Causseaux, Jr., Hearing Examiner From: Gary Carlson, Building Official Date: March 6, 2013 Subject: Bill's Towing Sign Variance VAR-20130116 Applicant: William Trull II 801 Yelm Ave West Yelm, WA 98597 Location: Bill's Towing 801 Yelm Ave West Yelm, WA 98597 Proposal: Vary the maximum height of a pole sign to 16 feet-7 inches Background William Trull II has applied for a variance to increase the sign height of his business Bill's Towing from the allowed 10 feet to 16 feet 7 inches. The property abuts Yelm Avenue West to the north and is zoned C-1 for commercial use. The parcels surrounding the site are also zoned C-1. The properties to the west and north, across Yelm Avenue, are developed as restaurants. The property to the south is approved for a day care facility. The property to the east is vacant and owned by Marie Goss, who submitted comments on the variance request for the Examiners consideration. William Trull Senior purchased the property in 1978 and City of Yelm's records indicate Bill's Towing began operation in Yelm the same year. The property is 2.88 acres in area and currently is used for Yelm Tire and Bill's Towing. The site has recently been used as an auto body shop and an auto wrecking yard. The Commercial (C-1) zoning district allows the sale of tires as a permitted use, and the towing business is a pre-existing, non-conforming use pursuant to Section 17.93.010 YMC. In a letter to the property owner dated March 21, 2000, the City noted that the existing sign on the property was conforming to the sign code in place in 1987. The existing sign is approximately 16 feet in height. The Yelm Sign Code at Section 15.24.210 (A) YMC allows pre- existing, non-conforming signs to remain, provided that: 1. No such sign shall be changed in any manner that increases the noncompliance of such sign with the provisions of this chapter; Staff Report Page 1 of 4 2. The burden of establishing a sign to be legally nonconforming under this section rests upon the person or persons, firm or corporation claiming nonconforming status for a sign; 3. When a business or activity containing a legal nonconforming sign is enlarged or remodeled to a value of 60 percent or more of existing value of real property improvements, then such sign must be brought in conformity with all provisions of this chapter; 4. When a business or activity with a legal nonconforming off-premises sign changes the sign face or name of the business, then such off-premises sign must be brought into conformance with all provisions of this chapter. As the proposal includes a face change to the sign, the Sign Code would require the pre- existing, non-conforming sign to be brought into compliance with current standards for signs. The current Sign Code would allow a free standing (pole) sign 36 square feet in area, 10 feet in height, and set back from the property line 10 feet. As part of the Yelm Avenue West road reconstruction, the City purchased 4 feet of additional right of way from the property owner and the fence and gates were rebuilt to their current configuration. A block retaining wall was added, as the elevation of the side walk is approximately 2 feet above the finish grade of the property. The Washington State Patrol has promulgated rules for Tow Truck operators. Section 308-61- 026 WAC requires Towing facilities to maintain a secure area for towed vehicles, including a 6 foot security fence topped with a minimum of 2 strands of barbed wire for a total of height of 8 feet. For the subject property, this required the fence to be 6 feet above the sidewalk grade with barbed wire extending an additional 2 feet. The barbed wire is canted away from the property and currently extends over City right-of-way, creating a public safety hazard. Mr. Trull, Senior had previously been notified by the City to correct this situation. A Notice of Application was mailed to local and state agencies and surrounding property owners on February 7, 2013. A Notice of the Public Hearing was published in the Nisqually Valley News March 1, 2013, and posted in public areas on February 27, 2013. The public hearing notice was mailed to adjacent property owners and the applicant on February 27, 2013. Two comments were received prior to the public hearing. The Washington Department of Transportation noted that the sign is not in the right of way of Yelm Avenue West/SR 510. Marie Goss noted that the current sign is non-conforming and raised a number of questions regarding the specific construction of the proposed sign, all of which are answered in the variance application materials, with the exception of who will install the sign, which is not required by the City until a construction permit application is made. Ms. Goss also questioned the impact the proposed sign would have on adjacent businesses, properties, and traffic, and whether the approval of the variance would apply to all properties in the area or make it easier for other properties to obtain a variance. Any other application for a variance would have to make the same showing in order to be approved, that due to special circumstances of the specific property, they are not able to enjoy the same rights and privileges as others within the area and the same zoning district. Any future variance application would be reviewed based on its own merits. The impacts to adjacent properties and traffic are addressed below. Variances from provisions of the Sign Code may be granted by the Hearing Examiner in accordance with Chapter 17.96 YMC, according to Section 15.24.200 YMC. Section 17.96.023 YMC allows the issuance of a variance when it can be shown that Because of special circumstances applicable to the subject property due to size, shape, topography, location, or surroundings, and if the strict application of this title is found to deprive subject property of rights and privileges enjoyed by other properties in the vicinity and under identical zone classification. Analysis As noted earlier the site has been in continuous use as a towing operation since 1978. Section 308-61-026 WAC requires a tow truck operator to fence a secure area with a 6 foot fence with a minimum of 2 strands of barbed wire for a total of height of 8 feet. In this case, the 6 feet is measured from the City sidewalk and the sign height requirement is measured from the finish grade of the property, resulting in a sign that could not be seen clearly through the required fence. This condition is a specific result of to topography of the property and the requirements of the State for operation of a towing operation, both of which are outside the control of the applicant. The strict application of the height requirement of the Sign Code would result in a sign that could not be seen and would appear lower than conforming signs on adjoining properties, both of which are at the same grade as the sidewalk and Yelm Avenue. The Sign Code requires new signs to include landscaping around the base of the sign. In this case, the landscaping would not be clearly visible from Yelm Avenue West, and would not serve its intended purpose of screening the base and beatifying the property. In lieu of this requirement, it would be a benefit for the property owner to maintain the area between the back of sidewalk and the fence to be free from weeds and debris. Recommendation The Community Development Department recommends the Hearing Examiner approve the variance with the following conditions: 1. The allowed height for the sign shall be 10 feet plus the grade difference between the base of the sign and the sidewalk grade. 2. The sign area shall meet the requirements of the Sign Code, Chapter 15.24 YMC. 3. The setback between the property line and the sign shall meet the requirements of the Sign Code, Chapter 15.24 YMC. 4. Landscaping at the base of the free standing sign is not required, however the area shall be maintained to be kept free of weeds and debris. 5. The barbed wire at the top of the fence shall be repositioned to not overhang City right-of-way. 6. The sign shall be brought into compliance with the Sign Code, Chapter 15.24 YMC, upon any change of use or redevelopment of the property. Attachments 1. Application for non conforming sign 2. Dear Board Members, Many of my concerns have not been addressed in the Trull application for exemptions for new signage. 1. It appears the current signage is non-conforming at its current height of approximately 18'to 20'. 2. The size and location of the new sign are not specified. 3. The type of sign is nat specified i.e.: painted,etched, plastic or electronic? 4. The topography is not significantly a problem condition as the yard behind the fence has a minor gradual slope. 5. Is the sign(s)going to be one sign incorporating both of the businesses,or two signs advertising both of the apparent current business uses? 6. Does the square footage of the building on the property actually conform to the requested signage size? 7. Who will install the sign(s)? 8. Using the same pole and bracket/hardware as the existing sign for mounting your new sign. Any changes other than changing the sign facing will increase the noncompliance of the sign and the Legal Nonconforming Sign status wil! be lost. {2) Apply for a Variance: fnclude the Variance application with the new sign application, new sign design and size, site plan showing setbacks anc! location, and any supporting information why the variance should be granted. Like a letter from ihe state concerning the fence. I have attached a Variance Application,your Sign Application and the Code section .
