947 Change Order PolicyCITY OF YELM ORDINANCE NO. 947 AN ORDINANCE OF THE CITY OF YELM AUTHORIZING THE APPROVAL OF CHANGE ORDERS FOR CONSTRUCTION CONTRACTS UNDER CERTAIN CIRCUMSTANCES, AND ESTABLISHING A PROCEDURE FOR REVIEW. WHEREAS, change orders, which are revisions to a construction contract, are an integral part of construction contracts that are administered by the Executive and Public Works Departments; and WHEREAS, decisions on change orders must often be made immediately to allow the contractor to continue with the work with a minimum of administrative delay; and WHEREAS, the City of Yelm desires to establish a formal policy and procedure which would allow the City Administrator and the Mayor to approve change orders under certain circumstances; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1: The City Administrator and the Mayor are hereby authorized and directed to approve and sign construction contract change orders on construction contracts under the following conditions: 1. If the change order does not substantially change the scope of the project; and; 2. If the total increase or decrease in the contract amount, as a result of the change order, does not exceed 10% for contracts $250,000 and less; and; 3. If the total contract amount as adjusted by the change order is within the amount budgeted for the project. Section 2: Prior to any authorization of additional work or commitment of funds, the Department leading the construction contract shall present the City Administrator and Mayor with the change order details for their consideration according to the conditions stated in Section 1. Section 3: Where the City Administrator and Mayor approve and sign change orders according to the conditions stated in Section 1, they shall forward the change order to the Council and the requesting department for its information within thirty (30) days of the signing of the change order.
