Present: Don Miller, Joe Baker, Bob Isom, Mike McGowan, and Russ Hendrickson. Excused: Tracey Wood. John Thompson arrived at 6:03. 3. Agenda Approval 11-71 MOTION BY RUSS HENDRICKSON APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations -none scheduled 5. Public Comment. There was no comment from the audience in attendance. 6. Consent Agenda Minutes -Regular Meeting August 9, 2011 Payables -Checks #56466-56526 Totaling $1,291,941.01. 11-72 MOTION BY BOB ISOM APPROVING THE CONSENT AGENDA AS PRESENTED. CARRIED. 7. Public Hearing -none scheduled 8. New Business a. Resolution No. 527 Irrigation Program Amendment Gary Carlson stated the Council passed Resolution No. 522 restricting the use of water for irrigation pursuant to Section 13.04.97 Yelm Municipal Code and establishing policies and procedures for the implementation of water conservation measures in 2011. Council adopted a water conservation program in 2010 that established a water budget for each water customer with an irrigation meter. The budget was based on the amount of water, according to the Washington Irrigation Guide, needed to maintain healthy and productive landscaping, or the customers use in 2009, whichever is less. Resolution No. 527 would amend Resolution No. 522 and add two new developments, Our Redeemer Lutheran Church and Cullens Road Subdivision. 11-73 MOTION BY BOB ISOM ADOPTING RESOLUTION NO. 527 AMENDING THE 2011 IRRIGATION WATER BUDGET IN ORDER TO ADD WATER BUDGETS FOR TWO NEW DEVELOPMENTS. CARRIED. b. Ordinance No. 944 Library Bldg. Fund Creation Janine Schnepf explained that in 1993 Ordinance No. 478 was adopted establishing the Yelm Library Donation Fund as Fund No. 108, stating all monies received from public or private sources be deposited into this fund for improvement and expenditures related to the Yelm Library. In 1999, Ordinance No. 665 was adopted adding a Chapter to the Yelm Municipal Code (YMC) establishing the Yelm Library Advisory Board and defining their responsibilities and the deposition of any gifts of money. After review of the YMC related to the renewed interest in the purchase of space for the library, it was determined that Library Donation Fund No. 108 was closed for inactivity and reused for another fund. Ordinance No. 944 would establish the Yelm Library Building Fund as Fund No. 110 for the receipt and expenditure of donations for the Yelm Timberland Library. Page 1 of 3 11-74 MOTION BY JOE BAKER ADOPTING ORDINANCE NO. 944 AMENDING ORDINANCE NO. 478 (9/93), ESTABLISHING A YELM LIBRARY BUILDING FUND FOR REVENUE AND EXPENDITURE OF DONATIONS. CARRIED. 1 ABSTAIN (MCGOWAN). c. Septage Hauling Contract Award for Collecting 8~ Hauling Septage Tim Peterson stated the City is required to contract with a hauling company to provide the necessary services for the City's step collection system and reclaimed water system. On July 22, and July 29, staff put out a call for bids for these services. It closed on August 5, 2011 and four sealed bids were accepted. The low bidder was Drain-Pro Inc. out of Puyallup, Washington. Bids are structured on a per gallon basis; Drain-Pro's bid was .24 per gallon for septage and .10 per gallon for waste activated sludge. The amount expended in 2010 for collecting and hauling sludge was $42,949.57. Drain-Pro's per gallon price times the estimated sludge to be hauled for the remainder of 2011, falls within the 2011 budget for this service. 11-75 MOTION BY BOB ISOM AUTHORIZING MAYOR HARDING TO SIGN A TWO YEAR CONTRACT WITH DRAIN-PRO, INC. FROM PUYALLUP, WASHINGTON, FOR THE COLLECTION AND HAULING OF THE CITY'S SEPTAGE AND WASTE ACTIVATED SLUDGE. CARRIED. d. Catch Basin Contract Tim Peterson explained that the City is required to contract with a hauling company to provide the necessary services for the maintenance of the City's catch basins. On July 22, and 29th, 2011 put out a call for bids for these services. Drain-Pro Inc. was the lowest bidder out of three bids accepted. Drain-Pro's bid for $170.00 per hour, $70.00 per ton for the collection and disposal of catch basin waste. This is a budgeted service paid from the storm water utility. 11-76 MOTION BY BOB ISOM AUTHORIZING MAYOR HARDING TO SIGN A TWO YEAR CONTRACT WITH DRAIN-PRO, INC. OF PUYALLUP, WASHINGTON FOR THE COLLECTION AND DISPOSING OF THE CITY'S CATCH BASIN WASTE FOR UP TO $20,000 PER YEAR. CARRIED. e. Hawthorn Tree Removal Gary Carlson stated the removal of Hawthorn street trees requires approval of the Yelm City Council, pursuant to Section 14.16.070 Yelm Municipal Code (YMC). Two Hawthorn trees located on Yelm Avenue West along the Sidewalk Improvement Project have been identified by the City of Yelm's contract arborist, Kevin McFarland as in very poor condition and hazardous. His recommendation is removal of these two trees. In addition, Mr. McFarland also recommends that care be taken to minimize any damage to the surface roots during the removal of the existing sidewalk and root pruning may be necessary. He would also like to be present when the excavation takes place immediately adjacent to the trees. There may be additional trees that may become a hazard or in poor health due to the construction project. We are seeking permission based on our consultant's evaluation to remove these trees. The trees removed would be replaced with Paul's Scarlet Hawthorns. 11-77 MOTION BY JOE BAKER APPROVING THE REMOVAL OF TWO OR MORE HAWTHORN TREES FOR THE YELM AVENUE WEST SIDEWALK IMPROVEMENT PROJECT. CARRIED. 9. Old Business -none scheduled Page 2 of 3 10. Mayor and Council Initiatives Councilmember Isom attended the Yelm Finance Committee meeting. Councilmember McGowan attended the Yelm Finance Committee meeting. Councilmember Thompson attended the Yelm Finance Committee and everything is on track and looks good. Mr. Thompson also attended a Library meeting. Councilmember Hendrickson attended a Medic One meeting where they are working on their budget. Mayor Harding attended a few committee meetings in town but has nothing to report. 11. EXECUTIVE SESSION -none scheduled 12.
