If sewer or water desired, include map showing location of nearest lines. (attached as Exhibit III) 11. When is extension of water and sewer service planned to the area: A water main and sewer main is installed along the frontage of several of the proposed parcels to be annexed: 12. Does this proposal affect any other interjurisdictional agreements? Yes^NoH If yes, please list these agreements: N/A 13.. Does this proposal conform to adopted county-wide planning policies on annexation? The City of Yelm's Urban Growth Boundary (UGA) is established and discussed in the City of Yelm Comprehensive Plan and Joint Plan with Thurston County.. The parcels included in this annexation petition are within the UGA. It is located within the City's Water and Sewer service areas. 14. Other specific Reason(s) for Annexation: The proposed annexation includes older residential developments that pre- date the adoption of the Growth Management Act and include lots that meet standards for `urban' densities. In order to allow infill development at urban densities, annexation is required. Also, the proposed annexation reduces the surface to area ratio of the City limits boundary and is a more logical boundary for the City. 15. Explain how this proposal furthers the objectives of the Boundary Review Board (as applicable) (RCW 36.93.180) [attach additional pages if necessary] (Some of these items may not apply because of Growth Management Agreements.): a. Preservation of natural neighborhoods and communities: The annexation area consists mostly of developed parcels at urban densities with some larger parcels that can not be redeveloped at urban densities without annexation. The City currently provides water service within the proposed annexation area. b. Use of physical boundaries, including but not limited to bodies of water, NOTICE OF INTENTION 2 THURSTON COUNTY BOUNDARY REVIEW BOARD highways, and land contours: .~ ,,:., The proposed annexation area follows property lines, and Yelm Creek. It also is more logical than the existing City limit line which runs down the middle of Coates Road, a boundary which would no longer be allowed under the rules for annexation. c. Creation and preservation of logical service areas: Streets and water are already in existence in the annexation area. The land is included in the City of Yelm Water and Sewer Service Areas. ' d. Prevention of abnormally irregular boundaries: The annexation area follows existing streets, a creek, and property lines and fills in an existing corner of the city. e. Discouragement of multiple incorporations of small cities and encouragement of incorporation of cities in excess of ten thousand population in heavily populated urban areas: The annexation area lies in the urban growth boundary as established in the City of Yelm Comprehensive Plan, Joint Plan with Thurston County. Dissolution of inactive special purpose districts: There are no special purpose districts in the proposed annexation area. g. Adjustment of impractical boundaries: The annexation area extends the city limits within a practical boundary. h. Incorporation as cities or towns or annexation to cities or towns of unincorporated areas which are urban in character: The annexation area is zoned Rural Residential 1/5, and is surrounded by land within the City limits that is already developed at urban residential densities. Protection of agricultural lands: The annexation area land has not been in active agricultural use. NOTICE OF INTENTION 3 THURSTON COUNTY BOUNDARY REVIEW BOARD For your information, the Boundary Review Board can consider the following factors (RCW 36.93.170) in deciding whether a particular decision furthers the objectives stated above: 1. Population and territory 2. Population density 3. -Land area and land use 4. Comprehensive use plans and zoning 5. Per capita assessed valuation 6. Topography, natural boundaries and drainage basins, proximity to other populated areas 7. The existence of prime agricultural soils and agricultural uses 8. Exhibit C -Coates Road Annexation YELM CITY COUNCIL MEETING MINUTES REGULAR MEETING WEDNESDAY,- MARCH 10, 2004 1. Call to Order. Mayor Rivas called the meeting to order at 7:30 p.m. 2. Roll Call. Present: Joe Baker, Bob Isom, Ron Harding and Pat Fetterly. Excused: Don Miller 3. Agenda Approval 04 -18 MOTIONBYBOB ISOM, SECONDED BYPAT FETTERLY APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations -Chris Maun, Green Congress. Council viewed a short video addressing Green Congress's programs which are intended to educate students about ecosystems. Two hundred Yelm students attended Green Congress workshops last year. Mr. Maun distributed handouts and thanked Yelm for continued support of the program. Mayor Rivas and Council thanked Mr. Maun for his presentation. 5. Public Comment -There was no response to the call for comments. 6. Consent Agenda a. Mayor Rivas opened public hearing at 7:54 p.m. announcing the date, place, time and purpose of the hearing. No objections to participants were stated. .. .. Cindy.Cecil, Yelm Community Services Director, thanked city officials and staff for agreeing to act as lead agency for the grants that supported projects including the initial YCS building, shelter, facility expansion, . Krislen Apartments and the Youth/Child Care Centers. YCS has received a temporary occupancy permit and should have the permanent permit soon. Ms. Cecil is anxious to showcase the new facility and welcomes city/community meetings. They will also be renting space for other meetings/events. Ms. Cecil also addressed future goals that include adding space for a SPSCC satellite and additional Head Start space. Mayor Rivas thanked Ms. Cecil for her dedication in providing services to the.community. Mayor Rivas closed the public hearing at 8:08 p.m. b. Yelm Community Services Project Completion Acceptance. 