Dear Mr. Carlson:
I have been asked to respond to your June 2, 2014 letter. We disagree with many of the
characterizations in your letter and respectful demand that the decision for revocation of the
certificate of occupancy be reversed. As discussed below, I have some serious concerns as to the
City revoking a vested right without notice to effected parties.
We do wish to make clear that while we believe your letter is incorrect,we suggest that the
City work with PSBA to try to see if the matter can be resolved pragmatically. PSBA contends
there was no incorrect information provided to the City and the Certificate of Occupancy was not
issued in error. Further, as will be discussed below, we disagree that there is any violation of the
International residential Code.
In your letter's third paragraph, you state that PSBA failed to construct a home that is
capable of preventing surface water from collecting in the crawl space. This is not correct—the
house does not collect surface waters in the crawl space. An examination of the crawl space would
show that there are no drip marks showing the water intruding through the foundation. Such
examination would show that the stem walls are dry. The water that has collected is not surface
water; it is water that has entered through the floor due to a high water table due to abnormally wet
weather.

Addressing the June 2,2014 Notice -we again contest there has been any violation of the law. We
would request a formal hearing on this matter. We hope that in the interim,that the City wark with
Chris Dunyaski and Adam Kemp of PSBA to try to find a resolution to this matter consistent with
the law and PSBA's duties vis-a-vis the homeowner.
As to Factual Background, we agree with Factual Background Paragraphs 1-3.
Regarding Paragraph 4, we would like to know exactly how it was determined that the water was
entering through the foundation. PSBA has worked with John Rowland as to these issues and has
coated all foundations with a subsurface asphalt emulsion to seal any normally occurring
microscopic holes in the cement. This was the agreed action after Mr. Rowland's April 7, 2014
inspection. There was nothing wrong with the foundations as poured, but given the presence of
water,PSBA worked to eliminate the possibility of surface water intrusion. Along such lines,it back
filled utility trenches to ensure that such work was done correctly and was not the problem, as
requested by Mr. Rowlands. To the extent Mr.Rowland can identify where he believes the water is
intruding through the foundation, my client will gladly consider the issue and possible remedies.
PSBA disputes Paragraph 5 as we are not dealing with surface water and there is no
current hazard. The house is built on stem walls with appropriate ventilation and appropriate
clearance between the soil and the sub-floors.
PSBA also disputes Paragraph 6. Adam Kemp of PSBA has had numerous conversations
with John Rowlands on numerous issues at this plat. He has not avoided any issues. No formal
letters or warnings were issued by Yelm prior to the June 2, 2014 letter and the Notice I am
addressing herein. Mr. Kemp spoke with Mr. Rowlands last week who made no mention of this
revocation that was finally received late last week and read this morning. Mr. Rowlands should be
aware of the work that PSBA has done to address water issues at this plat that have arisen due to the
combination of generally poor soil conditions and unusually wet conditions. Water intrusion in
essentially flood conditions would not be considered a building defect.
PSBA disputes Paragraph 7 of the Notice. PSBA has sealed the concrete, backfilled
utility trenches where water and septic went under foundation, re-graded the property, put in a
French drain at a low point in the back yard to avoid water pooling and put in a perimeter drain and
engaged in pumping. PSBA has taken action to try to eliminate the possibility that it is a foundation
leak. We are interested in any clear information that the water is entering through the foundation
versus being the result of a high water table. I am sure you are aware of the extreme rainfall earlier
this year.
PSBA also disputes the conclusion that the home was out of compliance with the IRC, as
indicated in Paragraphs 8 and 9. PSBA has provided truthful, accurate, and complete
information. The Certificate of Occupancy was correctly issued. The later occurring water levels
and subsequent water issues does not mean the certificate of occupancy was not correctly issued.

My client is disappointed with the action taken by the City. We have had no formal notices
of defects and Adam Kemp has worked well with the City. Taking such a drastic action when
Mr. Kemp and Mr. Rowlands had worked together on a possible solution, such as sealing the
concrete, and then saying PSBA has taken no action to rectify the matter is inaccurate and unfair.
As I just got the City's letter,I have not done in depth legal research but the notice of the City post-
inspection,post-approval,post-sale and occupancy by a third party is legally very dubious. Further
doing this without any formal notice seems to be a basic violation of due process rights and the
opportunity to be heard. I will be researching this issue further as to potential infringement of my
client's right without due process. Hopefully this matter con be resolved pragmatically without
resort to the courts.
In conclusion,we are reauesting an immediate reversal of the revocation of the Certificate of
Occupancy. We would appreciate if Mr. Rowlands would detail exactly where he believes the
water to be intrusion through the foundation to be occurring and we would request all information,
communication, and other material between the City and the owners so we know the exact issues
raised. In the meantime, Adam Kemp and Christopher Dunyaski will be contacting the City to go
over this issue. They have been, and remain, willing to meet and discuss the plat.
