Adapt Engineering, Inc. (Adapt) is pleased to present the results of the National Environmental
Policy Act (NEPA) review for the above-referenced T-Mobile project. Authorization to perform
this project was given in the form of the T-Mobile purchase order numbers 4550286804 and
4550347918.
1.0 INTRODUCTION
The NEPA review addresses whether the "facility" may have a significant environmental effect
on eight actions or categories as outlined in the Federal Communications Commission (FCC)
NEPA Rules [47 CFR Part I, 1.1307 (a) (1) through (8)]. The eight actions include: wilderness
areas; wildlife preserves; threatened-endangered species and critical habitats; historical
properties; Indian religious sites; flood plains; surface features including wetlands deforestation,
and water diversion; and high intensity white lights.
2.0 FACILITY DESCRIPTION
A Location Map (Figure 1), Street Map (Figure 2), Topographic Map (Figure 3), and 2005 Aerial
Photograph (Figure 4) are attached at the end of the report. Photographs are included in
Appendix A.
The project site is situated on a host parcel located at 16220 Railway Road Southeast in Yelm,
Thurston County, Washington (Section 19-Township 17 North-Range 2 East, Willamette
Meridian).
Adapt Engineering, Inc.
The host parcel is roughly triangular shaped with north, southeast, and southwest corners; and
northeast, south, and northwest sides. The parcel covers a reported 9.62 acres. At the
southeast corner of the parcel are a single-family residence, mobile home, and barn. The
house and barn were reportedly constructed in 1920. The remainder of the property is
undeveloped and covered with trees, brush, and grasses.
According to the United States Geological Survey (USGS) 7.5-minute series topographic map
"McKenna WA" (1990) the project site is at an elevation of approximately 340 feet above mean
sea level and is relatively level.
The host parcel is bordered on the north and northwest by a railroad right-of-way and Northern
Pacific Road Northwest, beyond which is parcel with a warehouse facility occupied by Lasco
Bathware (plumbing fixtures). Adjacent to the northwest of the host parcel is a largely
undeveloped parcel except for a Puget Sound Energy electrical substation adjacent to the east
of the southeast corner of the host parcel. Railway Road Southeast borders the south side of
the host parcel with single-family residences beyond.
T-Mobile proposes to lease a 50-foot-square (2,500 square feet) area approximately 100 feet
northwest of the host parcel buildings in an apparent former pasture area currently covered with
trees, grasses, and brush. Within the lease area a 40-foot-square (1,600 square feet)
equipment compound will be developed and which will include a 150-foot monopole, pad-
mounted equipment cabinets (including a base transmitting station), utility H-frame, generator
and associated propane tank. Chain-link fencing will enclose the compound and a 20-foot-wide
landscape buffer will surround the fencing. The monopole will have a triangular antenna array
platform at the top of the monopole with six panel antennas mounted to the platForm. An access
road running due north-south will be constructed to connect the compound with Railway Road
Southeast south of the host parcel. The project will tap electrical and telecommunication utilities
within the Railway Road Southeast right-of-way with the utility lines running underground along
the access road to the compound. The facility will be constructed to accommodate three
additional carriers.
3.0 NEPA REVIEW ACTIONS
The eight FCC NEPA actions are presented below in the form of questions.
1. Will the facility be located in an officially designated wilderness area?
No. The project site is not within the boundaries of an officially designated wilderness area.
According to information on Wilderness.net, the nearest wilderness areas are the
Clearwater Wilderness and the Glacier View Wilderness, respectively located approximately
30 to 35 miles east-northeast and 30 to 35 miles east-southeast of the project site in the
Cascade Mountains (see Figure 5).
The University of Montana's Wilderness Institute and their fund providers that include the
Arthur Carhart National Wilderness Training Center and the Aldo Leopold Wilderness
Research Institute provide Wilderness.net as a public service. The Arthur Carhart National
Wilderness Training Center and the Aldo Leopold Wilderness Research Institute are the
wilderness training and research arms of the U.S. Forest Service, the National Park Service,
the U.S. Bureau of Land Management, and the U.S. Fish and Wildlife Service (USFWS).

