ORDINANCE NO. 748
AN ORDINANCE repealing, replacing and amending certain ordinances and sections of
Chapter 13.04 of the Yelm Municipal Code related to monthly service rates and
equivalent residential unit fee (hook -up) fees for water customers;
WHEREAS, the Water Department is required by statute to be self - supporting; and
WHEREAS, it is necessary to periodically review and adjust charges necessary to
provide, maintain and improve the municipal water system; and
WHEREAS, a duly advertised public hearing has been held to consider this increase;
NOW THEREFORE, the City Council of the City of Yelm do ordain as follows:
Section 1. Repealer. The following monthly water rate chart from Ordinance 593,
Section 1, and Municipal Code section 13.10.050 is hereby repealed:

Section 2. Effective date of monthly rate increase. The monthly water rate increase in
Section 1 shall take effect May 1, 2002.
Section 3. Repealer. The following Equivalent Residential Unit fee (Hook -Up Fee for
new connections) from Yelm Ordinance No. 645 (12/98), Section 1, Table 1 and Yelm
Municipal Code Section 13.04.120 (C) (2), Table 1 is hereby repealed:

Section 4. Effective date of Hook -Up Fee increase. The Equivalent Residential Unit
(Hook -Up Fee for new connections) from Section 3 shall take effect January 1, 2002.
Section 5. Ordinance 504 (4/94), Section 1, and Municipal Code 13.04.120 (A) is
amended to read as follows:
All persons connecting to the water system of the to c� shall pay, in advance
of connection to the water system, a hook -up and water charge in accordance with
the schedule set forth below in this section. A portion of the fee will be dedicated
to necessary capital improvements of the city water system and acquisition of
water rights. In every case, title to the water meter, meter box and service
connection lines shall be and remain with the town cam.
Section 6. Ordinance 553 (4/95), Section 2 (A) and Municipal Code 13.04.120 (C) (1) is
amended to read as follows:
E.R.U. measurement shall be an equivalent flow of
one thousand two kundr-
six*y three ,.ubie feet nine hundred (900) cubic feet, or less, per month, based on
water meter in -flow.
Section 7. Ordinance 553 (4/95), Section 2 (C) and Municipal Code 13.04.120 (C) (3) is
amended to read as follows:
With respect to uses other than residential, one E.R.U. shall be designated for
each one thattsand two hundred sixty thfee e bie feet nine hundred (900) cubic
feet, or less of water consumed per month.
Section 8. Ordinance 553 (4/95), Section 2 (D) and Municipal Code 13.04.120 (C) (4) is
amended to read as follows:
Ordinance 540 (1995 budget) is amended to create a "Water Capital Improvement
Fund" where collected ERU water fees will be placed to be utilized for
emergency repairs, capital improvement projects and acquisition of water rights.
Section 9. Ordinance 337 (1987) and Municipal Code 13.04.230 is amended to read as
follows:
Should the owner or occupant of any premises turn on the water or suffer or cause
the same to be turned on after it has been shut off at the curb cock by the
superintendent water department, water service may again be turned off the
sup water department and a charge of *wen4., five dollars sixty $60
dollars shall be made for restoring turn -off. For restoration service after a
delinquent bill turn-off, a fee of fifteen delta twenty ($20) dollars shall be
assessed before restoration of service can be made.
Section 10. Effective Date. This ordinance will take effect five days after the date of its
publication.
Section 11. Saving Clause. Ordinances repealed and amended by this ordinance, shall
remain in force and effect until the effective date of this ordinance.
Section 12. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this ordinance is declared unconstitutional or invalid for any reason, such
decision shall not affect the validity of the remaining portions of this ordinance.
