ORDINANCE NO. 336
AN ORDINANCE providing for the annexation of cer-
tain contiguous property to the Town of Yelm,
Washington; and declaring an effective date.
WHEREAS, pursuant to the method of annexation provided
for in RCW 35.13.125 through RCW 35.13.170, inclusive, the
Town Council and the Mayor of the Town of Yelm have deter-
mined it appropriate to annex to and as a portion of the
Town of Yelm certain real property, more particularly
described hereinafter, which property is contiguous to a
boundary of the Town of Yelm; and
WHEREAS, the owners of the said real property within
the proposed annexation area have all petitioned therefor;
and
WHEREAS, the Thurston County Boundary Review Board
has declined to assert or invoke jurisdiction over the said
property or its annexation; and
WHEREAS, pursuant to the State Environmental Policy Act
(SEPA), the nonsignificance of the proposed annexation for
environmental purposes has been determined and published;
and
WHEREAS, a public hearing has been conducted by the
Town Council of the Town of Yelm for the hearing of public
comment upon such proposed annexation;
NOW, THEREFORE,
BE IT ORDAINED AND ESTABLISHED BY THE TOWN COUNCIL OF THE
TOWN OF YELM, THURSTON COUNTY, STATE OF WASHINGTON, as follows:
Section 1. The following described real property, situ-
ate in Thurston County, State of Washington, to -wit:
LOT 18 of Block 36 of the Plat of McKenna
Irrigated Tracts, as recorded in Volume 9 of
Plats, pages 43 and 44, records of Thurston County,
Washington;
AND ALSO that portion of 103rd Street SE abut-
ting said Lot 18 on the South and lying between a
line extending Southerly, at right angles to said
road, from the Southeast corner of Lot 1 of Block
37 of said Plat of McKenna Irrigated Tracts, and a
line extending Southerly at right angles to said
road, from the Southeast corner of said lot 18:
ALL IN Thurston County, State of Washington.
being contiguous to the Town of Yelm, Washington, and not
being a wart of any incorporated city or town of the State of
Washington, should be and the same hereby is annexed to the
Town of Yelm.

Section 2. The real property described in Section 1
of this Ordinance shall be and become a part of the Town
of Yelm as provided herein on the effective date of this
Ordinance, and shall be subject to all laws and ordinances
of the Town of Yelm now or hereafter in force and effect,
and shall be subject to the existing indebtedness of the
Town of Yelm and assessed and taxed at the same rat and on
the same basis as other real property within the corporate
limits of the Town of Yelm is assessed and taxed.
Section 3. Notwithstanding the provisions of Section
2 of this Ordinance, any portion of the annexed real prop-
erty which is used as a public roadway or right -of -way
shall, for the period such use continues only, be and the
same hereby is exempted from such taxes and assessments by
or under the authority of the Town of Yelm, and from sub-
jection to the indebtednesses of the Town of Yelm.
Section 4: This Ordinance shall be and become effec-
tive on and after the 9th day of June , 1987.
Section 5. The Clerk of the Town of Yelm should be
and he hereby is directed to record a copy of this Ordinance
in the Office of the Auditor of Thurston County, Washington,
and to file a certified copy thereof with the Board of Coun-
ty Commissioners of Thurston County, Washington.
