AN ORDINANCE creating a Tree Advisory Board; providing how the same shall be constituted;
defining the duties, authority and function thereof; creating a new chapter of Title 2, Yelm
Municipal Code; and providing an effective date.
BE IT ORDAINED AND ESTABLISHED BY THE COUNCII. OF THE CITY OF YELM,
THURSTON COUNTY, STATE OF WASHINGTON, AS FOLLOWS:
Section 1. Purpose. A Tree Advisory Board is hereby created and established to advise the
City of Yelm Council on specific tree-related matters as enumerated in this Ordinance.
Section 2. Membership -Appointment -Removal Compensation.
A. The Tree Advisory Board shall consist of five (5) members who shall be appointed by the
mayor of the city. The term of office for two (2) members shall be two (2) years and three (3)
members shall be three (3) years.
B. Any member who fails to attend three (3) consecutive meetings of the Tree Advisory
Board, that are not excused, shall be replaced immediately.
C. Any member may be reappointed by the mayor after the lapse of any term in ofIā¢ice. The
Mayor shall fill any vacancies as they may occur, and any person so appointed shall serve for the
unexpired portion of the predecessor's term.
D. Members of the Board shall serve without compensation, provided, however, that the
reasonable expenses of the Board and its members shall be provided for by budgeted funds as
approved by vote of the City Council.
Section 3. Organization -Records
A. The Board shall select its own chairperson from its membership, may create such other
officers and subcommittees as it may deem necessary, and shall adopt all necessary rules or
regulations for the transaction of its business and the keeping of its own records.
B. Accurate minutes shall be kept of the proceedings of all meetings, findings, and
determinations, which minutes shall be made available to the public at the City Hall and at all
reasonable times. The Tree Advisory Board shall meet monthly on a regular schedule as
determined by the Board, and such meetings shall be open to the public.
Section 4. Authority -Powers and Duties The Tree Advisory Board shall have the following
powers and duties:
A. The Board shall develop a comprehensive community tree management program for the
care of trees on public property;
B. To obtain public testimony and/or input as deemed necessary and to make
recommendations to the City Council concerning trees on public property;
C. To make recommendations to the City Council on ordinances, rules and regulations
regarding trees on public property to best serve the interests of the public; and
D. To carry out any other and further tree related projects assigned by the Mayor or City
Council.
Section 5. Budget. The Tree Advisory Board shall annually submit to the City Clerk its
proposed budge for the following fiscal year, to be considered and passed upon by the City
Council. Such budget proposal shall be submitted not later than the 15th day of October, of each
calendar year following enactment
Section 6. New Code Section The provisions of this Ordinance shall be codifies as a new
chapter within Title 2 of the Yelm Municipal Code.
Section 7. Seve~ If any provisions of this ordinance or its application to any person or
circumstance is held invalid, the remainder of the ordinance or the application of the provisions to
other persons or circumstances is not affected.
Section 9. Effective Date. This Ordinance shall become effective on the 5th day of
November, 1996, being a date not less than five days following publication.
