Landscape Maintenance Contract
1. General Reyuirements
1.1. All work wi11 be performed in a professional and workmanlike manner
by experienced and well trained, uniformed personnel,utilizing clean,
well-ma;ntained equipment of the latesf and most efficienf design.
1.2. The practices and procedures ennployed will be according to accepted
industry standards; installations and applications will be made�with
technical expertise; all vehicles and equipment will be operated both
skillfully and safely within the grounds.
1.3. Work performance wili comply with the Federal Occupational Safety and
Health Act. All applications of pesticides classified for restricted use will
be made by certified applicatars only.
1.4. A11 original product packaging may be inspected by the properfiy
representative prior to use.
1.5. The Contractor wi11 train crew members to respec�the property,but will
also train all emplayees concerning the provisions of this agreement and
the need to prevent damage to the proper�y.
2. Lawn Maintenance Issues
2.1. Mowing
2.1.1. Paper, trash, branches, and ather debris wili be collected prior to or
during each mawing.
2.1.2. Contractor will mow turf areas on a weekly schedule whether it's
wet or dry during the growing seasan and as needed the rest of the
year.
2.1.3. No more than 1/3 of the Ieaf blades will be removed per mowing-
Contractor will be expected to adjust the rnowing height as
appropriate and, if neCessary, for different sections of the property.
2.1.4. During periods of excessive ra�n and tall grass growth, the mower
cut height may be raised.
2.1.5. All mowing will be conducted with a rotary mower.
2.1.6. Mower blades will be sharp at all times fo provide a quality cut and
prevenf tearing of the grass blades.
2.1.7. Mowing equipment and patterns (alternate directions each cutting
where possible} shall be employed fo permit recycling of clippings
were possible and present a neat appearance.
2.1.8. Contractor will collect clippings from the lawn and remove them.
2.2. Edging and Trimming

2.2.1. Grass adjacent to fixed objects shall be trimmed to the same height
as the general turf.Trimming is to be done so that turf areas are not
scalped.
2.2.2. Contractor wi11 edge plant beds, sidewalks, drive�vays, parking lots,
and other surfaced areas bordered by grass. This will be done every
other mowing during the growing season to prevent excessive edge
loss.
2.2.3. Isolated trees and shrubs growing in lawn areas wi11 require
mulched areas around them (minimum 1-foot diameter, maximum 3-
foot diameter) to avoid bark injury fram mo�vers and filament Iine
trimmers and to reduce root competifion from grass. Establishment
and maintenance of such mulched areas will be charged to the client.
2.2.4. Contractor will clean aIl clippings from sidewalks, curbs and
roadways immediately after mowing and/or edging. Contractor will
not sweep, blow or otherwise dispose of clippings in sewer dxains.
2.2.5, Cont�ractor may use herbicides in lieu of edging and trimming,
espec�ally adjacent to buildings and fences. Use of non toxic
pesticides wi11 be used when ever possible.
2.3. Soil Testing
2.3.J.. A number of soil tests will be performed upon request at an
addi�ional cost to ensure correct care is being given to the turf.
2.3.2.The client is ta be provided with a written copy of all soil tesfis, along
with the recommendations resulting from the test.
2.4. Fertilization
2.4.1. Fertilizing of turf areas should be done as per the maintenance
schedule on the last page.
2.4.2. Complete fertilizers shall be granular in composition and contain
10% to 30% or moxe of the nitrogen in a slow- or controlled-release
form. The exact composition of the fertilizer shall be determined on
the basis of good 'zndustry practice combined with soil tesfiing(see
item 2.3,).
2.4.3, Fertilizer will be blown off of walks and driveways onto Iawns or
beds.
2.4.4. If there are no means of wafering in fertilizer, the Contractor will
apply at the appropriate season and when rain is anticipated within
24 hours.
2.5. Aeration
2.5.1.Turf grass areas in regions of clay and highly compacted soils
require regular aeratioi�. Aerafion should be accomplished in the
early spring or before soils freeze in late autumn in colder climates.
This can be requested at an additional cost.
2.6. Pest Contral