2. Will the facility be located in an officially designated wildlife preserve?
No. The project site is not within the boundaries of an officially designated wildlife preserve.
According to information on the USFWS website, the nearest wildlife refuge is the Nisqually
National Wildlife Refuge located approximately eleven to twelve miles northwest of the
project site (see Figure 6).
State wildlife areas are administered by the Washington Department of Fish & Wildlife
(WDFW). According to the WDFW website, the nearest state wildlife area is the Nisqually
Wildlife Area located approximately eleven to finrelve miles northwest of the project site.
3. May the facility affect listed threatened or endangered species or designated critical
habitats; or likely jeopardize the continued existence of any proposed endangered or
threatened species or likely result in the destruction or adverse modification of
proposed critical habitats?
No. A Habitats and Species Map obtained from the WDFW's Priority Habitats and Species
Program (PHSP) does not indicate listed or proposed threatened or endangered species or
critical habitats at the project site or immediate surrounding area.
Adapt has a license to use the Washington Department of Natural Resources Natural
Heritage Program (WDNR NHP) Geographic Information System (GIS) data set containing
the most authoritative information available for Washington's rare plant species populations
and endangered ecosystems. A review of the most recent data set (dated September 2007)
did not reveal rare plants or high quality ecosystems within one mile of the project site.
A review of the Western Washington USFWS office's November 1, 2007 listing (see
Appendix B) of threatened and endangered species (federal designation) in Thurston
County revealed no endangered species; five threatened species [bull trout, marbled
murrelet, northern spotted owl, Howellia aquatilis (water howellia) and Castilleja levisecta
(golden paintbrush)]; and several candidate species and species of concern. The USFWS
listing does not specify whether the species are known to inhabit the immediate project
vicinity. The WDFW and WDNR NHP information does not indicate known occurrences of
the species at the project site or vicinity.
Based on a review of the WDFW PHSP, WDNR NHP, and USFWS information, and the
project scope that includes construction of the facility in a former pasture on an industrial
zoned property, it appears the proposed T-Mobile project will have no effect to listed or
proposed threatened-endangered species and critical habitats as habitat loss will be
minimal. John Grettenberger, wildlife biologist for the Western Washington USFWS office,
told Adapt that as of July 2006, his office does not have staff available to review
submissions for proposed undertakings where there is a "no effect" conclusion by a
consultant, and it is not necessary to submit packages for such projects to the USFWS for
review. In response to another submittal for a communication project in Western
Washington, Ken S. Berg, manager of the Western Washington USFWS office, responded
with a letter (dated July 23, 2006) indicating that because of the "no effect" determination by
Adapt, there is no regulatory requirement for USFWS concurrence. The letter adds that
information used for the "no effect" determination should be maintained on file as supporting
documentation. A copy of the USFWS letter is included in Appendix C.

Because of the sensitivity of the species information and non-disclosure agreements with
the WDFW PHSP and the WDNR NHP, Adapt is not able to provide specific species and
location information, or the raw maps and data.
4. May the facility affect districts, sites, buildings, structures, or objects significant in
American history, architecture, archaeology, engineering or culture that are listed or
are eligible to be listed in the National Register of Historic Places?
No. Adapt completed a Section 106 Review of the National Historic Preservation Act of
1996 and 36 CFR 800 to assess whether the proposed facility will have an effect on
properties listed on, or eligible for listing on, the National Register of Historic Places
(National Register) within an area of potential effect (APE) for direct effects and visual
effects. The direct effects APE consists of the ground area that will be disturbed, namely
the equipment compound, access road, and underground utility line run. For towers below
200 feet in height, the APE for visual effects is one-half-mile as specified in Section VI.C.4.a.
of the Nationwide Programmatic Agreement for Review of Effects on Historic Properties for
Certain Undertakings Approved by the FCC (Nationwide Agreement).
