ORDINANCE NO. 335
AN ORDINANCE providing for the annexation of cer-
tain contiguous property to the Town of Yelm, Wash-
ington; and declaring an effective date.
WHEREAS, pursuant to the petition method of annexation
provided for in RCW 35.13.125 through RCW 35.13.170, inclu-
sive, the Town Council and the Mayor of the Town of Yelm
have determined it appropriate to annex to and as a portion
of the Town of Yelm certain real property, more particularly
described hereinafter, which property is contiguous to a
boundary of the Town of Yel-m; and
WHEREAS, the owners of at least seventy -five percent
(75/) of the assessed value of the real property within such
proposed annexation area have petitioned for or consented to
such proposed annexation; and
WHEREAS, the Thurston County Boundary Review Board has
declined to assert or invoke jurisdiction over the said real
property or its annexation; and
WHEREAS, pursuant to the State Environmental Policy Act
(SEPA), the nonsignificance of the proposed annexation, for
environmental purposes, has been determined and notice there-
of published; and
WHEREAS, a public hearing has been conducted by the Town
Council of the Town of Yelm for the hearing of public comment
upon such proposed annexation;
NOW, THEREFORE,
BE IT ORDAINED AND ESTABLISHED BY THE TOWN COUNCIL OF THE
TOWN OF YELM, THURSTON COUNTY, STATE OF WASHINGTON, as follows:
Section 1. The following described real property, situ-
ate in Thurston County, State of Washington, to -wit:
Beginning at a point.10.00 feet North of the quarter corner common
to Sections 19 and 30, Township 17 North, Range 2 East, W.M.;
Thence East, to the Easterly line of Clark Road, and the TRUE POINT
OF BEGINNING; Thence continuing East, to a point 64.70 feet East
and 10.00 feet North of said quarter corner; Thence South 101.00
feet; Thence East 77.80 feet; Thence South, to a point which is
220.00 feet South and 142.50 feet East of said quarter corner;
Thence East, 47.50 feet; Thence South, 100.00 feet; Thence East
110.00 feet to a point 320.00 feet South and 300.00 feet East of
said quarter corner;,Thence South, to the South line of the North-
west quarter of the Northwest quarter of the Northeast quarter of
said Section 30; Thence East, along said South line of the North-
west quarter of the Northwest quarter of the Northeast quarter of
Section 30, to the West line of the Southeast quarter of the
Northwest quarter of the Northeast quarter of said Section 30;

Thence, South along said West line of the Southeast quarter of
the Northwest quarter of the Northeeast quarter of Section 30, to
the Southwest corner of said Southeast quarter of the Northwest
quarter of the Northeast quarter of said Section 30; Thence East,
along the South line of the Southeast quarter of the Northwest
quarter of the Northeast quarter, of said Section 30, to a point
330.00 feet West of the Southeast corner of the Northwest quarter
of the Northeast quarter of said Section 30; Thence North, parallel
with the East line of said Northwest quarter of the Northeast
quarter of Section 30, to the Northline of the South 295.50 feet
thereof; Thence, East, along said North line of the South 295.50
feet, to the Westerly line of Vancil Road; Thence North, along
said Westerly line of Vancil Road, to the Southwesterly line of
S.R. 507; thence Northwesterly, along said Southwesterly line of
S.R. 507, to the Easterly line of Clark Road; Thence South, along
said Easterly .line of Clark Road, to the TRUE POINT OF BEGINNING;
TOGETHER WITH all of that portion of Clark Road abutting on the
West and lying between said quarter corner common to Sections 19
and 30, Township 17 North, Range 2 East, W.M., and the Southwesterly
line of S.R. 507;
ALL IN Thurston County, State of Washington.
being contiguous to the Town of Yelm, Washington, and not
being a part of any incorporated city or town of the State
of Washington, should be and the same hereby is annexed to
the Town of Yelm.
Section 2. The real property described in Section 1 of
this Ordinance shall be and become part of the Town of Yelm,
as provided herein, on the effective date of this Ordinance,
and shall be subject to all laws and ordinances of the Town
of Yelm now or hereafter in force and effect, and shall be
subject to the existing indebtedness of the Town of Yelm and
assessed and taxed at the same rate and on the same basis as
other real property within the corporate limits of the Town
of Yelm is assessed and taxed.
Section 3. Notwithstanding any provision of the Ordin-
ance to the contrary, any portion of the annexed real prop-
erty which is used as a public roadway or right -of -way shall,
for the period such use continues only, be and the same
hereby is exempted from such taxes and assessments by or
under the authority of the Town of Yelm, and from subjec-
tion to the indebtednesses of the Town of Yelm.
Section 4. This Ordinance shall be and become effec-
tive on and after the 9th day of June 1987.
Section 5. The Clerk of the Town of Yelm should be
and hereby is directed to record a copy of this Ordinance
in the Office of,the Auditor of Thurston County, Washington,
and to file a certified copy thereof with the Board of Coun-
ty Commissioners of Thurston County, Washington.
