342 Business LicensingORDINANCE NO. 342
AN ORDINANCE providing for the licensing and regulation of
business activities within the Town of Yel.m, and amending the rates
applicable to the licensing thereof and the credits applicable there-
to; amending provisions of Ordinance No. 234 (1979) and Chapter 5.04,
Yelm Municipal Code; and adding a new section to Chapter 5.04 YMC;
repealing -Sec. 15, Ord. 234 (1979) and 5.04.140 YMC; and declaring an
effective date.
BE IT ORDAINED AND ESTABLISHED BY THE COUNCIL OF THE TOWN OF YILM,
THURSTON COUNTY, STATE OF WASHINGTON, as follows:
Section 1. NEW SECTION. A new section shall be added to Chapter
5.04, YMC, to be codified as YMC 5.04.015, and to read as follows:
5.04.015. License fees.
A. Initial. The business licensing fee for any
business or activity required to be licensed shall be thirty dollars
($30.00) for the first year of operation, or fraction thereof, or for
the first year or fraction thereof under a new business licon -se, whether
issued for a new business or after a change in business activity requiring
rel i censing .
B. Renewals. abe business licensing renewal fee
for any business or activity required to be licensed shall be ten dollars
($10.00) for the second year of such business' activity, or fraction there-
of, and a like amount for each subsequent year or fraction thereof during
the continued operation of such business.
Section 2. Section-3, Ord. 234 (1979) and YMC 5.04.010 are each
amended to read as follows:
5.04.010. License required. On and after the effective date of
this chapter,_ as a.mended,'no person, whether or not subject to the payment
of a tax as provided in this chapter, shall engage in any business activity
within the town without having first obtained and being the holder of a
valid and subsisting business license to do so, issued under the provisions
of this chanter. The business license shall be issued for any lawful bus-
iness on application therefor and payment of the annual license fee (( of
five dollars)). The business license issued pursuant to the previsions
of this chapter shall be valid so long as the person to whom the same is
issued continues in business and pays the annual license fee ((of five
dollars)) on or before the first of February of each year, and any tax due
pursuant to the provisions of this chapter. Applications for the license
.shall be made to and on forms rrovided by the town clerk.
Section 3. Section 16, Ord. 234 (1979) and yMC 5.04.140 are hereby
repealed, each in its entirety.
Section 4. Effect' Date. This Ordinance shall be effective on and
after the 1 ± day of , 1988
Section 5. Severability. Should any section, paragraph, sentence,
clause, or phrase of this Ordinance, or its application to any person or
circumstance be declared unconstitutional or otherwise declared or adjudged
invalid for any reason, such decision shall not be construed to affect the
validity of the remaining portions of this Ordinance or its application to
other persons or circumstances.