On October 17, 2007, Adapt reviewed available records at the Washington Department of
Archaeology and Historic Preservation (DAHP). The DAHP database of National Register,
National Historic Landmarks, and Washington Heritage Register properties does not include
the host parcel or historic properties-historic districts within either APE. Additionally, a
review of DAHP inventory files and cultural resource maps did not reveal eligible historic or
cultural resource properties within the direct effects APE but two properties were found
within the visual effects APE. The properties are as follows:
• 34-Y160 House on Railway Road Southeast. A review of the inventory form
revealed the property corresponds to the single-family residence on the host parcel.
It appears the inventory form was completed as part of a 1992 inventory of buildings
in Yelm and the form does not indicate the house is National Register eligible.
• TN00331 Historic Agriculture Site. This property is located west of the intersection of
Wilkinson Road Southeast and Canal (Batch) Road Southeast, approximately one-
half-mile northeast of the project site. The property is a former farmstead with no
standing buildings but scattered refuse and domestic debris. The DAHP file
information does not indicate whether the property is National Register eligible.
The project site and APE are situated on the relatively level Yelm Prairie. Much of the
prairie within the APE has been developed but some undeveloped land remains. A majority
of the APE is within the city limits of Yelm, with the host parcel and immediate surrounding
areas to the north, east, and west are zoned industrial. Development is largely single-family
residential including several newer housing developments. A warehouse facility for Lasco
Bathware occupies the north center portion of the APE and the southwest limit of the APE
extends to the Yelm city center. Yelm Creek runs due northwest through the southwest
portion of the APE. Tree cover in the APE is low.
The new monopole will be 150 feet tall and situated within a stand of trees that a survey
found have an average height of approximately 68 feet. The trees will screen much of the
lower portion of the monopole throughout the APE. In general, because of the relative
levelness of APE, the upper portion of the monopole will likely be visible throughout the APE

when not directly blocked by trees or structures. The impact to views will decrease with
distance from the monopole.
Based on online Thurston County property records, the host parcel barn and house were
constructed in 1920. The barn is in poor condition and the house is in fair condition. The
monopole will be visible from both structures. The upper portion of the monopole may likely
be visible from the TN00331 Historic Agriculture Site but the approximate one-half-mile
separation distance will reduce the impact to views. Within one-quarter-mile of the project
site in the south portion of the APE are newer residential tracts that Thurston County
property records indicate have been constructed since the 1990s. South of Yelm Creek in
the south portion of the APE is a residential neighborhood with a mix of homes constructed
before and after the 1960s but trees along Yelm Creek will help to block views of the
monopole in this area. For the older properties in the APE, Adapt has not made an
assessment as to whether they may be eligible for listing on the National Register. Trees,
however, will screen the lower portion of the monopole which will contribute to reducing view
impacts in the APE, including from properties that may be National Register eligible.
The review concluded there were no historic properties within the APE for direct effects and
no effect to possible historic properties within the visual effects APE. Adapt forwarded an
FCC Form 620 (dated and mailed December 3, 2007) to DAHP with those conclusions.
Gregory Griffith (Deputy State Historic Preservation Officer) responded with a December 6,
2007 email requesting an updated inventory form be completed for the house and barn
situated on the host parcel. Adapt subsequently retained Preservation Services to complete
an updated inventory form. The inventory form provided additional historical information
concerning the host parcel, the house, barn, and L.O Cochrane, the host parcel owner from
1927 to 1990. Preservation Services states in the updated inventory form the house does
not meet National Register eligibility requirements because of an addition on its north side.
Adapt forwarded the updated inventory form and an updated FCC form 620 (dated and hand
delivered February 20, 2008) to DAHP with the conclusion there was no historic properties
within the direct effects APE and no adverse effect to historic properties in the visual effects
APE. In a telephone conversation with Mr. Griffith on February 27, 2008, he said that after
reviewing the updated inventory form he was not ready to conclude the house was not
National Register eligible and it may come down to him having to visit the property. Mr.
