ORDINANCE N0. 319
AN ORDINANCE providing for a change in
the zoning classification of certain real
property within the Town of Yelm.
WHEREAS, heretofore the owners of the property de-
scribed hereinbelow filed a petition with the Yelm Town
Council requesting that the zoning classification of the
said described property be changed from Potential Commercial
Zone to Commercial Service Zone; and
WHEREAS, the Town Council elected to consider said
zoning petition and to hold a public hearing thereon;
and
WHEREAS, notice of a public hearing on the said rezone
petition, which invited all interested parties to appear and
voice their concerns and opinions respecting the same, was
published and posted in the form and manner required by
law and a hearing was regularly held at the time and place
fixed in said notice, and all interested parties were given
proper opportunity to be heard with respect thereto;
and
WHEREAS, the Town Council has determined it would be
in the best interests of the Town of Yelm and the citizens
thereof to change the zoning classification of said de-
scribed real property, NOW, THEREFORE,
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF YELM,
THURSTON COUNTY, WASHINGTON, as follows:
Section 1. That the following described real property
situate in T urston County, State of Washington, to -wit:
The East 681.78 feet of that part of the
Northeast quarter of the Northeast quarter of
Section 30, Township 17 North, Range 2 East,
W.M., lying North of a line running West from
a point on the East line of said Section 30,
1,237.02 feet South of its Northeast corner,
less the North 338.7 feet of the West 561.78
feet thereof; and -less the Old Yelm- McKenna
Road and Creek Road,
AND.
That portion of the Northeast quarter of
Section 30, Township 17 North, Range 2 East,
W.M., described as follows: Beginning
at a point on the South right -of -way line of
county road known as Old Yelm-McKenna Road
681.78 feet West of its intersection of the
East line of said Northeast quarter; thence
West along said right -of -way line 60 feet;
thence South 0 "54'03" West 1,076.02 feet to
the PC of a curve to the right having a
radius of 120 feet; thence Southerly along
said curve 79.23 feet to the PT of said
curve; thence South 38 "43'46" West 16.28 feet
to the Northerly right -of -way line of Second-
ary State Highway 5 -1; thence South 51"16'14"
East along said right -of -way line to a point
681.78 feet West of the East line of said
Northeast quarter and South 0"54'03" West
from the point of beginning; thence North
0"54'03" East to the point of beginning,
AND,
That part of the East half of the Northeast
quarter of Section 30, Township 17 North,
Range 2 East, W.M., described as follows:
Beginning at a point 75.22 feet West of a
point on the East line of said Section 30,
1,237.02 feet South of its Northeast corner;
running thence West 606.56 feet to the
true point of beginning; thence South 44.5
feet, more or less, to the Northerly line of
Secondary State Highway No. 5 -11; thence
Southeasterly along said Northerly line of
highway 132 feet; thence North 38"0'30" East
86 feet; thence Southeasterly parallel with
the North line of said Secondary State
Highway No. 5 -H, 85 feet; thence North
38 0'30' East 113.5 feet, more or less, to a
point 290 feet East of the 'true point of
beginning; thence West 290 feet to the true-
point of beginning.
be, and the same is hereby zoned Commercial Service Zone
pursuant to Chapter 17.24 of the Yelm Municipal Code.
Section 2. The Clerk of the Town of Yelm, be, and
he is ere y irected to cause the new zoning classification
for the property described hereinabove to be indicated on
the official zoning map for the Town of Yelm.
