Recommendation
Adopt Ordinance Number 880 annexing property located east of Grove Road on the
south side of SR 507, into the City of Yelm.
Background
On April 10, 2007 Kenneth Jewell appeared before the City Council with a request to
circulate a petition to annex approximately 9.33 acres of land located east of Grove
Road on the south side of SR 507. The property in question is 1 parcel, and is owned
by Kenneth Jewell. The property is adjacent to the existing City Limits on the west and
north, and is in the Urban Growth Area for the City.
The Council approved the circulation of an annexation petition at its regular meeting of
April 10, 2007.
The Community Development Department then processed the proposed annexation
through the Thurston County Boundary Review Board, requesting a waiver from review
by the Boundary Review Board pursuant to RCW 36.93.110, which authorizes the
Chairman of the Boundary Review Board to exempt from review proposed annexation
where the area proposed for annexation is less than 10 acres, and less than 2 million
dollars in assessed valuation.
The Boundary Review Board issued a Statement of Exemption on July 18, 2007
Upon annexation, the land would be zoned Heavy Commercial (C-2) as stated in the
Yelm Comprehensive Plan.

Current Situation
The Council should adopt Ordinance Adopt Ordinance Number 880 annexing the
property south of SR 507, and east of Grove Road into the City of Yelm.
This action does not conflict with the policy adopted by the Council on May 8, 2007, via
Resolution Number 472, which states that "no request to circulate a petition for
annexation shall be authorized for any residentially zoned property within the Yelm
Urban Growth Area". The property, when annexed would be zoned Heavy Commercial.

AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE CITY OF YELM, WASHINGTON
WHEREAS, the record owners of at least sixty percent of the value of the property
described in Exhibit A attached have petitioned for annexation to the City of Yelm,
WHEREAS, the City Council ofYelm has held aduly-noticed public hearing regarding
such annexation,
WHEREAS, the City Council finds that such annexation is in the best interest of the City
and conforms with annexation policies of the City as set forth in the Comprehensive Plan and
Yelm Municipal Code Chapter 2.66.
NOW, THEREFORE, THE CITY COUNCIL OF YELM DOES ORDAIN AS FOLLOWS:
SECTION 1. The described territory that is attached to this ordinance as exhibit A, is hereby
annexed and made a part of the City of Yelm:
SECTION 2. Said property shall be subject to the existing indebtedness of the City of Yelm
and to pay said indebtedness shall be assessed and taxed at the same rate and on the same
basis as other property within the City of Yelm.
SECTION 3. The City Clerk shall record a copy of this ordinance in the Office of the County
Auditor and file a certified copy with the Board of County Commissioners.
SECTION 4. This ordinance shall take effect five days after its publication as provided by law
PASSED by the City Council of Yelm this 14t" day of August, 2007.

NOTICE OF PUBLIC HEARING
YELM CITY COUNCIL
The Yelm City Council will hold an open record public hearing at 7:30 PM on Tuesday
August 14, 2007, at Yelm City Hall, 105 Yelm Avenue West in Yelm, Washington.
The purpose of the hearing will be to receive public comments on the proposed
annexation of approximately 9.33 acres of land into the City of Yelm. The property is
located east of Grove Road, on the south side of SR 507.
Testimony may be given at the hearing or through written comments, which must be
received by the close of the public hearing. Written comments may be submitted to the
City of Yelm at the address shown above or mailed to: City of Yelm, PO Box 479, Yelm,
WA 98597.
Any related documents are available for public review during normal business hours at
the City of Yelm, 105 Yelm Avenue West, Yelm, WA. For additional information, please

Re: Waiver request for proposed annexation
Dear Mr. Falcone:
Pursuant to RCW 36.93.110 the City of Yelm requests the full Boundary Review Board
process be waived on the enclosed application far annexation.
The proposed annexation is less than 10 acres in size and is less than $2 million in
assessed value, including improvements. Following is information requested, by the
Chair of the Boundary Review Board, for a waiver to be considered.
1. The proposed annexation area includes tax parcel number 64303200300. The
parcel is 9.33 acres with an assessed valuation of $943,050.00.
2. The City of Yelm received a Notice of Intent to Commence Annexation
Proceedings in April 2007. The .property owner submitted a Petition to Annex to
the City Council on April 10, 2007. Copy of the City Council minutes are
attached.
3. The current County zoning is 1 unit per 5 acres. Upon annexation the parcel
would be zoned Heavy Commercial (C-2) in accordance with the site's future
land use designation found in Yelm's Comprehensive Plan and Joint Plan with
Thurston County. Please see enclosed map.
4. The proposed annexation site is rectangular in shape and contiguous to the City
on the west and north property lines. The proposed annexation area is within
Yelm's urban growth boundary. Please see enclosed map.
5. The original and eight (8) copies of the application, and a CD Rom containing the

of the real property herein described, do hereby petition that such territory be annexed to and
made a part ofthe City of Yelm.'
The territory proposed to be annexed is within Thurston County, Washington. A description of
the property and a map that outlines the boundaries of the property as more particularly
described in Exhibit A is attached.
The City Council of the City of Yelm met with the initiating parties at a Council meeting on April
10, 2007 and did determine that the City would accept the proposed annexation. At said
meeting, the City Council did also determine that:
• It would require the simultaneous adoption of a comprehensive plan for the area to be
annexed; and
• ft ~~outd require the assumption of existing City indebtedness b~ the area to be annexed,
as disclosed by the minute entry regarding the same in the minutes of said Council meeting.

of the City Limits. Tami Merriman reviewed the stall report showing interest by
Kenneth Jewell to annex 9.33 acres into the city limits with the intent to develop as
Heavy Commercial use (C-2). The proposed annexation makes a logical city boundary
and development would protect the Yelm Loop right of way bisecting this property and
provide a portion of the Yelm Loop construction. Dedication of the right of way meets
the goals and policies of the Yelm Transportation Comprehensive Plan.