Griffith eventually visited the property the week of March 31, 2008 and subsequently issued
a letter (dated April 11, 2008) concurring with the no adverse effect finding. Copies of the
original and updated inventory form for the host parcel house and barn are included in
Appendix D. A copy the DAHP letter is included in Appendix E.
5. May the facility affect Indian religious sites?
No. Adapt's October 17, 2007 review of DAHP files did not indicate Indian religious sites at
or adjacent to the project site. Notification of the project to Indian tribes was completed via
the FCC's Tower Construction Notification System (TCNS). Adapt input information for the
project into TCNS on October 9, 2007 and received a confirmation email indicating the
project had been assigned the Notification ID: 32033. The TCNS subsequently sent an
October 12, 2007 email with a listing of Indian tribes that had been notified. The TCNS
websites gives the date of first notification to the tribes as October 11, 2007. Copies of the
TCNS emails are included in Appendix F.

The following eleven Indian tribes were notified of the proposed T-Mobile undertaking via
TCNS:
1. Nisqually Indian Tribe
2. Puyallup Tribe of Indian
3. Suquamish Tribe
4. Tulalip Tribes of the Tulalip Reservation
5. Confederated Tribes and Bands of the Yakama Nation (Yakama Nation)
6. Coeur d'Alene Tribe
7. Confederated Tribes of the Chehalis Reservation
8. Squaxin Island Tribe
9. Cowlitz Indian Tribe
10. Skokomish Indian Tribe
11. Spokane Tribe of Indians
Nine of the notified tribes provided a response via TCNS or the tribe has a TCNS exclusion
that has been satisfied. The tribes and their responses are as follows:
Nisquallv Indian Tribe — Adapt received an email from Thor Hoyte, the attorney for the
Nisqually Indian Tribe, on November 27, 2007 in response to a second notification email
sent by Adapt on November 13, 2007. Mr. Hoyte's email states the following:
Adam, Thank you for the notice. The tribe has no comment on this application.
Suquamish Tribe — Adapt received an email from TCNS on November 14, 2007
indicating Dennis E. Lewarch (Archaeologist) responded with the following:
We have no interest in this site. However, if the Applicant discovers archaeological
remains or resources during construction, the Applicant should immediately stop
construction and notify the FCC and the Tribe, pursuant to 47 C.F.R Sec. 1.1312 of
the Commission's rules.
The reply from the Suquamish Tribe was received after Adapt sent a second notification
email on November 13, 2007.
Tulalip Tribes — The October 12, 2007 TCNS email listing of notified tribes included the
following exclusion for the Tulalip Tribes:
If the Applicant receives no response from the Tulalip Tribe within 30 days after
notification through TCNS, the Tulalip Tribe has no interest in participating in pre-
construction review for fhe site. The Applicant, however, must notify the Tulalip Tribe
in the event archeological properties or human remains are discovered during
construction, consistent with Section IX of the Nationwide Programmatic Agreement
and applicable law.
Thirty days have elapse since the initial TCNS notification with no response from the
Tulalip Tribes.

Yakama Nation —The October 12, 2007 TCNS email listing of notified tribes included the
following exclusion for the Yakama Nation:
If the Applicanbtower builder receives no response from the Yakama Nation within
30 days after notification through TCNS, the Yakama Nation has no interest in
participating in pre-construction review for the proposed site. The Applicanbtower
builder, however, must IMMED/ATELY notify the Yakama Nation in the event
archaeological properties or human remains are discovered during construction,
consistent with Section IX of the Nationwide Programmatic Agreement and
applicable law.
