referenced project was received by the City of Yelm on November 28, 2007. The City has determined the application to be complete on January 30, 2008. The application and any related

Department at 360-458-3835. PROJECT DESCRIPTION: Construction of a 164 unit apartment complex with approximately 55,000 square feet of commercial development. ENVIRONMENTAL and OTHER
DOCUMENTS SUBMITTED WITH THE APPLICATION: A Site Plan, Design Guidelines Checklist, Environmental Checklist, Landscape Plan, Shoreline Exhibit, Stormwater Plan, Geotechnical Report and
Wetland Delineation were submitted with the application. Additional Information or Project Studies Requested by the City: None at this time. No preliminary determination of consistency
with City development regulations has been made. At minimum, this project will be subject to the following plans and regulations: City of Yelm Comprehensive Plan, Zoning Title 17 YMC,
Critical Areas Ordinance Chapter 14.08 YMC, Storm Water Drainage Design and Erosion Control Manual (DOE), International Building Code, State Environmental Policy Act (SEPA) Title (14),
Road Design Standards, Platting and Subdivision Title (16), and the Shoreline Master Program. The City of Yelm invites your comments early in the review of this proposal. Comments should
be directed to Nisha Box, Community Development Department, P.O. Box 479, Yelm WA 98597, 360-458-3835. THE 15-DAY PUBLIC COMMENT PERIOD ENDS AT 5:00 PM ON FEBRUARY 15, 2008 This notice
has been provided to appropriate local and state agencies, and property owners within 300 feet of the project site. These recipients will also receive the following items when available
or if applicable: Environmental Threshold Determination, Notice of Public Hearing and Notice of Final Decision. If the proposed project requires a City Council decision, it will be mailed
to all those who participate in the public hearing and to anyone else requesting the decision in writing. Additionally, there will be a 14-day public comment period if an environmental
determination is issued. Opportunities for appeal occur within twenty one (21) days after the date the environmental determination is issued. City Council decision can be appealed through
Superior Court. Appeals of site plan review decisions may be filed within 14 days of Notice of Final Decision.

Creek Road Mixed Use To Whom It May Concern: On March 4, 2008, the Community Development Department issued a Mitigated Determination of Non-Significance (MDNS) for the Creek Road Mixed
Use project. During the process of our environmental review, it was noted that the proposed stormwater facilities specifically may not meet the requirements of the City of Yelm Critical
Areas Code. Section 14.08.120 YMC requires that the bottom of any infiltration facility for stormwater discharge shall be located at least 6 feet above the base flood elevation. A Hydrogeological
report assessing the groundwater elevations relative to high ground water flood hazard areas and the bottom of the infiltration galleries will be required prior to receiving Site Plan
Review Approval for this project. Revisions made to the site plan to meet the requirements for separation between groundwater and infiltration galleries may cause a significant change
to the site layout. The Site Plan Review Approval and the Shoreline Permit can be scheduled for the April 21, 2008 meeting of the Hearing Examiner if the above item has been addressed

above referenced project. The application submittal is not complete and further information is required before we can begin the review process. 1. The 300 foot radius labels that were
submitted seem to be somewhat unclear. The 300 foot radius should be based on all the parcels involved together, not individually. It appears that there were separate labels submitted
for each parcel involved. One set of labels with a corresponding 300 foot radius map is required showing all the property owners no further than 300 feet from all sides of the parcels
that are involved in the project. 2. Please submit a $500.00 scoping fee for the TIA review. 3. The shoreline designation of the site is Rural. Although development is allowed within
the shoreline jurisdictional area through a Shoreline Permit, residential densities in this environment shall not exceed two dwellings per acre, regardless of housing type. It appears
that buildings 5 and 6 fall within the 200 foot shoreline designation area. Please provide a calculation of the approximate acreage within the 200 foot shoreline jurisdictional area
and the number of units within buildings 5 and 6. 4. Please illustrate the 100 year floodplain boundaries based on the FEMA floodplain map on the preliminary site plan. 5. Please provide
