Good morning Tami
PSE understands that Yelm Public Works has concerns regarding the
re-imbursement potential for future relocation of PSE's proposed
transmission lines in the vicinity of Mossman and 3rd St SE if the city
initiates the Public Improvement project as described in the city's
6-year TIP.
Under Section 4.1 of the electric franchise (attached), it is PSE's
interpretation that there would need to be 2 separate City caused
relocations within 5 years to activate the requirement that the city pay
for the second relocation. PSE is initiating the proposed transmission
facility construction independent of any City caused action. Therefore,
PSE does not believe that the proposed transmission construction is the
first "trigger". We believe that the initiation of the first city
project for this intersection would constitute the first trigger.
PSE desired to avoid potential future relocation at this intersection,
but we have been unable to reach agreement with private landowners. PSE
will work with Yelm Public Works to identify a design that is compatible
with the road project when it comes to fruition. In the meantime, we
have minimized to the extent possible the cost of the current proposed
facilities.
I suggest that the Yelm City Attorney review the franchise and provide
an interpretation. Please let me know if the city's interpretation is
inconsistent with PSE's. Also, let me know if the city has any other
concerns or questions regarding this matter.