Thirty days elapsed since the initial TCNS notification with no response from the
Yakama Nation; however, Adapt received an email from TCNS on December 11, 2007
indicating Johnson Meninick (Cultural Resources Director) replied with the following:
We have no interest in this site. However, if the Applicant discovers archaeological
remains or resources during construction, the Applicant should immediately stop
construction and notify the FCC and the Tribe, pursuant to 47 C.F.R Sec. 1.1312 of
the Commission's rules.
Coeur d'Alene Tribe — Adapt received an email from TCNS on October 24, 2007
indicating Quanah Matheson (Cultural Resources Manager/THPO) replied with the
following:
We have no interest in this site. However, if the Applicant discovers archaeological
remains or resources during construction, the Applicant should immediately stop
construction and notify the FCC and the Tribe, pursuant to 47 C.F.R Sec. 1.1312 of
the Commission's rules.
Confederated Tribes of the Chehalis Reservation — The October 12, 2007 TCNS email
listing of notified tribes included the following exclusion for the Confederated Tribes of
the Chehalis Reservation:
If the Applicanbtower builder receives no response from the Confederated Tribes of
the Chehalis Reservation within 30 days after notification through TCNS, the Tribe
has no interest in participating in pre-construction review for the site. The
Applicanbtower builder, however, must IMMED/ATELY notify the Confederated
Tribes of the Chehalis Reservation in the event archaeological properties or human
remains are discovered during construction, consistent with Section lX of the
Nationwide Programmatic Agreement and applicable law.
Thirty days have elapse since the initial TCNS notification with no response from the
Confederated Tribes of the Chehalis Reservation.
Squaxin Island Tribe — Adapt received an email from Larry Ross, Cultural Resource
Specialist 2, on November 19 2007 in response to a second notification email sent by
Adapt on November 13, 2007. Mr. Ross' email states the following:
Thank you for sending the informafion abouf this project. We would like to fake the
opportunity to respond to your request for our concerns about the proposed
communications facility project. While the project is located in the Squaxin Island

Tribe's aboriginal territory, and Squaxin people may have traveled to the area for
social and/or resource gathering purposes, the area was permanently inhabited by
the Nisqually Tribe. Therefore, we recommend that further consultafion be
conducted with the Nisqually Tribe to acquire their concerns on places of cultural
importance to their people. The Squaxin Island Tribe requires no further consultation
on the proposed project.
Cowlitz Indian Tribe — The October 12, 2007 TCNS email listing of notified tribes
included the following exclusion for the Cowlitz Indian Tribe:
If the Applicant receives no response from the Cowlitz Indian Tribe within 30 days
after notification through TCNS, the Cowlitz Indian Tribe has no interest in
participating in pre-construction review for the site. The Applicant, however, must
notify the Cowlitz Indian Tribe in the event archaeological properties or human
remains are discovered during construction.
Thirty days elapsed since the initial TCNS notification with no response from the Cowlitz
Indian Tribe; however, Adapt received an email from TCNS on February 29, 2008
indicating Edwin Arthur (Assistant Director - Cultural Resources) replied with the
following:
The Cultural Resources Department of fhe Cowlitz Indian Tribe recommends that an
Inadvertent Discovery Plan be attached before any work is performed.
See below for Inadvertent Discovery Plan information.
Sqokane Tribe of Indians — Adapt received an email from TCNS on October 5, 2007
indicating Randy Abrahamson (THPO) replied with the following:
We have no interest in this site. However, if the Applicant discovers archaeological
remains or resources during construction, the Applicant should immediately stop
construction and notify the FCC and the Tribe, pursuant to 47 C.F.R Sec. 1.1312 of
the Commission's rules.
