Pursuant to a telephone conference conducted at 10:00 a.m., Tuesday, January 24, 2012, attended by Grant Beck, City of Yelm Community Development Director; Joseph A. Rehberger, attorney
for appellants; and Brent Dille, Yelm City Attorney, the Examiner determined as follows:
On or before the close of business February 7, 2012, Mr. Rehberger will submit a dispositive motion and brief to the Examiner with a copy to Mr. Beck and Mr. Dille. Mr. Rehberger may
submit the motion and brief by email, but shall also mail a hard copy.
Mr. Rehberger shall submit a list of potential witnesses, contact information, and summary of testimony to Mr. Dille and Mr. Beck by the close of business February 7, 2012.
Mr. Dille shall submit a responding brief to the motion on or before close of business February 15, 2012, with copy to Mr. Rehberger.
Arguments on the motion will occur telephonically at 10:00 a.m., Tuesday, February 21, 2012. The City will arrange the conference call.
Should the Examiner deny the dispositive motion, the hearing will commence on Tuesday, March 8, 2012, in the City Council Chambers at the City of Yelm. Mr. Rehberger and Mr. Dille may
submit prehearing briefs two to three days in advance of the hearing at their option. The Examiner will decide whether post hearing briefs are appropriate at the conclusion of the hearing.
The order of presentation shall be as follows:
Presentation of the City Staff Report and testimony regarding the Notice of Violation by City staff (the City has advised that it will call Gary Carlson as its only witness).
Presentation by the appellants.
Response by the City.
Closing comments by appellants.
Closing arguments (optional) in the same order. Closing arguments may be presented in writing as part of a post hearing brief.
