160 Annex Yelm Creek Canal Crystal Springs
ORDINANCE N0. 160
AN ORDINANCE providing for the annexation of certain
contiguous property to the Town of Yelm, Washington,
declaring an emergency, and making the ordinance
effective immediately upon passage.
BE IT, ANP IT IS HEREBY ORDAINED BY THE COUNCIL OF THE
TOWN OF YELM, as follows:
Section 1. On the 10th day of October, 1973, there was filed
with the Council and the Mayor of the Town of Yelm, Washington, a notice
of intent to commence proceedings for the annexation of the Town of Yelm
of the real property hereinafter described pursuant to the petition method
provided by Chapter 35.13 of the Revised Bode of :~Tashington, which notice
was signed by the owners of more than ten percent (10~) in value, according
to the assdssed valuation for general taxation, of said real property.
Section 2. That pursuant to said notice, ®n October 10, 1973,
at 8:00 o~clock P.M. at the Town Hall, Yelm, Washington, the Council
held a meeting with representatives of the parties signator to said notice
for the purpose of discussing and determining the matters set forth in
RCW' 35.13.125.
Section 3. At the meeting held on the said 10th day of October,
1973, the M~ror and Council of the Town of Yelm met with the said representatives
of the initiating parties and considered the matters provided for in RCW
35.13.125 and determined that there is no liability of the Town of Yelm
on general obligation bonds, the liability for which should be extended
to the area proposed for annexation, and further determined that the Town
of Yelm had not adopted a comprehensive plan extending over the area
proposed for annexation, but that the said petitioners desired that the
area proposed for annexation be sub3ect to the zoning c~.assification of
Residential Agriculture if the same be annexed to the Town of Yelm, and
the Council further made its preliminary determination that it would acce~xt
~` the proposed petition for annexation.
Section 1~. Pursuant to the determination made at saiG meeting,
a petition for the annexation of such real property to the Town of Yelm
was circulated, and said petition was thereafter filed with the Council
of the Town of Yelm. That the Council of the Town of Yelm determined
that said petition complied in all respects with the provisions oaf RCW 35.13.130
and directed that the 1l~th day of November, 1973, at 8:00 o~clock P.M.
at the Taaan Hall, Yelm, ~~Jashingten, be fixed as the time and place for
a public hearing on the said petition for annexation and inviting all interested
parties to appear at said hearing and voice their approval or disapproval
of the petition for annexation, and directing that notice of such hearing
be given by publication in The Nisqually Valley News, the aafficial newspaper
of the Town of Yelm, and by posting three copies of such notice in three
public places within the area proposed for annexation.
Section 5. That the said notice of hearing on the petition
for annexatiaai was posted in three public places within the area proposed
for annexation and published in one publication of The Ali squally Valley
News, as appears from the affidavits of posting and of publication filed
with the Council of the Town of Yelm.
Section 6. That a hearing was regularly held at the time and
place fixed in said notice in the manner provided by law, and all interested
parties were heard with respect to the proposed annexation.
Section 7. That the following portion of Thurston County, State of
Washington, to-wit:
Beginning at the intersection of Yelm Creek and the
center line of the Southwest quarter of the Southwest
quarter of Section 18, Township 17 North, Range 2
East, W.M. Thence North along said Yelm Creek to
the Northerly line oaf the said Soaithwest quarter of the
Southwest qugrter; thence East along said Northerly
line to its intersection with the East right of way line
of the cGUnty road known as Crystal Springs Road;
thence North along said road to its intersection with
the South line of the county road known as Canal Road;

thence East along said Canal Rarad to the West line of
the tract owned by Arther J. Mackey and Ruby B. Gorman;
thence South along said West line to its intersection
with the North line of the Southeast quarter of the
Southwest quarter of Section 18, Township 17 North,
Range 2 East, W.M.; thence East along said North line
to its intersection with the Truest right of way line
of Rhoton Read; thence South along said right of way line
to the center line of the Southeast quarter of the South-
west quarter of Section 18,Township 1? 1Qbrth, Range 2 Last, W.M.;
thence West along said center line to the point of beginning.
being contiguous to the Town anf Yelm, Washington, and not being a part
of any incorporated city or town of the State of Washington, be, and the
same is hereby annexed to the Town of Yelm.
Section 8. That the said real property shall be and become
a part of the Town of Yelm effective on the date and time of the adoption
of this ordinance and that said area shall be subject to all laws and ordinances
of the Town of Yelm then and thereafter in force.
Section 9. That the above-described real property hereby
annexed to the Town cf Yelm be, and the same is hereby zoned Residential
Agriculture.
Section 10. That a copy of-this ordinance be recorded by
the Clerk of the Town of Yelm with the Auditor of Thurston County, and
that a copy hereof be filed with the Board of County Commissioners of
Thurston County in compliance with the provisions of RCiJ 35.13.150.
Section 11. This ordinance is necessary for the immediate
preservation o f the public health, welfare and safety of the Town of Yelm,
Washington, and its existing public institutions and shall take effect immediately
upon its passage and publication.