The FCC's Declaratory Ruling Clarification of Procedures for Participation of Federally
Recognized Indian Tribes and Native Hawaiian Organizations Under the Nationwide
Programmatic Agreement includes a process by which wireless providers or tower
applicants may satisfy Indian tribe notification for projects that have been escalated to the
FCC for government-to-government consultation. The primary process includes the
following as spelled out in Paragraph 1.2. Of the Declaratory Ruling:
We clarify that once an Applicant has made two good faith efforts over 40 days to obtain
a response as specified in the Nationwide Agreement, the Commission upon notice will
communicate by letter or email with the Indian tribe's or NHO's cultural resources
representative seeking an indication, within 20 days, of the Indian tribe's or NHO's
interest in participating in review of the proposed construction. The Indian tribe or NHO
thus will have received at least three contacts and will have had a total period of at least
60 days in which to respond. If the Indian tribe or NHO does not respond to either the
Commission or the Applicant within 20 days of the Commission's communication, it will
be deemed to have no interest in the pre-construction review, and the Applicanf's

obligations with respect to that Indian tribe or NHO under Section IV of the Nationwide
Agreement are complete. This process is effective immediately.
The below-listed tribes did not respond to the initial TCNS Notification or they do not have a
TCNS exclusion that has been satisfied.
Nisqually Indian Tribe
Suquamish Tribe
Puyallup Tribe of Indian
Squaxin Island Tribe
Skokomish Indian Tribe
Adapt emailed second notifications to the above listed five tribes on November 13, 2007
asking for an "Interest-No InteresY' reply. The Nisqually Indian Tribe, Suquamish Tribe, and
Squaxin Island Tribe subsequently replied as noted in Attachment 3— Part II above.
As of November 29, 2007, Adapt had not received a reply from the Puyallup Tribe of Indians
or the Skokomish Indian Tribe. Since over ten days elapsed since the second notification
without a reply, Adapt escalated the project to the FCC for government-to-government
consultation on November 29, 2007. Adapt received a December 6, 2007 email from the
FCC indicating government-to-government consultation with the Puyallup Tribe of Indians
and the Skokomish Indian Tribe occurred on December 6, 2007 and if the FCC or Adapt do
not receive a statement of interest from the tribes within 20 days, obligations of Section IV of
the National Programmatic Agreement are complete. To date, Adapt has not received a
statement of interest from the Puyallup Tribe of Indians or the Skokomish Indian Tribe and
the FCC has not notified Adapt that they have received a statement of interest. Thus, since
20 days have elapsed since December 6, 2007, T-Mobile's obligation to notify Indian tribes
under the Nationwide Programmatic Agreement has been fulfilled for the project.
Included in Appendix G are the TCNS emails documenting the replies of the Indian tribes in
the order they appear on the TCNS notification. Appendix H includes the December 6, 2007
FCC email to Adapt and the second notification emails sent to the Puyallup Tribe of Indians
and the Skokomish Indian Tribe.
It should be noted that DAHP requires that during construction activities, if archaeological or
historic materials are discovered, work in the immediate area must be discontinued, the area
secured, and the appropriate Indian tribe(s) and DAHP notified. An Inadvertent Discovery
Plan is included in Appendix I.
6. Will the facility be located in a flood plain?
No. Based on a review of the Federal Emergency Management Agency Flood Insurance
Rate Map (Panel Number 530310 0001 A, dated June 16, 1999), the facility is in a Zone X,
which is defined as: Areas determined to be outside 500-year floodplain. A copy of a portion
of the flood plain map is included in Appendix J.

7. Will the construction of the facility involve significant change in surface features such
as wetland fill, deforestation, or water diversion?
No. The USFWS' Wetlands Online Mapper indicates the nearest wetlands to the project site
are associated with Yelm Creek located approximately one-quarter-mile to the south of the
project site. J.S. Jones and Associates, Inc. completed a Wetland Determination Study for
the proposed project. Adapt obtained the study report (dated June 29, 2007) from the City
of Yelm website and the report states: There are no weflands on the property or within 300
feet of the proposed telecommunications facility. The wetlands map and J.S. Jones and
Associates, Inc. report are included in Appendix K.
The project is adjacent to a stand of trees and clearing and grubbing of the proposed
equipment compound and access road is anticipated, but in Adapt's opinion, this activity
does not constitute deforestation.
