of the city is committed, continued or
permitted by any person, and is punishable accordingly.
Section 2. This Ordinance shall take effect and be in force on and five days after its
passage, approval and publication as required by law.