2.6.1. The Contracfor will inspect lawn areas each month for indications of
pest problems and advise the property representative of such
problems.
2.6.2. Upon confirmation of a specific problem requiring treatment,the
Contractor will apply pesticides as needed and only in affected spots.
Non toxic pesticides will be used when possible. No pest�cide wi11 be
applied to turf areas in need of treatment without the express
approval of fhe client.
2.6.3. A11 applicatians of pesticides and fertilizations wi11 be performed
when temperatures are below 90°F and wind drift is negligible.
2.6.4. The Contractor wiil keep records on pests identified and
treatment(s) rendered for control.
2.6.5. All pest control services (othex than weeds) are in addition#o the
basic contract charges.The Contractox will chaxge the client per�ob,
based on materzals cost plus labor. The cost will be agreed on by the
Client a�d Contractor before such services are rendered.
3. Landscape Beds and Plant Maintenance Issues: Trees, Shrubs, Ground
Covers
3.1. Fertilization
3.1.1. Ornarnental shrubs, trees and ground covers wi11 receive an annual
application around March. The Rate will be 1 pound of nitrogen per
1,000 square feet per application.
3.1,2. Fertilizers should contain equal amounts of nitrogen and potassium,
and 30% or more of the nitrogen should be available in siow-release
form.
3.1.3. Fertilizer applied to shrubs and trees ptanted in beds shall be
broadcasted aver the entire plant bed.
3.2. Pest Control
3.2.1. Contractor shall practice Integrated Pest Management(IPM) to
control insects, diseases and weeds on and around perennials,
ground covers, shrubs, vines and trees. This will include frequent
monitoring and spot treatmenfi as necessary using the least toxic
mefihod when possible. AlI applications will be�erformed when
temperatures are below 90°F and when wind drift is negligible
3.2.2. Weeds in beds or mulched areas will usually be treated with Round
Up (or its equivalent) sparingly or mechanicaily removed.
3.2.3. Noxiaus weeds shall be treated and/or removed from the property.
3.3. Pruning
3.3.1. Pruning should only be done to remove dead or diseased branches,
reduce foliage density or crassing branches, to improve the beauty of
the plant, or to ensure safety to the public {especially near street
signs}.

3.3.2. Shrubs will be pruned with hand shears or powered hedge trimmers
as needed to provide uniform shape, fullness and blooms.
3.3.3. AlI�rees should be trimmed so a mower can get undex and around
fihem, with these exceptions: [newly planted trees,trees that are too
small, trees designed to be a Iandscape block or barrier, and special
requests].
3.3.4. No pruning will be done during or immediately following growth
flushes, branches will be pruned just outside the branch coIlar, and
pruning paint wili not be applied.
3.3.5.Sucker growth will be removed by hand from the base of trees, No
herbicides will be used for this purpose.
3.3.6. No trees will be topped unless specificaliy requestedo Once
requested an assessment of the pruning will be done and an estimate
of the cost will be provided to the client.
3.3.7. The maximum heigh�of pruning provide within the contract is
twelve feet. Any need for pruning above and beyond the basic
contract can be requested at an additzonal charge. The cost wi11 be
agreed on by the Client and Contractor before such services are
rendered.
3.4. Mulching/Barking
3.4.1. All mulched areas should be replenished once a year in �ebruary
before the 1St of March. Maintenance of such mulched areas will be
charged to the client at an additional cost.
3.4.2. Mulch should be maintained at a depth of not less than 2-inches and
not more than 3-inches.
3.4.3. Mulch�svill not be allowed to cover valve boxes, meters, irrigation
heads, Iandscape 1'rghting,or markers.
3.4.4. Additional mulch wi11 be billed at$45/yard (includes product and
labor).
4. Irrigation System Work
4.1. The Contractor is responsible for bringing up th�irrigation system in the
spring and setfing the schedules. Each systezxi will be checked for proper
operation and coverage. The systems wili be shut down in the fall once
the fail rains have returned.
4.2. Minor adjustments such as head/emitter cleaning, fiiter clean�ng, and
minor timer adjustmenfs shall be made by the Contractor, with the client
paying for parts plus 15% if needed (the labor for these minor adjustments
is included in your basic maintenance).
4.3. During weekly mainfenance, the Contractor will note and report to client
any symptoms of inadequate or excessive irrigation, drainage problems,
etc.