The nearest water course to the project appears to be Yelm Creek and the project will not
require water diversion.
8. Will high intensity white lights, if required by the Federal Aviation Administration
(FAA), affect residential neighborhoods?
No. The proposed project includes a new 150-foot monopole. According to the FAA's
Advisory Circular (AC 70/7460-1 K) Obstruction Marking and Lighting, the FAA does not
typically require lighting for communication structures below 200 feet in height or high
intensity white lights for communication structures below 500 feet in height.
4.0 CONCLUSIONS
Adapt responded "No" to each of the eight FCC NEPA actions-questions. In conclusion, it is
Adapt's opinion the proposed T-Mobile facility will have no significant environmental effect on
the eight FCC NEPA actions thus in accordance with 47 CFR Part I, 1.1307, the preparation of
an Environmental Assessment is not necessary.
5.0 LIMITATIONS
The NEPA review is intended to specifically satisfy the requirement of 47 CFR Part I, 1.1307,
and should not be solely relied upon to satisfy federal, state, or local permitting requirements.
Further, the NEPA review questions apply only to the "facility" defined as the areas of the host
parcel that T-Mobile will lease and develop such as a tower compound and access road.
This letter has been prepared for the exclusive use of T-Mobile and their agents for specific
application to the project site. Use or reliance upon this report by a third is at their own risk.

as to the accuracy or completeness of this report or the suitability of its use by such other

at l 6220 Railway Road, S.E. in Yelm. 1'he above referenced project I�as been reviewed on bellalf of die
State Historic Preservation Officer(SHPO)under provisions of Section 106 of the National Historic
Preservation Act of 1966(as amended) and 3G CFR Part 800. My re��ie�;� is based upon documentation
cantained in your coi�iimulic�itions.
In response, I concur that the cwrent praject as proposed�;�ill have "NO ADVERSE EFFECT" on
Nationa] Re�ister eli�ible or listed historic and cultural resources witIiin the�rea of potential effect
(AP�}, Based upou the Historic 1'roperty lnvento�y database entry for this parcel, the present residence
and Uar1�have strong local historical associations���ith the McKenna Lu�uber Company and L.O.
Cochrane. Botli the com��any ai�d the Cocl�rane family appear to have played itnportant roles in the
developl�lent of the Yelm area in the early 20"'century. In addition, the resicience itself is a��ood and
intact example of Craftsman influenced desi��n and distinguished by note«�ortl�y and intact��indows plus
design elements constn�cted of river rock. Also of note is the nearby i�arn tl�at is also l�istoricalty
associated ���ith Coclu•ane fanlily and their long-time residence at this location.
Our concurrence with your°�no adverse effect''detenninatio��is based upon the distance of the proposed
u�onopole fi•om the bain. Based upon the aei-ial pl�oto��rapli and site plan,tl�e�nonopole is about 100 feet
fi-om tlle barn�nd set b�ck frotn Raih��y Road near a small grove of trees. Therefore,the visual impacts
af the monopole on the barn and house are reduced, particularly when compared to the clase proximity of
the nearby electric substation immediately to the east of the residence.

request for our concerns about the proposed communications facility project. While the project is located in the
Squaxin Island Tribe's aboriginal territory, and Squaxin people may have traveled to the area for social and/or
resource gathering purposes, the area was permanently inhabited by the Nisqually Tribe. Therefore, we recommend
that further consultation be conducted with the Nisqually Tribe to acquire their concerns on places of cultural
importance to their people. The Squaxin Island Tribe requires no further consultation on the proposed project.

This letter addresses the proposed communications facilities listed below that you
have referred to the Federal Communications Commission (Commission) for purposes of
contacting federally recognized Indian Tribes, including Alaska Native Villages
(collectively Indian Tribes) , and Native Hawaiian Organizations (NHOs) , as specified by
Section IV.G of the Nationwide Programmatic Agreement (NPA) . Consistent with the
procedures outlined in the Commission's recent Declaratory Ruling (1) , we have contacted
the Indian Tribes or NHOs identified in the attached Table for the projects listed in the
attached Table. You referred these projects to us between 11/29/2007 and 12/06/2007. Our
contact with these Indian Tribes or NHOs was sent on 12/06/2007.