Tami Merriman reviewed the staff report indicating interest by Brenda Jolin to circulate
an Annexation Petition to annex a 5 acre parcel into the city limits for the intent to
develop. Property is currently zoned Rural Residential with the potential for 3D
residential units if annexed and zoned Moderate Density Residential (R-6}. The
proposed annexation does not make a logical boundary for the city limits. If the
boundary were extended, there are not enough water rights in the applicant's control to
support this increase to the number of potential units in this development.

Tim Peterson stated that as part of the Water Conservation Plan for protecting precious
water resources from loss. it is necessary to complete the installation of the hydrant
locks throughout the City.

Council member Baker attended Intercity Transit Board meeting.
Council member McGowan reported the TC HOME Consortium Committee awarded
575.000 to organizations including: Habitat for Humanity, Safe Place and the Salvation
Army. Nothing has been requested from the Yelm area.
Council member Hendrickson reported that the consolidated recycle bins are in the
process of being delivered to the citizens of Yelm.
Mayor Harding attended Yelm Emergency Operations Board meeting where they
discussed coordination of volunteer resources Also attended Thurston County Mayor's
Forum.

Current Joint Plan Designation: The Yelm Comprehensive Plan and Joint
Plan with Thurston County designates these properties as Rural
Residential 115, with future zoning when annexed into the Gity Limits of
Yelm as Heavy Commercial (C-2).

within the annexation area.

A water and sewer main has recently been installed along the frontage of
this property by commercial project across the SR 507 and service is
available upon annextation.

13. Does this proposal conform to adopted county-wide planning policies on
annexation?
The City of Yelm's Urban Growth Boundary (UGA) is established and
discussed in the City of Yelm Comprehensive Plan and Joint Plan with
Thurston County. The parcel included in this annexation petition is within
the UGA. It is located within the City's Water and Sewer ervice areas.
14. Other specific Reason(s) :for Annexation:
The proposed annexation parcel includes land that is required for future
right-of-way of the SR 510 Yelm Loop {Y-2). A commercial development
occurring across the SR 507 from this parcel is constructing a portion of
the SR 510 Ye1m Loop as well as installing a signalized in#ersection.
Development of this parcel, and the adjoining parcel to the west, would

complete the signalized intersection improvements, and provide the right-
of-way needed for a portion of the future Yelm Loop. The construction of
the future right-of-way is imperative for the commercial development of
these parcels. The proposed annexation creates a logical boundary for the
City.
15. Explain how this proposal furthers the objectives of the Boundary Review Board
(as applicable) (RCW 36.93.180} [attach addi#ional pages if necessary] (Some of
these items may not apply because of Growth Management Agreements.):
a. Preservation of natural neighborhoods and communities:
The annexation area consists of one parcel, developed as rural residential,
with one single family home, and 2 barn structures. Future zoning of this
parcel as Heavy Commercial and current zoning and development of
surrounding parcels as Large Lot Commercial, is designated and planned
for this type of development. The Gity will provide water and service to the
proposed annexation area.
Use of physical boundaries, including but not limited to bodies of water,
highways, and land contours:
The proposed annexation area follows SR 507 and existing property lines.
At the time of development, dedication and construction of right-of-way for
the future SR 510 Yelm Loop will create safe access to the parcels, and
benefits the City and community. It is a IogicaF City boundary that
completes the commercial zoning in this area.
c. Creation and preservation of logical service areas:
Sewer and water have recently been installed in the area of this proposed
annexation. The land is included in the City of Yelm Water and Sewer
Service Areas.
d. Prevention of abnormally irregular boundaries:
The annexation area follows existing property lines, and completes the
commercial zoning in this=area. - ~~
e. Discouragement of multiple incorporations of small cities and encouragement of
incorporation of cities in excess of ten thousand population in heavily populated
urban areas:
The annexation area lies in the urban growth boundary as established in
the City of Yelm Comprehensive Plan, Joint Plan with Thurston County.
f. Dissolution of inactive special purpose districts:

There are no special purpose districts in the proposed annexation area.
g. Adjustment of impractical boundaries:
The annexation area extends the city limits within a practical boundary.
h. Incorporation as cities or towns or annexation to cities or towns of
unincorporated areas which are urban in character:
The annexation area is zoned Rural Residential 115, and is adjacent to land
within the City limits that is commercially zoned and currently in
commercial construction.
i. Protection of agricultural lands:
The annexation area land has not been in active agricultural use.

For your information, the Boundary Review Board can consider the following
factors (RGW 36.93.170) in deciding whether a particular decision furthers the
objectives stated above:

populated areas

incorporation and unincorporated areas during the next ten years

11. Need for municipal services
12. Effect of ordinances, governmental codes, regulations and resolutions on
existing uses
13. Present cost and adequacy of governmental services and controls in area
14. Prospects of governmental services from other sources
15. Probable future needs for such services and controls
16. Probable effect of proposal or alternative on cost and adequacy of
services and controls in area and adjacent area
17. The effect of the finances, debt structure, and contractual obligations and
rights of all affected governmental units
18. The effect of the proposal or alternative on adjacent areas, on mutual
.economic and social interests, and on the local governmental structure of
the county
19. Decisions of the Boundary Review Board must also be consistent with the
