RESOLUTION NUMBER 523
ADOPTING FINDINGS OF FACT AND CONCLUSIONS OF LAW SUPPORTING
ORDINANCE 935 ESTABLISHING A MORATORIUM ON MEDICAL MARIJUANA
DISPENSARIES.
WHEREAS, the Yelm City Council adopted Ordinance 935 on March 22, 2011, without a
public hearing as a moratorium pursuant to Section 36.70A.390 RCW; and
WHEREAS, the Council scheduled a public hearing on the Ordinance within 60 days of its
adoption, on April 22, 2011; and
WHEREAS, notice of the public hearing was published in the Nisqually Valley News at
least ten days prior to the hearing on April 8, 2011; and
WHEREAS, the City Council heard testimony at the public hearing regarding the adoption
of Ordinance 935 establishing a moratorium on medical marijuana dispensaries; and
WHEREAS, the legislature of Washington State is still considering a bill that would
establish requirements and restrictions for medical marijuana dispensaries, and
WHEREAS, there is still considerable uncertainty as to the final outcome of the issue by
the Legislature; and
WHEREAS, the findings and conclusions contained in Ordinance 935 are hereby adopted
and incorporated into this resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm that the
moratorium established by Ordinance 935 remain in effect for a period of six months
from the date of its adoption on March 22, 2011.