Thus, as described in the Declaratory Ruling (2) , if you or Commission staff do not
receive a statement of interest regarding a particular project from any Tribe or NHO
within 20 calendar days of 12/06/2007, your obligations under Section IV of the NPA with
respect to these Indian Tribes or NHOs are complete (3) . If an Indian Tribe or NHO responds
that it is interested in participating within the 20 calendar day period, the Applicant
must involve it in the review as set forth in the NPA, and may not begin construction
until the process set forth in the NPA is completed.
You are reminded that Section IX of the NPA imposes independent obligations on an
Applicant when a previously unidentified site that may be a historic property, including
an archeological property, is discovered during construction or after the completion of
review(4) . In such instances, the Applicant must cease construction and promptly notify,
among others, any potentially affected Indian Tribe or NHO. An Indian Tribe's or NHO's
failure to express interest in participating in pre-construction review of an undertaking
does not necessarily mean it is not interested in archeological properties or human
remains that may inadvertently be discovered during construction. Hence, an Applicant is
still required to notify any potentially affected Indian Tribe or NHO of any such finds
pursuant to Section IX or other applicable law.

INADVERTENT DISCOVERY PLAN

Recommended Protocol upon Inadvertent Discovery
of Cultural Resources and/or Human Remains
Upon discovery of potential or actual archaeological sites, or cultural resources as defined by
RCW 27.44 Indian Graves and Records Act, and RCW 27.53 Archaeological Sites and Resources,
and/or potential historic properties as defined by the National Historic Preservation Act of 1966,
P.L. 89-665, 16 U.S.C. Section 470 et seq. (NHPA) or human remains and other cultural items as
defined by the Native American Graves Protection and Repatriation Act of 1990, P.L. 101-601, 25
U.S.C. Section 3001 et seq. (NAGPRA), the Contractor shall immediately cease or halt ground
disturbing, construction or other activities around the immediate area of the discovery and secure
the area with a perimeter of not less than thirty (30) feet. If such a perimeter would materially
impact agency functions mandated by law, related to health, safety or environmental concerns,
then the secured area shall be of a size and extent practicable to provide maximum protection to
the resource under the circumstances. After discovery, all findings shall be left in place,
undisturbed and without analysis, until consultation and final disposition of the findings.
Following the finding of possible archeological deposits, the Contractor shall immediately(no later
than four hours) notify the Washington State Department of Archeology and Historic Preservation
(DAHP). During this time, depending on the nature of the discovery, construction activities shall
continue outside the perimeter of the discovery. The Contractor shall ensure that its appropriate
personnel follow procedures stipulated in this Agreement and treat all cultural items and potential
historic properties with respect.
Upon discovery of potential human remains, the Contractor shall immediately(no later than four
hours) notify the Washington State DAHP and the County Coroner. The Coroner will be notified
to determine whether the remains are Native American and to eliminate the site as a crime scene.
Human remains and associated funerary objects shall remain in place, unwashed, uncleaned and
without analysis, covered from public view, and with minimal disturbance by the Coroner in
completing his or her work. After identification of the human remains as Native American and
elimination of the site as a crime scene, the Contractor shall continue to maintain the remains and
any associated funerary objects in place, unwashed, unexamined and undisturbed until their final
disposition.
Except for confidential internal communications and documentation required by law, the
Contractor shall make its best efforts to ensure that its appropriate personnel and permittees keep
the discovery of any found or suspected human remains, other cultural items, and potential historic
properties confidential, including but not limited to, refraining from contacting the media or any
third party or otherwise sharing information regarding the discovery with any member of the
public.
