07-12-11 MinutesYELM CITY COUNCIL REGULAR MEETING TUESDAY, JULY 12, 2011 MINUTES Mayor Harding called the meeting to order at 6:05 p.m. 2. Roll Call. Present: Don Miller, Joe Baker, Bob Isom, Mike McGowan, Tracey Wood, John Thompson and Russ Hendrickson. 3. Agenda Approval 11-58 MOTION BY JOHN THOMPSON APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations -Margaret Clapp, Citizen of the Year. Mayor Harding, on behalf of the City, presented Margaret Clapp with a plaque in appreciation of all she does for the community, above and beyond and in honor of her Citizen of the Year designation. Margaret Clapp thanked the Mayor, Council and staff. 5. Public Comment. There was no comment from the audience in attendance. 6. Consent Agenda Minutes -Regular Meeting June 28, 2011 Payables -Checks #56162-56279, Totaling $376,489.14 11-59 MOTION BY JOE BAKER APPROVING THE CONSENT AGENDA AS PRESENTED. CARRIED. 7. Public Hearing -none scheduled 8. New Business a. Ordinance No. 9840 Standards for Public Defender, Yelm Municipal Court. Maryam Olson, Court Administrator, presented the staff report with the proposed Ordinance and Standards for Public Defense in the City of Yelm Municipal Court based on the standards set by the WA Supreme Court to improve quality of public defense. The 5 standards were reviewed: Qualifications of Counsel, Compensation, Duties and Responsibilities of Counsel, Training and Caseload Reporting of Counsel and Limitation of Practice. Qualification requirements are defined including: familiarity with court rules, court law statute, consequences of conviction, mental health issues and issues related to defendant as well as good standing with the Bar. Yelm Municipal Court now provides a public defender at preliminary hearings. Adoption of the standards benefit the City allowing eligibility for application of state grant funds to offset added costs of Attorney and Prosecutor present and available at arraignment calendar. Council had questions about the selection of Counsel and the estimated yearly cost. 11-60 MOTION BY MIKE MCGOWAN ADOPTING STANDARDS FOR PUBLIC DEFENSE IN THE CITY OF YELM MUNICIPAL COURT. CARRIED. Ordinance No. 938 Budget Amendment 2010, Neighborhood Stabilization Plan Janine Schnepf presented the staff report for three ordinances relating to budget amendments to account for the Neighborhood Stabilization Plan grant funding. The Washington State Department of Community, Trade and Economic Development (CTED) and the U.S. Department of Housing and Urban Development (HUD) entered into an agreement with the City of Yelm to facilitate the use of federal grant funding to assist eligible buyers with down payment loans on foreclosed properties. Under the terms of the grant, many potential buyers qualified for the funding option, but were unable to qualify for the financing to purchase. The program was revised in 2010, authorizing the City of Yelm to purchase three homes to be managed by anon-profit agency. A budget amendment was not completed at the close of the 2010 year for that change. With the approval of the 2010 budget amendment, a second amendment is required for the remaining balance of $22,611.27 carried over to the start of 2011. Additionally, now as owners of the vacant properties, the City of Yelm will maintain the utilities on the three homes until the management is turned over the non-profit agency on execution of the contract details. 11-61 MOTION BY MIKE MCGOWAN AMENDING THE 2009/2010 CITY OF YELM BUDGET BY ADJUSTING THE APPROPRIATIONS AND EXPENDITURES TO ACCOUNT FOR THE $640,505 NSP CTED GRANT FUNDING. CARRIED. 11-62 MOTION BY MIKE MCGOWAN AMENDING THE 2011 CITY OF YELM BUDGET BY ADJUSTING THE APPROPRIATIONS AND EXPENDITURES TO ACCOUNT FOR THE REMAINING $22,611.27 NSP, CTED GRANT FUNDING. CARRIED. 11-63 MOTION BY MIKE MCGOWAN AMENDING THE 2011 CITY OF YELM BUDGET BY TRANSFERRING $3,000 FROM CAPITAL RESERVE 197 559 90 67 00 FOR THE UTILITYAND MAINTENANCE OF THREE CITY OF YELM OWNED NEIGHB ORHOOD STABILIZATION PROGRAM HOMES. CARRIED 9. Old Business -none scheduled 10. Mayor and Council Initiatives Councilmember Miller attended Grand Opening for the Goodwill store in Yelm. Councilmember Baker announced that the final floor repairs will begin Monday at the Yelm Senior Center, after resolving the moisture problem. Councilmember Isom represented the City as Mayor Pro-Tem at the Grand Opening of the Yelm Goodwill store. Store opening created 35 new jobs in Yelm. Attended TRPC Retreat in Rainier and discussed future goals for the group. Councilmember McGowan attended HOME Consortium meeting, discussed staffing and re-organization. Preliminary information on foreclosure mediation, more to follow at a later date. Councilmember Wood attended TCOMM where they continue to discuss adding representation for South County; Tenino, Bucoda, Rainier . Page 2 of 3 11. EXECUTIVE SESSION -none scheduled 12. Correspondence included Port of Olympia Public Meeting Draft Airport Master Plan, July 7, 2011 and Thurston County Chamber of Commerce Voice July August 2011.