4.4. The Contractor may be requested to xnspect and test rain shut-off devices
and other companents and zones in the irrigation system monthly and
sha11 reset zone times according to seasonaI climate changes.
4.5. Repairs or system service beyond the above scope will be charged to the
clienf at$40/hour plus parts. The Contractor will notify the client of the
nature of the problem before repairs are made.
5. Insurance, Licenses, Permifis, and Liability
5.1. The Contractor will carry liability amounts and worker's compensation
coverage required by Iaw on his/her operators and employees and
requires the same of any sub-Contractor and provide proof of same to the
client.
5.2. The Contractor will carry general liability insurance in the amount of
$1,000,000.
5.3. The Contractor is also responsible for obtaining any licenses and/or
perznits {not Iimited to business Iicenses, pesticide licenses, etc.) required
by law for activities on the property.
5.4. AlI work will be performed in a workmanship-like xnanner.
5.5. Situations which the Contractor may deem are his/her responsibiiity:
5.5.1. Any damage due to the operation of his equiprnent in performfng
fhe contract, to include damage to plantings, fences, walkways, curbs,
irrigation heads, sewer lids, or any personal property.
5.5.2. Failure to comply with all Iaws pertaining to protected plant species.
5.5.3. Damage to plant material due fo improper horticultural practiceso
5.5.4. Injury to non target organisms due to application of pesticides.
5.6. Situations which the Cantractor may deem are not hzs/her responsibiIity:
5.6.1. Death or decline of plant maferials due to improper selection,
placement, planting or maintenance done before the time of this
contract.
5.6.2. Damage due to improper or faulty irrigation components existing at
the time of contract execution.
5.6.3. Exposed cables/wires or sprinkler cornponents/lines normally
found below the surface.
5.6.4. Flooding,storm, wind,fire or coId darnages. Cleanup for this can
be requested at the current hourly rate.
5.6.5. Disease ox damage to lawns or Iandscape plants caused by excessive
irrigation or Iack of water due to inoperative irrigation components
provided he/she reported these to client, or irrigation restrictions
imposed by civil authorities.
5.6.6. Damage caused by or to any item hidden in the Iandscape and not
clearly guarded or marked.
5.6.7. Damage due to vandalism.

6. Genex�l Maintenance

on�we�kZy basis duxxng the fall season and as needed the rest of the year.

7. Property I�escripfion,Addikianal Services,Terms,Conditiona,and Charges

7.2.`�h��4�rtt�,�ct term i�for a period of 3-ycars. The contract may Ue canceled by
ei#�.���p��ty on 3U-days written notification foi�nonperformance. The contract
sh�1�Qr�ki�t�e qn a yearly basis if services are not cancelled nr inodifiec� by the
endx��d�te af each'can�ract y�ar.
7.3.This�pz�t��ct w'iIl be governed by the laws of Washington St�te.
7,4.Charge��nc�P�yment ,
7.4.�, �'�t�Contractor wall furnish all labor and equiprnent fc�r the performance of
this'ca�ttract.

7.5. Any add�tianal or uinscheauled services agreed'upon by the client and
�oritractor will b�bill�ri separately with payment due upon rec�ipt. Unskilled
Iabor hou�rs will be billed at$35 per hour. Any equipment rented to perform
any addiHonal services will be billeci at cast plus 15%0.
