04-13-10 MinutesYELM CITY COUNCIL REGULAR MEETING TUESDAY, APRIL 13, 2010 MINUTES Mayor Harding called the meeting to order at 7:00 p.m. Roll Call Present: Don Miller Joe Baker, Bob Isom, Mike McGowan, Tracey Wood and Russ Hendrickson. John Thompson arrived at 7:09 pm (8b). 3. Agenda Approval 10-23 MOTION BY JOE BAKER APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations -none scheduled Mayor Harding reported on a land use ruling today from the Washington State Court of Appeals who affirmed the Hearing Examiners decision is upheld, dismissing J.Z. Knights appeal and awarding attorney fees to the City of Yelm and the developers of Tahoma Terra. Public Comment -there was no response to the Mayor's call for comment. 6. Consent Agenda a. CARRIED. Public Hearing- none scheduled 8. New Business Comprehensive Plan Amendment- Hebert Rezone. Tami Merriman reported that Mr. Hebert's attorney sent a letter requesting removal of the rezone request from tonight's agenda until which time the Comprehensive Plan is scheduled for review in 2011. No action taken a. Cabaret License, White Horse Tavern LLC Lori Mossman presented the application and regulations for issuance of cabaret license for any establishment serving alcohol beverage with the presence of live music entertainment. 10-25 MOTION BY BOB ISOM APPROVING CABARET LICENSE FOR WHITE HORSE TAVERN LLC AT 107 YELM AVE EAST. CARRIED. b. Ordinance No. 919 Finance Police Vehicle Sue Davis reviewed the staff report for the purchase of police vehicle through use of cooperative state purchasing. In so doing, the City will realize an estimated 2% saving on cost, interest rate and fees. Washington State Treasurer requires passage of an ordinance to acquire the property and execute the financial documents including designation of authorized signing agents: Mayor Harding, City Administrator and Finance Director. 10-26 MOTION BY JOE BAKER ADOPTING ORDINANCE NO. 919 AUTHORIZING THE ACQUISTION OF A POLICE CAR AND EXECUTION OF FINANCING CONTRACT. CARRIED. cc/meeting 04/13/10 8c. Puget Sound Energy Easement Request. Grant Beck presented a request from Puget Sound Energy for a purchase of overhead easement in two separate properties owned by the City to bring a third transmission service line into Yelm. Transmission line would follow existing line with taller poles requiring more surface area to maintain. Puget Sound Energy has offered $500 for 10ft wide by 380 ft length at the edge of SR507 and Mill Pond and $1575 for 15 feet by 125 feet along the edge of Third Street right of way within the set back area. Grant addressed Council's questions about the property, the appraisal and the offer. Neither sale is expected to impact future construction or devalue the property, as the easement is within the setback area, which would be required along Third Street. Grant stated that new lines would benefit the City with increased reliability of service to the city and residents. MOTION BY JOE BAKER AUTHORIZING MAYOR HARDING TO SIGN TWO 10-27 OVERHEAD EASEMENTS GRANTING PUGET SOUND ENERGY THE RIGHT TO CONSTRUCT AND MAINTAIN POWER TRANSMISSION LINES FOR TWO CITY OWNED PROPERTIES. Vote; 3 Ayes, 4 Neah. MOTION FAILED. d. Resolution No. 509 Conservation Program Grant Beck reviewed the staff report and resolution proposed to implement water conservation by establishing policies and procedures for use of water for commercial irrigation. 10-28 MOTION BY MIKE MCGOWAN APPROVING RESOLUTION NO. 509 RESTRICTING THE USE OF WATER FOR IRRIGATION PURSUANT TO SECTION 13.04.97 YELM MUNICIPAL CODE AND ESTABLISHING POLICIES AND PROCEDURES FOR THE IMPLEMENTATION OF WATER CONSERVATION MEASURES. SW Yelm Well #2, Golder and Associates Scope of Work Shelly Badger provided a history of the on-going water rights work that Yelm has engaged in their quest for new water. City submitted new water rights application in 1994 to provide water for Yelm's future from deep water aquifer for long term needs with Department of Ecology. Adopted Water system plan for wells, yet to be drilled in deep aquifer. In 2007-2009, the City modeled impacts of developing deeper aquifer system and produced mitigation plan of those impacts to submit to Department of Ecology (DOE). The draft Water System Plan includes the current rate structure to drill and construct first production well, closer to center infrastructure. The responsive bid was from Boart Longyear to drill up to 800 feet deep, including a well seal install to 300 feet to minimize potential impact to any shallow wells in the surrounding area. Property ownership is slated to be dedicated as future city park. Contingency for additional work written into scope of work, requiring a change order on approval. 10-29 MOTION BY BOB ISOM AUTHORIZING MAYOR HARDING TO SIGN THE SCOPE OF WORK WITH GOLDER AND ASSOCIATES IN THE AMOUNT OF $615,223 FOR CONSULTING SERVICES AND WELL DRILLING FOR SW YELM WELL #2. CARRIED. Mayor Harding added this is a positive project moving Yelm forward to establish future water supply needs for current and future citizens. Council and staff mindful that the plan have no adverse impact on other wells. 9. Old Business - none scheduled cc/meeting 04/13/10 10. Mayor and City Council Reports Councilmember Baker attended impressive groundbreaking ceremony for the Department of Transportation SR510 Loop project. Also attended Inter-jurisdictional Intercity Transit meeting to select number of members on the authority. Reported from the regular Intercity Transit meeting where they continue to discuss tax rate options and route and schedule cut-backs in Olympia and Yelm if measure fails. Councilmember McGowan chairs Thurston County HOME Consortium. Request for Funding Proposal meeting allocated $2.5 to the numerous applications received. Funding of $40,000 went to Killion Apartments for rehabilitation and rental voucher were two items allotted to Yelm needs. Councilmember Wood attended his first Solid Waste Advisory Committee (SWAG) meeting and Transportation Policy Board (TPB) orientation. Councilmember Thompson attended the Chamber Forum where Mayor Harding presented the conservation measures proposed for commercial irrigation users. Mayor Harding attended the groundbreaking events for the new medical clinic and the DOT SR 510 Loop. He presented conservation measures proposed at the Chamber forum as well as explaining revisions on the billing statement, making it easier for business owners and residents to understand their billing statement. Mayor Harding reminded Council of the upcoming Spring Home and Garden Show on April 24 and 25, where Council and staff will be on hand to meet, greet and inform those attending about city matters. 11. Executive Session Mayor Harding informed the audience that Council would be going into executive session for approximately 30 minutes to discuss a possible real estate acquisition. The executive session was opened at 8:03 pm. Council returned to regular session at 8:37. 12. Correspondence included correspondence from Association of Washington Cities call for nominations for Officer and Director of AWC Board, Thurston County Chamber Voice, Thurston County Solid Waste invitation to the South Sound Green Tour, April 17 and 18, 2010, and Honeywell letter referenced in agenda item 8. removing Comprehensive Plan Amendment Hebert rezone request. 13.
