The Mayor called the meeting to order at 7:00 p.m.
2. Roll Call: Present; Joe Baker, Bob Isom, Mike McGowan, Pat Fetterly John
Thompson and Russ Hendrickson. Excused; Don Miller and John Thompson.
3. Agenda Approval
9-023 MOTION BY JOE BAKER APPROVING THE AGENDA AS PRESENTED.

5. Public Comment. Steve Klein, a Thurston County resident stated that for the
city to continue issuing approvals for plat development with ongoing litigation
concerning water availability at final plat is quite remarkable and illustrates the
city's intent to the ultimate degree. Mr. Klein is on the record to say this action is
being noticed and will be presented before the State Department of Ecology,
Department of Health and the State Attorney General's office. The city would
show good judgment by not approving further developments until all components
are in place and the current appeal has been determined.

8. New Business
a. Ordinance No. 902 Budget Amendment Killion Road/Yelm Ave West. Shelly
Badger explained that the amendment would provide funding for final
construction payments but will not be used for engineering costs or LID final
formation. Cash is available in Fund 310 to pay these expenses, but was
unallocated in the 2009-2010 budget to ensure Council approval of all LID
expenses as the project nears closeout.

2009-2010 BUDGET FOR KILLION ROAD IMPROVEMENT FUND (310)
ALLOCATING $74,118 OUT OF CASH FOR REMAINING CONSTRUCTION

b. Final Plat John's Meadows. Nisha Box stated the 42 lot subdivision is located
off of Middle Road and is adjacent to Mill Pond School. The Yelm Hearing
Examiner approved, with conditions, the preliminary subdivision on June 24,
2005. The City has submitted to the Washington Department of Ecology
mitigation plans for new rights and a note has been added to the face of the final
subdivision that states; Issuance of a building permit constitutes the City of
Yelm's determination that evidence of an adequate water supply for the intended
us of the building has been provided pursuant to Section 19.27.097 RCW. The
City currently does not hold sufficient water rights to serve all undeveloped lots
within its water service area, but has determined that the proposed means of
water supply for this final subdivision is adequate pursuant to Section 58.17.150
RCW. If the City is unable to provide potable water at the time a building permit
application is submitted for any structure within this subdivision, the permit will
not be issued until such time as evidence of an adequate water supply can be
made pursuant to Section 19.27.097 RCW. The staff has reviewed the
subdivision for compliance with the conditions of approval placed on the
preliminary subdivision and is satisfied that the final subdivision meets all
conditions of the preliminary approval and asks for approval of the final
subdivision for John's Meadow SUB-04-0175-YL.

c. Neighborhood Stabilization Plan -Assistance Program Resolution No. 493
Certificate of Compliance, Resolution No. 494 Grievance Procedure. Cindy
Teixeira gave an overview of the program stating that in November 2008, the
City of Yelm issued a letter of support for the State's proposal regarding the
Federal Neighborhood Stabilization Program. In January 2009, Yelm was named
a recipient of $611,000 on the condition that a plan for using the money was to
be submitted by April 1, 2009. The funds were awarded based on information
about bank-owned homes in the 98597 zip code and are to be employed to
address the impact of abandoned and foreclosed homes in Yelm neighborhoods.
In February, the City was sent a letter reporting an increase in the NSP award to
$640,505. In order to complete the plan, two resolutions are required before the
plan may be submitted to the State. Theresa Slusher and James Guteirrez of the
Housing Authority of Thurston County (HATC) were in the audience to answer
any questions that council had regarding the process.

9-029 MOTION BY MIKE MCGOWAN APPROVING THE NSP PLAN FOR
SUBMISSION TO THE NEIGHBORHOOD STABILIZATION PROGRAM (NSP)
STATE PROGRAM MANAGER. CARRIED.

10. Council and Mayor
Councilmember Baker attended the Intercity Transit Board meeting where the
village van will continue to run for low income people and people seeking

employment. They also discussed new methods on how to address the smoking
in the Olympia and Lacey shelters. Also attended the Yelm Adult Community
Center meeting and states that the center is doing well financially. Their budget
is currently in the black.

Councilmember Isom had the opportunity to watch the Middle School 7th
graders act out a mock Council meeting and was impressed with the way all
three classes conducted themselves and the process and decisions that were
made.
Councilmember McGowan attended the 7th graders mock Council meeting and
gave kudos to the students that participated and found it very interesting.
Councilmember Fetterly attended the mock Council meeting and the ribbon
cutting of Coates Road.
Councilmember Hendrickson attended the Regional Fire Authority meeting
where the plan that Council has looked at and approved will be forwarded to
Thurston County Elections and Prosecuting Attorney for their review.
Mayor Harding attended the Master Builders Association dinner and talked
about what Yelm's expectations are for the future and thanked the
Councilmember's for their support and their optimistic philosophy on some of the
issues that Yelm has dealt with. He visited Rosemont's Retirement Center and
updated the residents there and answered any questions they had. Attended a
joint Town Hall meeting at Rosemont on Saturday with Representative Jim
McCune and Senator Randi Becker. Mayor Harding also attended the 7th grade
mock Council meeting and was very impressed on the way they went through
the process. It was a learning experience for the kids and the members of the
council and staff that attended the mock session.
