1. Mayor Harding called the meeting to order at 6:00 p.m.
2. Roll Call Present: JW Foster, Joe Baker, Bob Isom, Tracey Wood, Ken Garmann
and Russ Hendrickson. Mike McGowan arrived at 6:02 p.m.

5. Public Comment -Took place at the end of the meeting -
Pastor Winn of the Truth Seekers Church introduced herself to Council. Pastor
Winn has been a resident of Yelm since May of 2013. Pastor Winn has concerns
regarding Warren Williams; Executive Director of the Yelm Adult Center who was
recently removed from his position and asked that Council assist in putting Mr.
Williams back in his role as Executive Director. Mayor Harding invited Pastor to
meet with him after the meeting or at a different time.

8. New Business -
a. Ordinance No. 977 Eminent Domain for Real Property referred to as 401
First Street SE, 403 First Street SE, 405 First Street SE, Tax Parcel No.'s
227-19-332500, 227-19-331000 and 227-19-330900.
Stephanie Ray stated as the City's six-year transportation plan, and in an effort
to provide efficient transportation systems within the City to meet the current
and future growth consistent with the goals of the Growth Management Act, the
City identified the Mosman Avenue Realignment Project as a high priority project
for funding and construction. The City has made a substantial investment of
resource in both time and money to design and fund improvements associated
with the Mosman Avenue Realignment Project. In 2011, the City received
transportation grant funds from the Washington State Transportation
Improvement Board (TIB) in the amount of $1,132,142 and the City provided
$500,000 for the match. During the design phase of the project, the City
formalized the final right of way needs from various property owners needed to
complete the project in accordance with the Washington State Department of
Transportation Standards and the City of Yelm's Development Standards for a
commercial collector roadway. Alternative plans were considered but did not
meet the City's objectives relating to the interconnectivity and safety issues
relating to the adjacent trail corridor and City Park across First Street. In
addition, even as redesigned, substantial questions remained regarding the

suitability for development of any remaining property. Consistent with sound
practices, the City is acquiring the entirety of the property for City right of way,
landscaping, park (trail) and park access and public use. The City has considered
the current market value of the property and is attempting to negotiate the sale
of the property at fair market value. The eminent domain proceedings are
necessary to secure the City's interest in the property and the adoption of the
ordinance is one-step in the well-established process for acquisition of property
for public use. The adoption of the ordinance and initiation of condemnation
proceedings will not foreclose further negotiations toward the settlement with the
current property owners Mr. Craig and Ms. Hemoine and the City recognizes that
just compensation must be paid by the City. The property owners were notified of
the City's intent and it was published in the Nisqually Valley News. Stephen
DiJulio, Special Assistant City Attorney was available on speaker phone.
Councilmember McGowan asked about the process of the eminent domain. Mr.
DiJulio explained the steps of the process.
MOTION BY BOB ISOM AUTHORING MAYOR HARDING TO SIGN
ORDINANCE NO. 977 IMPLEMENTING EMINENT DOMAIN PROCEDURES
REGARDING THE ACQUISTION OF REAL PROPERTY AS REFERRED TO IN
EXHIBIT A, COMMONLY KNOWN AS 401 FIRST STREET SE; 403 FIRST
STREET SE; AND 405 FIRST STREET SE, YELM, WASHINGTON. CARRIED.
Old Business -
a. Ordinance No. 974, Water Revenue Bond Refund
Teresa Mattson, City Treasurer gave an overview of the Water Revenue Bond
Refunding. The City currently pays 4.25%, increasing every year to 5.25% by
2022. With our Standard and Poor bond rating at A+, we stand to save $216,809
over the next 10 years. These savings are net of all financing costs and a net
present value saving percent of 10.41%. Rates for the new issuance were
determined the day of the meeting and are between 2 and 3.125%. Jim Nelson,
Senior Vice President of D.A. Davidson & Co. explained the cost savings to the
City in detail. Rating agencies consider the amount of outstanding Water System
debt, local economy, financials of the Water System, and management of the
City. Mr. Nelson thanked Shelly Badger, Teresa Mattson, Grant Beck, Ryan
Johnstone and Stephanie Ray for participating in the rating conference call on
August 22nd. Rating The City of Yelm has gotten an excellent rating from
Standard and Poors. It is a great accomplishment considering what communities
have endured the last few years with the unstable economy. Cynthia Weed, Bond
Attorney was also present to answer any questions.
MOTION BY BOB ISOM ADOPTING ORDINANCE NO. 974, AUTHORIZING
THE ISSUANCE OF WATER REVENUE REFUNDING BONDS OF THE CITY IN
AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $1,600,000 TO
PROVIDE FOR THE REFUNDING OF CERTAIN OUTSTANDING WATER
REVENUE BONDS. CARRIED.
Mayor and Council Initiatives
Councilmember Baker attended the Intercity Transit Board meeting and stated
they gained more vanpools. Councilmember Baker also attended the Yelm Adult
Community Center meeting and reminded everyone of the upcoming Silent
Auction on September 28 from 4 pm - 7:30 pm.

Councilmember Isom stated he would be not attending the next two meetings
and asked that any Sustainability comments be given to Grant Beck by the next
Study Session so he can submit them to the Sustainability Plan. Councilmember
Isom attended a TRPC meeting and reported on an interesting study about
Regional Transportation Plan update conducted by Department of Transportation
(DOT) about Rail Service. It appears there may be grant money available for short
line freight rail service. The Town of Bucoda is having their second annual Scary
Nights Haunted House in October and November.
Councilmember McGowan attended the Thurston County HOME Consortium
Committee meeting on CHG funds. There is approximately $560,000 that will be
allocated to the Rapid Rehousing Programs and Tenant Based Rental Assistance
Program. Locally Yelm Community Services received $10,000 for their shelter
program. A small group met to discuss the Annual Homeless Census count that
will take place in January.
Councilmember Wood will be attending the Transportation Policy Board meeting
in the morning and they will be discussing Rail Grants in detail.
Councilmember Hendrickson attended the Yelm Emergency Operations Board
meeting today and reported that they are still working on department functions
during a declared emergency. Chief Stancil is looking at new fuel pumps for the
school gas tanks.
Mayor Harding attended the Thurston County Mayor's Forum and the Luncheon
Chamber Forum for the annual presentation for Police and Fire.
Councilmember Isom highly commended staff for all the work done on saving
money for the City with the Bond Refunding. Mayor Harding stated that staff has
been great over the years not only looking for ways to save money but also to pay
off debt early.
