04-26-11 MinutesYELM CITY COUNCIL REGULAR MEETING TUESDAY, APRIL 26, 2011 MINUTES Mayor Pro-Tem Bob Isom called the meeting to order at 7:00 p.m. 2. Roll Call. Present: Don Miller, Joe Baker, Tracey Wood, John Thompson and Russ Hendrickson. Mayor Harding excused. Mike McGowan arrived at 7:03. 3. Agenda Approval 8. b moved to 8. a so that Brent Dille could be present for the Moratorium on Medical Marijuana Dispensaries. 11-35 MOTION BY JOE BAKER APPROVING THE AGENDA WITH THE CHANGES. CARRIED. 4. Special Presentations- Bicycle Commuter Month Proclamation Mayor Pro-Tem Isom read the Proclamation, introduced Duncan Green from Intercity Transit, and presented the proclamation. Mr. Green coordinates the Annual Bicycle Commuter Month hosted by Intercity Transit. In conjunction with the National Bike Month, the Bicycle Commuter contest encourages all Thurston County residents to try bicycling as a means of transportation during the month of May. There are rewards and recognition for those who do with prizes and coupons from local sponsors. This event has taken place for 24 years and is well received by many people of the community. Bicycling instead of driving is a good way to improve personal fitness, save money and reduce the impact on the environment both locally and globally. 5. Public Comment -Cindy Teixeira, Friends of the Library member and Pierce County resident spoke in favor of the future proposal that the City will present to the Timberland Regional Library Board on Wednesday, April 27, 2011 at the Tumwater Library, 7:00 pm for housing of the Yelm Library. Ms. Teixeira and other library goers have been at the intersection of Yelm Avenue and First Street rallying support for the Yelm Library with signs asking cars to honk in support of the library. Kelsey Raddas, Yelm Timberland Library employee and resident of Yelm, also spoke in favor of the library. Ms. Raddas stated that our local library has an impact on the community every single day and shared some experiences. Thanked the council for their continued support of the Yelm Library. Mayor Pro-Tem Isom assured the audience that there will be a Library in Yelm, it might not be as big as the current location, but it will not go away. The City Council is committed to assure that there is a library facility in this City. 6. Consent Agenda Minutes -Regular Meeting April 12, 2011 Payables -Checks 55675 - 55774, Totaling $158,209.94 11-36 MOTION BY JOHN THOMPSON APPROVING THE CONSENT AGENDA AS PRESENTED. CARRIED. 7. Public Hearing -Moratorium on Medical Marijuana Dispensaries- moved to 8. b. Page 1 of 3 8. New Business a. Regional Plan for Sustainable Development -Memorandum of Understanding Grant Beck is pleased to recommend that the Council authorize Mayor Pro-Tem Isom to sign the Regional Plan for Sustainable Development Memorandum of Understanding (MOU) for the Thurston County, Washington Region. The Thurston Regional Planning Council (TRPC) submitted a grant last August to the U.S. Department of Housing and Urban Development (HUD) under the Sustainable Communities Regional Planning Grant Program on behalf of a consortium of eligible partners. The City of Yelm supported this effort and submitted a letter of support of the application. The MOU is the first step in formalizing the partners that applied for the grant with Thurston Regional to proceed with the work authorized per the grant. Lon Wyrick, Executive Director of Thurston Regional Planning Council gave background on the organization and gave details of the grant. The region received the grant for $1,500,000 over a three-year process to develop a Regional Plan for Sustainable Development - an integrated regional plan that articulates a vision for growth that federal housing, transportation and other federal investments can support. The Sustainable Communities Regional Planning Grant Program is part of an effort underway by the Department of Housing and Urban Development (HUD), the U.S. Environmental Protection Agency (EPA) and the U.S. Department of Transportation (DOT) to help improve access to affordable housing, provide more transportation options, and lower transportation costs while protecting the environment in communities nationwide. The three federal agencies have made a commitment to utilize the integrated regional plans or visions to guide their planning and funding decision-making. The City of Yelm has adopted sustainability as a core principle of its Comprehensive Plan, sustainability, and supports efforts to increase regional, local, and state capacity to incorporate livability, sustainability, and social equity principles into land use and zoning. 11-37 MOTION BY JOE BAKER AUTHORIZING MAYOR PRO-TEM ISOM TO SIGN THE REGIONAL PLAN FOR SUSTAINABLE DEVELOPMENT MEMORANDUM OF UNDERSTANDING FOR THE THURSTON COUNTY, WASHINGTON REGION. CARRIED. 7. Public Hearing -Moratorium on Medical Marijuana Dispensaries Mayor Pro-Tem Isom opened the public hearing at 7:32. Grant Beck stated that on March 22, 2011 the City Council adopted Ordinance 935 establishing a moratorium on medical marijuana dispensaries. The moratorium was adopted under the authority of the Growth Management Act at Section 36.70A.390 RCW, which states that a public hearing on the adopted moratorium, must be held within 60 days of its adoption. Although the City Council did adopt findings and conclusions as part of its adoption of Ordinance 935, the proposed resolution affirms and updates these findings and could be adopted if the Council chooses to continue the moratorium. If, after considering all public testimony regarding the moratorium on medical marijuana dispensaries, the Council desires to continue the moratorium, it should adopt Resolution 523. Without action by the City Council, the moratorium enacted by Ordinance 935 would expire. If Resolution 523 is approved the moratorium would remain in effect for a period of six months from March 22, 2011, when Ordinance 935 was adopted. Currently the House of Representatives have adopted a similar bill (Senate Bill 5073) with a summary of changes, which are included in the council packet. The Senate adopted the bill in the form that the House proposed and is now before the Governor for action. Mayor Pro- Tem asked for Public Comments. No public responded. Moratorium on Medical Marijuana Dispensaries Brent Dille was present to answer any questions from the council. 11-38 MOTION BY JOHN THOMPSON ADOPTING FINDINGS OF FACT AND CONCLUSIONS OF LAW SUPPORTING ORDINANCE 935 ESTABLISHING A MORATORIUM ON MEDICAL MARIJUANA DISPENSARIES. CARRIED. 9. Old Business -None scheduled 10. Mayor and Council Initiatives Councilmember Baker attended Intercity Transit meeting and the Yelm Adult Community Center meeting where they discussed repairs to the Senior Center building Councilmember McGowan attended the Elected City Officials Retreat along with the other council members. Councilmember Wood attended a Transportation Policy Board meeting along with Grant Beck and Stephanie Ray where they secured some funding for sidewalk improvements. Mr. Wood also attended the monthly Thurston County Solid Waste committee meeting. Councilmember Thompson attended the Nisqually River Council meeting and talked about the Salmon Recovery Plan. Councilmember Hendrickson attended the Medic One meeting and found out that if you are going to have a heart attack that Thurston County is the best place to have it. Your chances for survival are 42%. They also discussed the Mobile Computer Terminal (MCT) that will be in the Medic units for additional confidential information. Mayor Pro-Tem Isom also attended the Council Retreat, which consisted partly of a tour around the City to see the past projects and future projects. An upcoming project will be some new sidewalks thanks to Councilman Woods' efforts through the Transportation Policy Board, a branch of the Thurston Regional Planning Council. Mayor Pro-Tem encouraged everyone to attend the Home and Garden Show April 30 & May 1 at the Yelm High School and Arbor Days at the City Park on Friday, April 29 at 11 am. 11.