04 - 20 MOTION BY BOB ISOM, SECONDED BY RON HARDING - ACCEPTING THE YELM COMMUNITY SERVICES YOUTH ACTIVITIES/CHILD CARE CENTER AS COMPLETE. CARRIED. Council consensus supported moi~ing Old Business ahead of Ne-v Business to accommodate the majority of people attending the meeting. 9. Old Business a. Final Plat Application, Willows Glen Subdivision Phase II, SUB-04- 0012-YL. Tami Merriman, Yelm Assistant Planner, provided an overview of the staff report including existing and new conditions. Ms. Merriman reported that the landscaping plan has been approved, but deferred to wait for better weather and to allow access to the rear of the northern lots for construction. Also deferred to warmer months is a road repair. An assigned savings account for deferred items has been provided. Exhibit C -Coates Road Annexation Scott Rood and Jim Norton, Willow Glen Homeowners Association, addressed Council with concerns about the Homeowners Association for the new area, maintenance work provided with Association fees, lack of accountability for how those funds were spent,~and the speed and amount of construction traffic that will pass thru the existing development during Phase II construction. ' Speed limit clarification was provided and it was noted that the maximum City speed limit is 25 mph unless posted otherwise. Council recommended that homeowners contact Yelm PD if there is a problem with excessive speed. The City's speed display unit can be set up in the area to create an awareness of driving speeds. Denny Balascio, Yelm Property Development, indicated that the sub-contractors work for him and problems can also be reported to him for follow-up. Council discussion determined that issues between the Homeowners Association and developer are private and cannot be addressed by the City. 04 - 21 MOTION BY BOB ISOM, SECONDED BY PAT FETTERL Y APPROVING THE WILLOW GLEN SUBDIVISION, PHASE II, SUB-04-0012-YL WITH THE TWO CONDITIONS IDENTIFIED IN THE STAFF REPORT AND RECORDING DELAYED UNTIL FINAL CCR APPROVAL. BY THE CITY. CARRIED. b. Park Use Request (from Consent Agenda) -Cochrane Memorial Park. Council expressed concern about a request to use the park for a wedding with 200 people attending. Areas of concern include lack of parking, the number of expected guests, restroom facilities, and the length of the request. Council requested that staff do some additional follow-up with the applicant. New Business a. Approval to Circulate Petition for Annexation: Area North of Coates Road - Robert & Forrest Roberts. Grant Beck, Community Development Director, provided information about the court decision overturning annexation methods and the reversal of that decision. Currently, rivo petition options are available; the original requiring majority signatures based upon valuation or the alternate method requiring majority signatures based upon property size and registered voters. Road. Property size is approximately 15 %Z acres with 2~ parcels, some of which have been developed. The property is currently zoned RR/~; annexation would allow a change to allow 4 units per acre. The area falls within the water service area. Council discussion concerned lack of identification of the method to be used and the possibility oflan applicant using both methods if one failed. .- "' - " '- Consideration was given to requiring the identification and having the applicant return to the next meeting for a final decision. 04 - 22 MOTIONBYBOBi ISOM, SECONDED BYPAT FETTERLY ACCEPTING THE ROBERT AND FORREST ROBERTS REQUEST TO CIRCULATE A PETITION FOR ANNEXATION USING EITHER METHOD. CARRIED. b, Approval to Circulate Petition for Annexation: Area Between Bald Hills Rd and Yelm Avenue W. -David Phill. Grant Beck provided an overview of his staff report. The 61 acre property contains 12 parcels; located south of Yelm Ave West (SR X07), north of Bald Hills Road and west of 5 corners. Property in this area is subject to a water extension latecomers agreement. The property is currently zoned Arterial Commercial. Future zoning would be C-2 or heavy commercial. 04 - 23 MOTION BY RON HARDING, SECONDED BY PAT FETTERL Y ACCEPTING THE DAVID PHILL REQUEST TO CIRCULATE A PETITION FOR ANNEXATION USINC EITHER METHOD. CARRIED. 10. Mayor and Council Reports and Initiatives and Board/Commission Business Councilmember Baker attended a SWAC meeting where discussion concerned increasing rates as a way of encouraging recycling. Councilmember Isom attended TRPC meetings. Meeting discussion concerned Vision vs. Reality, the possibility of the Thurston County PUD (formed in 1939) joining TRPC, commercial development along Y/2-Y/3 and rail line frontage.. Councilmember Harding also attended TRPC (TPB) meetings and acknowledged staffs awareness of south county needs and consideration of Pierce Co. impacts on the area. Councilmember Fetterly attended the Yelm Fire District Public Meeting and found it to be informative and positive. A community.task force is forming to work on securing community support for locating a NASCAR raceway in Yelm. Staffprovided an initial remodel plan for City Council Chambers. The plan includes redirecting and expanding a new council bench to accommodate a seven member council.
